LOWE'S set up a large SEMI mobile claim center in their parking lot... they did not secure a SPECIAL EVENT permit from the City and considering that they have had some regular site violations with debris, outside storage and rear _ -- site non-compliance — even after several warnings — they do not appear to understand that there are rules in our City. They will be asked to remove it until they come into compliance with all other elements of their site CUP. v ry 2. Staff met with the representatives from CHASE BANK who plan on . redeveloping/renewing the former Burger King site—The image shows Scott Richards and Jenni Pinski learning about the signage and materials proposed. It will be a major upgrade... or so it appears... w � COVID-19 Matters: • This is the Governor's-PORTAL https://mn.gov/covidl9—Many documents/ T Exec.Orders can be found. Washington County has initiated a County Dashboard containing more localized COVID-19 Impacts and rates LINK->>HERE. Other Items: • The City has allowed a dog to be returned to the City—that was removed a few months ago under the POTENTIALLY DANGEROUS DOG ordinance. The Owner is complete some first stage of training and the property owner did not have any objections.Additional training and monitoring E are required.Please see the enclosed Agreement with Mr.Charles Sell. • The City did hold a preconstruction meeting with TA SCHIFSKY for the upcoming mill and overlay project—enclosed are copies of additional communication sent to the impacted areas as well as Project Schedule. • SODIES CIGAR will be having an outside event this weekend.They have secured a Special Event permit. • Andy Swenson and Lisa Danielson repairing the WATER TOWER VALVE near City Hall. The Animal Control Officer or law enforcement officer shall immediately seize and impound any dangerous dog or potentially dangerous dog that is found within the City. The dog will be kept no fewer than ten (10) calendar days. The owner has until the end of this time period to provide written verification that the dog will be legally rernm ed from the City, or that the dog will be euthanized. The owner must pay all associated impounding and boarding costs prior to the release of the dog. Upon its release,the dog shall be immediately transported to a location outside the City. 3. Any such dog that is not properly claimed within ten (10) calendar days shall be humanely euthanized. The owner of the dog that is euthanized shall be responsible to pay the impounding, boarding, and euthanization costs. 4. The owner of any dog declared a "potentially dangerous dog" shall cause the removal of the dog from the City as outlined in 601.14 A. After a minimum of ten days following the removal of the dog, the owner may appeal to the City Administrator to again keep or maintain the dog in the City. Such appeal shall include the following: a. Provide in writing to the City the request to return the dog C. to the City. This letter must be signed (or cosigned) by the property owner. b. Provide veterinarian documentation an all required vac nations baft-r,�e e an t�p t date for such dog. c. Provide documentation that the dog (and any other dog or cat Tin eJs u y licensed.. d. Provide detailed third-party Nmitten certification that the doh as passec�`a �n:zze ao itizen" obedience training test e American Kennel Club; which must be taken (or retaken) after the "potentially dangerous dog" finding has been made. Such certification will include written and signed documentation showing the professional entity the examiner is representing along with proof of liability insurance. The examiner and certifying entity will attest that the dog has shown no signs of aggression or similar behavior, and the dog does not chase or otherwise leave the homeowners property or act in an aggressive manner. This certification 5 of 28 2/16/2022 will include the credentials of the examiner from the AKC showing current standing and type of certification. e, Provide documentation from the property owner's insurance provider that such homeowner's (or other) policy does for liability purposes coyer the dog residing in the ZD residence. f Provide a written signed statement that the dog has not been kept in the City during this appeal process. g. Provide a $50.00 fee payable to the City to-the cover City costs for review of the appeal and its related elements. h. Provide verification that dog will be kept inside a fenced yard capable of containing the animal at all tunes while outside of the residence. Electronic control fences will not meet the criteria of this ordinance. If the dog is taken outside the home and fenced area or removed from the property within this City; the dog will be under control by static leash and muzzle by a person competent to control the animal. B. The City Administrator shall consider this submitted documentation and if all items are complete and in satisfactory condition, the City Administrator shall issue a written finding that the dog may be returned to the City. C. Should the dog subsequently be found as a potentially dangerous dog for a second event, the dog shall be removed from the City consistent with this ordinance and the City shall not afford a secondary appeal process to again return the dog to the City. D. Notwithstanding the provisions found in this Section, in all circumstances the dog, owner and property must be compliant with all other rules and ordinances of the City. E. This Section (601.14) shall not apply to police dogs under the control of a licensed law enforcement officer during the performance of official police activities. 601.t5 Females in Heat. Construction Schedule - is dependent upon the weather Sprinkler Systems and Dog Fences If you have a sprinkler system or dog fence adjacent to the curb and sidewalk replacement areas, it is recommended that you temporarily move sprinkler heads, sprinkler piping and dog fence components away from replacement areas. The contractor is not responsible for damage to sprinkler systems or dog fences within the city right-of-way. Landscaping around mailboxes and in the city right of way is also not the responsibility of the contractor. The contractor will seed the area that is disturbed once the new curb is installed. Pavement Removal The contractor will remove the bituminous wedge (existing pavement along the curb) with a milling machine. The road surface will be drivable during this process. However, all vehicles will need to be parked in a driveway or elsewhere, or the vehicles will be towed at the owner's expense. We ask that you do not park on the street between the hours of 7:00 AM and 7:00 PM during the milling operation. Curb and Sidewalk Removal After the bituminous wedge is removed, an inspection will be made to identify any additional damaged curb. If a curb section is cracked, sunken, heaved, or has large chunks of concrete missing, the curb meets the criteria for removal. These repairs are scheduled to begin following the removal of the bituminous wedge. Curb and sidewalk sections to be removed will be marked with white paint. Driveway Access If curb or sidewalk along your driveway is not marked for removal - park on your driveway at all times. If curb or sidewalk along your driveway is marked for removal, the following applies: 8 of 28 • New curb and sidewalk cannot be driven over for approximately 7 days. The contractor will not warranty concrete that has been driven on before it has fully cured. • If curb is marked in front of your driveway for removal, portions of your driveway may not be accessible at all times. Please avoid parking in front of curb sections marked for replacement. Please contact the project inspector listed below if there are any issues regarding access to your driveway. Boulevard and Grass Restoration The contractor will restore all disturbed boulevards and grass areas with soil, fertilizers, and seed. Paving Operation We ask that you do not park on the street between the hours of 7:00 AM and 7:00 PM during the paving operation. During this process, you will have access to and from your driveway, except for when work is occurring directly in front of your home. The new asphalt pavement can be driven on approximately 30 minutes after placement and final rolling. If you are not sure whether it is ok to drive on the pavement, please ask one of the workers on-site. When driving on new pavement, please avoid making sharp turns or turning tires while your vehicle is not in motion. This will cause scarring of the surface of the pavement. Please refrain from running irrigation systems while the paving process is occurring. Currently,while one bus stop is near a sidewalk and both have a sign and bench,the bus stops on both sides of the street are not paved,potentially presenting a concern for individuals with limited mobility. (SEE: https://www.metrotransit.org/imal)/294 -- STOPS: 7253& 7261 —IMAGES ATTCHED) The City understands that these may not be high traffic bus stops or even stops that are regularly utilized but we would like to ensure equitable accessibility of all the bus stops in our City so that all our residents can benefit. So that you may further understand our perspective,please note that approximately 19.8%of Oak Park Heights residents have some form of disability,which is higher than the national average,of which, 13.9% have ambulatory difficulty.' We can understand these may be older stops that may be coming due for some updates however Metro Transit must ensure that its bus stops have a firm, stable surface to allow passengers to board the bus and to be in compliance with the Americans with Disabilities Act and related updates. Currently,the bus stops at 58t1 Street and Stillwater Blvd do not appear to meet these standards, since they do not have pavement(or other firm surface) at the stops and as a result lack an accessible connection to the off-street/street route. We ask that Metro Transit consider paving the stops and make other necessary improvements to better ensure they are accessible to our community members.And,please let us know the timeline for any such improvements. We are grateful to have bus stops in Oak Park Heights and hope to ensure they are accessible to all, so we look forward to ensuring the accessibly of these stops. At the northbound bus stop, it appears a pad can be added between the curb and trail to make the accessibility improvement, but site measurements are needed to verify. At the southbound bus stop, the site conditions and absence of a pedestrian network are challenges to making the stop accessible. We would like to consider moving the southbound bus stop to the pedestrian crossing preceding the traffic signal, nearside of the intersection. As reflected above, residential values increased by 20.9%; Apartments by 16% and Commercial by 7.2%. Overall total 15.5%increase. The preliminary values reflect no change in Xcel—DOR values as this information is not available until later in the year. 20 of 28 The large increase in EMV of residential properties causes a shift in the class percentage of values for 2022 as compared to 2021. The 4/6/22 Preliminary Values from the County compare the 2022 payable Tax Capacity value of$14,402,888 to payable 2023 Tax Capacity $15,710,815, an increase of $1,307,927. 75% of this increase is in residential values. Although these are preliminary values and are subject to change, it can be concluded that residential properties will share in a greater portion of the tax levy for 2023.
