Endunuuui j CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Thursday, March 10, 2022 Call to Order/Pledge of Allegiance: Chair Freeman called the meeting to order @ 6:00 p.m. Present: Commissioners Freeman, Husby, Van Denburgh, VanDyke and White; City Planner Richards. Absent: City Administrator Johnson and City Councilmember Liaison Representative Liljegren. II. Approval of Agenda: Commissioner White, seconded by Commissioner VanDyke, moved to approve the Agenda as presented. Carried 5-0. III. Approval of November 18, 2021 Meeting Minutes: Commissioner Van Denburgh, seconded by Commissioner White, moved to approve the Minutes as presented. Carried 4-0. IV. Department/ Commission Liaison/ Other Reports: None. V. Visitors/Public Comment: None. VI. Public Hearings: A. Minnehaha Transportation, Inc. CUP: Review and consider request for a Conditional Use Permit to allow outside truck storage, truck repair and body shop at 5280-5288 Stagecoach Trail,N. City Planner Richards reviewed the March 3, 2022 Planning Report to the request, providing background information with regard to earlier approvals to the site. Richards provided an issue analysis and discussed the same, noting staff recommendation for approval, subject to the conditions noted within the planning report. Brief discussion ensued as to previous site approval requirements, zoning and compatible uses, and comprehensive plan designation for the area. Chair Freeman invited the applicant to address the Commission. Idiris Mohamud, the applicant and owner of Minnehaha Transportation Properties, advised the Commission that the business is to be owner operated and engaged in discussion with the Commission with regard to issues related to the proposed operation, including vehicle noise, numbers of vehicles anticipated to be on site,hours of operation, signage, and the recommended condition of Annual Review. Planning Commission Minutes March 10, 2022 Page 2 of 4 Chair Freeman opened the public hearing at 6:18 p.m. and invited public comment. John LeMire-5598 Penrose Ave. N. stated that he had come with concern regarding noise with the body shop proposal but after the information shared, he had no objection to the request. Commissioner VanDyke, seconded by Commissioner White, moved to close the public hearing at 6:22 p.m. Carried 5-0. Commissioner White, seconded by Commissioner Van Denburgh, moved to recommend City Council approval of the request subject to the amended conditions of the March 3, 2022 Planning Report, specifically, that: 1. The number of truck vehicles including truck only, tractor only, trailer only, or combination truck-trailer allowed onsite and stored outdoors shall not exceed 85. 2. All employees dispensing fuel shall receive training for proper fueling techniques including emergency spill response procedures. 3. The Applicant shall submit a Spill Prevention and Control Countermeasure Plan to the EPA and to the City, if required. 4. The Applicant shall receive and retain a Hazardous Waste Generators License from Washington County for the repair operation. 5. The Applicant shall comply with all Building Code requirements for the fuel tank and installation of a paint booth. A Building Permit shall be required from the City for the fuel tank and paint booth installation. 6. The Applicant shall provide a plan for noise and exhaust mitigation for review by the City. All air quality standards of the Minnesota Pollution Control Agency shall be complied with. 7. A rapid entry lock box shall be maintained at the entrance gate to provide police, fire and emergency services access. 8. Any changes to the grading, drainage and utilities shall be subject to the review and approval of the City Engineer. 9. All lighting fixtures shall be full cut off and replaced/installed in compliance with the lighting standards of the Zoning Ordinance. 10. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. Planning Commission Minutes March 10, 2022 Page 3 of 4 11. The City Arborist should comment if there are any tree maintenance issues or if additional trees should be added for screening and the Applicant shall take appropriate corrective measures. A tree plan shall be subject to approve of the City Arborist. 12. Signage shall be subject to review and approval of City Staff for conformance with City Zoning Ordinance standards. 13. All noise generated from the business shall be compliant with Section 401.15.B.11 of the Zoning Ordinance. The service doors to the building shall be closed at all times except when vehicles are moved in and out of the service bays. 14. Mechanical equipment that is located on the roof or visible from street level or neighboring properties shall be screened with materials that blend harmoniously with the building façade materials and in accordance with Section 401.15.E.10.e of the Zoning Ordinance. 15. There shall be no outside storage, including tires and vehicle parts unless enclosed with a screen. No storage shall be allowed in trailers that are parked on the property. 16. Hours of operation shall be limited to 7:00 AM to 9:00 PM, Monday through Friday and 8:00 AM to 5:00 PM, Saturday and Sunday except for emergency truck repair drop offs. The operations shall cease and the entrance gate shall be locked no later than 15 minutes after the approved closing times or emergency truck repair drop off. 17. All employees shall be assigned a designated parking stall. No employee or client vehicle parking shall be allowed on Stagecoach Trail. 18. There shall be no overnight stays by clients. 19. If truck backing alert systems create a noise issue for surrounding properties, the City Council shall review the Conditional Use Permit and conditions of approval. 20. Annual review is imposed as a condition of the Conditional Use Permit. This permit shall be reviewed on or about October 1 of each year and may be amended or altered at the discretion of the City Council through an amended Conditional Use Permit. 21. Emergency vehicle access and business operations related to fuel dispensing shall be subject to review of the Police Chief and Fire Marshal. Planning Commission Minutes March 10, 2022 Page 4 of 4 22. All Conditional Use Permits previously issued by the City of Oak Park Heights for 5280 and 5288 Stagecoach Trail N. shall be deemed revoked and cancelled as part of and in consideration of the granting of this new Conditional Use Permit. The existing building will be used which was built as a Burger King. The building will be remodeled and updated and will include a drive up ATM, but not a drive up window. The PUD Amendment is required in that it is a change to the original site approvals plan. The PUD/CUP for the Bruger King was approved in May of 1999 as part of the Oak Park Ponds development. The request is for a Conditional Use Permit and Design Guideline Review for full interior renovation and exterior building renovation of the existing vacant Burger King Franchise located at 5907 Neal Avenue, Oak Park Heights to transform the building into a full- service Chase Bank complete with drive-up night drop and ATM. The facility will also have an additional 24-hour ATM in the building vestibule. Interior fit out includes removal of all no-load bearing walls, interior finishes, equipment, and fixed furniture will be removed. New interior walls finish, and bank equipment will be installed per the layout attached to this application. The Conditional Use Permit is for the ATM/night drop drive-up and signage. A Conditional Use Permit for a drive-through and signage was previously approved for the vacant Burger King on May 25, 1999, under File Number 798.02-99.04. Please note that the proposed improvements include an ATM/night drop drive-up only. The facility will not include a full drive-through as vehicles will not be able to communicate directly with a teller inside the building. The site has been vacant for some time and Chase Bank is looking to make site improvements to raise the overall face the building presents to the community. Existing façade masonry is to be power washed and existing EFIS will be repaired and painted to match the light accent stone on the building (see color renderings attached to the application). Chase also plans to update the overall appeal of the façade and break up the previous Burger King designed architecture with Nicha Fiber cement accent panels at the new entry canopy, upper parapet of the existing tower, and new ATM canopy. The existing parking lot is to be milled, resurfaced, and restriped. Existing light poles and fixtures will be replaced, damaged curbing will also be replaced and a new accessible sidewalk from the building to the existing pedestrian pathway along Neal Avenue will be installed. The bank is proposing a total of four signs for the location, one on each façade. All signs are scaled to be below the 15 percent of wall requirement outlined in the code and total proposed sign area for the location is below the 150 square feet for the property. Please note that the previously approved Conditional Use Permit allowed for signage of 64 square feet for each sign. Existing landscaping is described in the enclosed landscape plan. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The use of the site as retail, office and restaurant buildings is consistent with the Comprehensive Plan. 2 Zoning. The property is zoned PUD Commercial Planned Unit Development. The development was approved as a PUD and the Applicant has now requested a PUD Amendment to allow for site and building design. A Conditional Use Permit is required for the ATM drive-thru and for signage allowances. Section 401.301.E of the Zoning Ordinance provides the review criteria for the drive-thru request. The drive thru as designed complies with the criteria. Drive Thru ATM. A drive thru ATM will be installed, but no window is proposed for a teller. There is adequate space for seven vehicles in the stacking lane and a bypass lane is provided. The ATM lighting will need to be limited to the screen and operational portions, but the entire machine shall not be internally lit. A plan for directional signage to the ATM was not provided, but if any is proposed, it shall be subject to review of the City. Parking/Access. The parking and access for the site will not change from existing. The parking lot will be resurfaced and restriped. Setbacks. Building, parking, and driveway setbacks will not be changed with the improvements to the site. Pedestrian Access. The site plan indicates that a sidewalk from the trail on Neal Avenue to the building is to be constructed. Parking. The parking for the site will not change. The site has cross easements for access and parking throughout the Oak Park Ponds Development. Adequate parking is provided for the shopping center. Landscaping. The submitted landscape plan is subject to City Arborist review and approval. City Arborist comments are found as Exhibit 11 . Lighting. The lighting plan indicates the locations of the parking lot and site fixtures. The lighting specifications indicate that the fixtures to be used in the parking lot will be full cut off and LED. The maximum height of the pole and fixture is not to exceed 25 feet as per the Zoning Ordinance. The building light fixtures indicate the use of a compliant, full cut off fixture. The photometric plan has been provided and is consistent with the requirements of the Zoning Ordinance. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to lighting requirements. Trash/Recycling. All trash and recycling storage shall be within the building. No outside storage area is proposed. Mechanical Screening. All mechanical equipment shall be required to be screened as provided in accordance with the Zoning Ordinance requirements. 3 Grading, Drainage, Erosion Control and Utilities. No changes are proposed that would require grading, drainage, erosion control, and utility plans. Any change to the site that requires engineering review is subject to review and approval by the City Engineer. Signage. Freestanding Sign. No freestanding sign is proposed for this site. Wall Signage. The Zoning Ordinance would allow for three wall signs, each on a separate façade for the Chase building. The elevation plans indicate the Chase name with the logo on three sides of the building, and the logo on just the south facade. Staff would allow the Chase/Logo signs even though they are not connected, as one sign. The Ordinance would allow a total of 150 square feet of wall signage and the four signs total 135 square feet. The fourth sign can be allowed through Conditional Use Permit/Planned Unit Development approvals. The Planning Commission should discuss this request. Sign Illumination. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. The building signage will be individual lit channel letters, attached to the face of each elevation. The sign lighting should be designed such that only the text and logo portions of the signs are to be lit at night. The sign background will need to be dark. Design Guidelines. Architectural Guidelines. Façade Treatments The façades feature differences in materials, strong vertical and horizontal elements, and a varied roof line to provide architectural interest. Ground Level Expression The building is one story with visibility to Neal Avenue North. The building has been constructed such that the brick, windows and detailing will be featured on each elevation other than the rear that faces an adjacent building. Transparency The design of the building and transparency is not changing with this existing building. There is significant transparency at the front entrance that faces the corner of Neal Avenue North and the entrance to the shopping center. Entries The building features a prominent entry on the two facades with entry doors. A canopy will be installed to mark the main entrance. 4 Roof Design The roofline of the building features varying parapet heights to break up the roofline. The rooftop mechanical equipment will be completely screened within the parapet of the buildings. The building is one story and less than 35 feet in height. Building Materials and Colors The Applicant has provided color elevations for review. The primary building materials of the buildings are masonry, stone, EIFS, glass, and Nichia Fiber cement accent panels. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building was originally a franchise design, but the new design and materials comply with the Design Standards. Site Design Guidelines Building Placement The building is existing and will not be altered in size. Parking Areas The parking area is not changed with this project. Storm water No grading or drainage changes are proposed. Pedestrian and Common Space Pedestrian access to Neal Avenue North has been added from the building. Landscaping Building perimeter plantings are provided for the building. The landscape plan has been reviewed by the City Arborist. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. Utilites Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. Signage Addressed elsewhere in the planning report. 5 Pedestrian/ Bicycle Routes A bike rack will be required for the building. The Applicant should identify a location. CONCLUSION / RECOMMENDATION Subject to the preceding review, City staff recommends approval of the following listed requests for a Chase Bank at 5907 Neal Avenue North, subject to the conditions that follow: • Planned Unit Development Amendment • Conditional Use Permit for ATM Drive Thru and Signage • Design Guidelines/Site Plan Review 1 . The final plans for the ATM and associated lighting shall be subject to review and approval of the City. 2. Any proposed directional signage shall be subject to review of the City and can only include the name and logo of the business. 3. Any changes to the grading, drainage, erosion control, utility plans are subject to review and approval of the City Engineer. 4. The landscape plan shall be subject to the review and approval of the City Arborist. All required landscape plan details shall be submitted to the satisfaction of the City Arborist. 5. All mechanical equipment on the roof or on the site shall be fully screened in accordance with the provisions of the Zoning Ordinance. 6. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to lighting requirements. The maximum height of the parking lot poles and fixtures is not to exceed 25 feet as per the Zoning Ordinance. 7. One wall sign per façade shall be allowed. A discussion of the proposed project with respect to the City of Oak Park Heights Design Guidelines is provided below: Sustainable Development • Site Planning: o The proposed improvements occupy the existing site envelop and will limit the environment impacts of building and the surrounding ecosystem. • Indoor Environmental Quality: o Equipment specified in for Chase Bank projects is designed per ASHRAE 90.1 indoor ventilation standards to exceed outside air requirements for all conditioned spaces within the building.Calculations factor in zone population and area to ensure adequate fresh air is provided to building occupants at all times.All RTUs are provided with economizers allowing them to provide up to 100%of their supply air volume with outside air when conditions allow.The air distribution system is also provided with controls allowing for separate temperature control of commonly occupied spaces including,bank lobbies,offices and break rooms,as well as separate systems to control heat from ATM and IT equipment. Typically,water closets are the greatest source of water consumption in most banks,and as a standard these are replaced with 1.0 gpf low flow fixtures as part of the plumbing design. New water heaters are also provided with recirculation pumps as a means to save energy and water consumption by ensuring how water is available as close to fixtures as possible. Architectural Guidelines • Facade Treatments o Defined Base, Middle and Top ■ Facade improvements include addition of Nichia Fiber cement accents panels at the new entry (base/middle)canopy,upper(Top)parapet of the existing tower,and new(base/middle)ATM Canopy.The other existing accents and EIFS cornices are to be cleaned repaired and reused.(See color elevations attached to this application.) o Distinct Modules • Chase proposes breaking up the articulation of the east and west facades of the existing building by adding Nichia Fiber cement accents panels at the new entry canopy,upper and new ATM Canopy. o Entries ■ The existing entry on east side of building is proposed to be reused.Chase is proposing installation of a new sidewalk to provide foot traffic access from the right of way.A new entry canopy will be installed to mark the main entrance and is intended to match existing storefront system. o Awnings ■ Awnings are not proposed.Chase is proposing a new front entry canopy.(Noted above.) • Ground Level Expression: o Location is a single-story building. • Transparency-Window&Door Openings o Window and Door Design/Levels of Transparency • Existing storefront design and entry to remain.Floor plan has been oriented in such a fashion as to use existing building elements of entry,corner tower and drive thru.Back of house functions have been placed in such a location as to make use areas without glazing. • Entries o The existing entry on east side of building is proposed to be reused.Chase is proposing installation of a new sidewalk to provide foot traffic access from the right of way.A new entry canopy will be installed to mark the main entrance and is intended to match existing storefront system.Chase is also proposing a material change with the inclusion of Nichia Fiber cement accents panels to mark the entry on the east. • Roof Design o Roof Design/Rooftop Equipment • Existing roof is scheduled for replacement in kind.existing Mechanical systems are also scheduled for replacement.It is expected that Chase will reduce the number of rooftop units required as well as make use of existing rooftop location to meet the screening requirements as outline in the current design guidelines. No exterior trash enclosure is proposed. • The existing drive-up area is currently screened with existing landscaping. • Lighting: o Fixtures: • The existing site poles and fixtures will be replaced with energy-efficient,full cut-off fixtures.Accent Wall sconces and recessed can fixtures in the proposed entry and atm canopy are compatible with the architecture of the building.(See attached photometric and color elevations) • Signage: o Wall and Projecting Signs: • The proposed wall signs are positioned so they are an integral design feature.The proposed signs do not obscure architectural features. o Shape: • The proposed signs are compliment and in scale with the architecture of the building. o Colors: • The proposed sign colors are compatible with the building facade.Two colors(white and a soft blue)are proposed. o Materials: • Proposed signage consists of Internal LED luminated "CHASE"channel letter sets and Octagon. The following includes my comments and/or recommendations: Landscape Plan (Sheet C7-0) The landscape plan submitted includes keeping the existing plantings already located on the site with no new plantings proposed. After reviewing the landscape plan and visiting the site I noticed many of the existing trees located on this site are ash and maple. There are also a few trees on this site that are in poor condition. 1. Due to Emerald Ash Borer (EAB) being found within the City of Oak Park Heights last summer and infestations currently expanding throughout the City, I would recommend removing all of the ash trees on the site along with the trees in poor condition and replacing the trees with something other than maple trees to work towards the Minnesota DNR community tree canopy 20-10-5 guidelines. This means a community has no more than 20% of their trees within a single family, no more than 10% of their trees within a single genus and no more than 5% of their trees within a single species. As the City of Oak Park Heights strives to work towards this goal this means avoiding planting any additional maple trees throughout the City. 2. Replacement trees to be planted must be hardy under local growing conditions, tolerant and/or resistant to major insect and disease problems and fairly low maintenance.All plant sizes, root and container classes included in the plan must conform to the City of Oak Park Heights zoning ordinance requirements. TREE CITY U.S.A. 3. Update the Landscape Plant List to include the replacement trees to be planted and updated information. 4. Update the Landscape Plan to include the proposed locations of the replacement trees to be planted. Landscape Details Planting Notes/Planting Detail The landscape notes and planting detail was not submitted. Please include the following items on the final plans: 1. All trees must be landscape grade trees of good form and structure not Park Grade trees. Trees with poor form will be more prone to storm damage and failure in the future. Please include this in the planting notes. 2. Burlap, wire and all rope must be removed from the top 12" of the root ball on all trees. 3. All trees must be straight and not need staking after planting. Contractor shall stake trees only if the tree(s) begin to lean within the guarantee period, please include this in the final planting notes. 4. The landscape contractor is required to plant trees and shrubs according to the approved planting detail diagrams and landscape notes submitted with the final approved landscape plan. The lot was previously part of the Eagles Club property. It is situated at Highway 36 and Norell Avenue North. The site was planned to be redeveloped with two buildings, one which is a Panera Bread with a drive thru that was approved in June of 2018. The second lot, to the south of the Panera Bread is proposed for a Popeyes Restaurant. The Planned Unit Development allowed for a multi building shopping/restaurant development with joint signage, access, and parking. The site is zoned B-4 Limited Business District that allows retail and restaurant development. The Parikh Network is proposing a 2515 SF Popeyes Restaurant located on a 0.88 acre parcel located at the southwest corner of 60th Street and Norell Avenue in Oak Park Heights, Minnesota. The parcel is Lot 2 of the Ridgecrest Oak Park Heights development. Lot 2 is situated directly south of Lot 1 which contains an existing Panera Bread restaurant. The proposed restaurant will include construction of a new drive thru lane, minor revision to parking and sidewalk, site lighting, landscaping, and a new dumpster enclosure. The majority of the existing parking lot will remain unchanged with the development and provide adequate parking for the restaurant. A total of 39 spaces, including two accessible spaces will be provided with the project. Original plans for the overall Ridgecrest development from 2018 included a 6,720 square SF retail building with no drive thru lane on Lot 1. As part of that project, an underground detention vault was provided beneath the parking lot to provide stormwater detention for the planned retail building. Rain gardens were also incorporated in the landscape island to provide water quality for the project. Based on these previously provided stormwater systems, additional stormwater detention and water quality features have not been provided with the Popeyes project. Proposed storm sewer added with the project will tie into the underground detention system. Utility stubs for sanitary sewer and watermain have been provided on the east side of Lot 2 for use by the proposed restaurant. Proposed electric and gas will connect directly to the existing facilities within the Norell Avenue right-of-way. 2 Per the City Code, the project will require a Conditional Use Permit due to the proposed drive thru lane, which includes a site plan review, public hearing, and City Council approval. The project will incorporate a dual drive thru lane to minimize stacking distance. Based on the location of the restaurant, stacking will be limited to the project site without potential for back-up on 60th Street North during peak operational periods. Direct access to Norell Avenue is not provided with the project so any interruption of existing traffic movements along that road is not expected either. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The use of the site as restaurant buildings is consistent with the Comprehensive Plan. Zoning. The property is zoned B-4 Limited Business District that allows retail and restaurant use as a permitted use. Developments with joint signage, access and parking require a Planned Unit Development overlay. The Concept and partial General Plan phases of the process were completed in June of 2018 with approval of the development including the Panera Bread. A General Plan approval is now required for the Popeyes Restaurant. A conditional use permit has been requested to allow a drive thru for the Popeyes Restaurant. Section 401.301.E of the Zoning Ordinance provides the review criteria for this request. The drive thru as designed complies with the criteria. Subdivision. The property has been subdivided as Ridgecrest Oak Park Heights I with one lot for each of the two buildings. As indicated, the Popeyes Restaurant is on Lot 2. Setbacks. Building setbacks required in the B-4 District are a 40-foot front yard setback, 10-foot side yard setback and 20-foot rear yard setback. The Planned Unit Development would allow flexibility in the setback requirements. The proposed building would be 38 feet to the Norell Avenue right of way, 25 feet to the property line to the north, and 53 feet to the south property line. The building is adequately setback from the property lines and consistent with the original Concept Plan. All parking and drive aisles must be set back at least ten feet from the property line. The drive thru lane setback to the south property line is at the narrowest point five feet. The Planning Commission should comment on the proposed setbacks. Traffic Circulation/Curb Cuts. The site is accessed by 60th Street North at the north side of the property and 59th Street to the south that is currently under construction. This access is shared with the office building to the west. The plan shall be subject to review by the Fire Marshal for emergency vehicle access. Pedestrian Access. There is an existing sidewalk on the south side of 60th Street North and additional sidewalk access will be provided as part of the 59th Street project. 3 Parking. The following table provides an analysis of proposed and required parking spaces. Building Parking Requirements and Calculation Required Spaces Lot 1 Building Shopping Center: 6 Spaces per 1,000 24 Square Feet 4,500 x .9 = 4,050 / 166 = 24 Lot 2 Building Shopping Center: 6 spaces per 1,000 14 Square Feet 2,515x .9 = 2,263 / 166 = 14 TOTAL 38 Per ordinance, based upon the shopping center parking requirements and the size of the buildings, the site would require 38 parking spaces. The proposed site plan indicates a total of 83 spaces, 44 spaces on Lot 1 and 39 stalls on Lot 2. There are cross easements for parking and access throughout the development. The plans indicate two disability stalls adjacent to the front entrances of the proposed building, which will be adequate for Popeyes. Drive-Thru for Restaurants. The Popeyes building has been designed with dual order lanes for the drive thru. The lanes would allow for a vehicle at each order board and four cars in the stacking area. That will be adequate for most hours of operation, but at times stacking may occur in the parking lot. The plans include a canopy structure and the menu board for each order lane. The restaurant drive thru requires a conditional use permit and the final plans for the directional signs, menu boards, the canopies and associated lighting will be subject to review by the City. Snow Storage. The plans do not indicate an area for snow storage. The applicant shall indicate where the snow is to be stored. Snow storage shall not interfere with parking stalls. Landscaping. The submitted landscape plan is subject to City Arborist review and approval. City Arborist comments are found as Exhibit 23. Lighting. The lighting plan indicates the locations of the parking lot and site fixtures. The lighting specifications indicate that the fixtures to be used in the parking lot will be full cut off and LED. The maximum height of the pole and fixture is not to exceed 25 feet as per the Zoning Ordinance. The building light fixtures will be required to be compliant, full cut off fixtures. The photometric plan has been provided and is consistent with the requirements of the Zoning Ordinance. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. 4 Trash Storage. The plans show the location and design of a trash enclosure. The material colors will be required to match the building. Mechanical Screening. The plans for the Popeyes indicate that the parapet walls are designed to screen the mechanical equipment. All mechanical equipment shall be required to be screened as provided in accordance with the Zoning Ordinance requirements. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. Storm water issues are also subject to review and approval by the Brown's Creek Watershed District. Signage. Freestanding Sign. The plans indicate one proposed monument sign. The Ordinance allows for one freestanding sign per lot and two additional freestanding signs on the same lot if constructed as a monument. The freestanding signs will need to be setback at least five feet from the property lines. The proposed monument sign is eight feet in height and two square feet in width with a sign area of 3.75 square feet each on two sides. It is adequately set back from Norell Avenue. The monument sign is required to be landscaped at the base. Wall Signage. The Zoning Ordinance would allow for three wall signs, each on a separate facade for the Popeyes building. The elevation plans indicate multiple signs including logo signs on three facades. The Ordinance would allow a total of 150 square feet of wall signage. Staff recommends that one sign per façade be allowed, with the choice of the sign at the discretion of the Applicant if the total wall signage not exceed 150 square feet or 80 square feet per sign. If a sign is not placed on the rear facade, two signs may be placed on one of the facades. This recommendation is consistent with other sign approvals in the Highway 36 corridor. The fourth sign can be allowed through Conditional Use Permit/Planned Unit Development approvals. The Planning Commission should discuss this request. Sign Illumination. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. The sign and order board lighting should be designed such that only the text and logo portions of the signs are to be lit at night. The sign background will need to be dark. Design Guidelines. Architectural Guidelines. 5 Facade Treatments The façades feature differences in materials, strong vertical and horizontal elements, and a varied roof line to provide architectural interest. Ground Level Expression The building is one story with visibility to Highway 36. The building will be constructed such that the brick, windows and detailing will be featured on each elevation other than the rear that faces Norell Avenue. Improvements with detailing and materials should be made to that elevation. Transparency The Design Guidelines requires at least a 20 percent glass on ground floor, street facing facades. The Popeyes building will feature glass of 28.4 percent on the front side, the west elevation; 22 percent on the entrance side, the south elevation; 2.5 percent on the drive thru side, the north elevation; and 0.8 percent on rear side, the east elevation facing Norell Avenue. The Planning Commission should comment on the rear façade facing Norell Avenue. Although transparency requirements may not be met, the appearance of the façade should be improved with additional detailing and use of materials. Entries The building features prominent entries with canopies. Roof Design The roof of the building features varying parapet heights to break up the roofline. The rooftop mechanical equipment will be completely screened within the parapet of the buildings. The building is one story and less than 35 feet in height. Building Materials and Colors The Applicant has provided color elevations for review. The primary building materials of both buildings are Nichiha fiber cement brick and wood, EIFS and painted metal canopies. A building material sample exhibit has been provided. Franchise Architecture The building is a franchise design, but the design and materials comply with the Design Standards. Site Design Guidelines Building Placement The buildings is well placed on the site and will be a prominent feature of the intersection at 59th Street North and Norell Avenue. 6 Parking Areas The parking area is landscaped with perimeter plantings as well as plantings within the parking lot. Storm water Stormwater will be addressed by the City Engineer. Pedestrian and Common Space Adequate pedestrian access is provided to the building entrances. There is no outside seating planned for this restaurant. Landscaping Building perimeter plantings are provided for the building. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. Utilites/Service/Loading/Drive-Through/Storage Areas Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. The following includes my comments and/or recommendations: Landscape Plan (Sheet No. C500) The overall design of the plan is attractive and will complement the building well. The plan includes an acceptable species selection of deciduous trees, evergreen trees, evergreen shrubs and groundcover grasses to be installed ((207) plantings total). The plants included in the plan are hardy under local growing conditions, tolerant and/or resistant to major insect and disease problems and fairly low maintenance. All plant sizes, root and container classes included in the plan conform to the City of Oak Park Heights zoning ordinance requirements. Landscape Details (Sheet No. C500) Planting Notes/Planting Detail The landscape notes and planting detail submitted is incomplete. Please include the following items on the final plans: 1. All trees must be landscape grade trees of good form and structure not Park Grade trees. Trees with poor form will be more prone to storm damage and failure in the future. Please include this in the planting notes. 2. Burlap, wire and all rope must be removed from the top 12" of the root ball on all trees. TREE CITY U,S.A. 3. All trees must be straight and not need staking after planting. Contractor shall stake trees only if the tree(s) begin to lean within the guarantee period, please include this in the final planting notes. 4. The landscape contractor is required to plant trees and shrubs according to the approved planting detail diagrams and landscape notes submitted with the final approved landscape plan. This will be checked after planting and any deviations from the plans must be corrected before the landscaping will be approved by the City, this needs to be noted in the final plans. 5. Planting detail diagrams must be included on the plan sheet(s) for: -Deciduous Trees -Evergreen Trees -Shrubs -Perennials -Maintenance Strip (Sod edge, seeding, landscape edging, mulch) 6. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Worker's License for 2022 from the City of Oak Park Heights Building Department. All required documents must be submitted with the application. 7. The City Arborist will conduct an Initial Landscape Inspection after all plants/trees, mulch, ect. have been installed. 8. The City Arborist will conduct a Final Landscape Inspection typically (1) year after installation, at the end of the plant guarantee period. For Final Acceptance of Installation and Landscape Plants the specified planting procedures must have been followed and all plants must be alive and in good condition at the end of the plant guarantee period. The City reserves the right to inspect the construction of the project. The City or its designee shall be present for water and sanitary sewer service connections to the City's systems. 2. The Owner will need to comply with all requirements of the NPDES Construction Stormwater Permit and Browns Creek Watershed District. The City reserves the right to require additional erosion control measures as determined/necessary during the construction of the project. 3. Review of issues related to parking, lighting, landscaping, fire department access or the buildings is by others. 4. The Owner shall be responsible for obtaining all required permits. 5.
