BACKGROUND
Dan McAuley of Bergmann Architectural Associates, Inc. has made application for
Planned Unit Development Amendment, Conditional Use Permit for an ATM drive thru
and signage, and Design Standards, Site Plan Review for a Chase Bank at 5907 Neal
Avenue North. The existing building will be used which was built as a Burger King. The
building will be remodeled and updated and will include a drive up ATM, but not a drive
up window. The PUD Amendment is required in that it is a change to the original site
approvals plan. The PUD/CUP for the Bruger King was approved in May of 1999 as
part of the Oak Park Ponds development.

PROJECT DESCRIPTION
The complete Project Narrative for the project is found as Exhibit 1.
The request is for a Conditional Use Permit and Design Guideline Review for full interior
renovation and exterior building renovation of the existing vacant Burger King Franchise
located at 5907 Neal Avenue, Oak Park Heights to transform the building into a full-
service Chase Bank complete with drive-up night drop and ATM. The facility will also
have an additional 24-hour ATM in the building vestibule. Interior fit out includes
removal of all no-load bearing walls, interior finishes, equipment, and fixed furniture will
be removed. New interior walls finish, and bank equipment will be installed per the
layout attached to this application.
The Conditional Use Permit is for the ATM/night drop drive-up and signage. A
Conditional Use Permit for a drive-through and signage was previously approved for the
vacant Burger King on May 25, 1999, under File Number 798.02-99.04. Please note
that the proposed improvements include an ATM/night drop drive-up only. The facility
will not include a full drive-through as vehicles will not be able to communicate directly
with a teller inside the building.
The site has been vacant for some time and Chase Bank is looking to make site
improvements to raise the overall face the building presents to the community. Existing
façade masonry is to be power washed and existing EFIS will be repaired and painted
to match the light accent stone on the building (see color renderings attached to the
application). Chase also plans to update the overall appeal of the façade and break up
the previous Burger King designed architecture with Nicha Fiber cement accent panels
at the new entry canopy, upper parapet of the existing tower, and new ATM canopy.
The existing parking lot is to be milled, resurfaced, and restriped. Existing light poles
and fixtures will be replaced, damaged curbing will also be replaced and a new
accessible sidewalk from the building to the existing pedestrian pathway along Neal
Avenue will be installed.
The bank is proposing a total of four signs for the location, one on each façade. All
signs are scaled to be below the 15 percent of wall requirement outlined in the code and
total proposed sign area for the location is below the 150 square feet for the property.
Please note that the previously approved Conditional Use Permit allowed for signage of
64 square feet for each sign.
Existing landscaping is described in the enclosed landscape plan.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Commercial on the Proposed
Land Use Map. The use of the site as retail, office and restaurant buildings is
consistent with the Comprehensive Plan.

Zoning. The property is zoned PUD Commercial Planned Unit Development. The
development was approved as a PUD and the Applicant has now requested a PUD
Amendment to allow for site and building design. A Conditional Use Permit is required
for the ATM drive-thru and for signage allowances. Section 401.301.E of the Zoning
Ordinance provides the review criteria for the drive-thru request. The drive thru as
designed complies with the criteria.
Drive Thru ATM. A drive thru ATM will be installed, but no window is proposed for a
teller. There is adequate space for seven vehicles in the stacking lane and a bypass
lane is provided. The ATM lighting will need to be limited to the screen and operational
portions, but the entire machine shall not be internally lit. A plan for directional signage
to the ATM was not provided, but if any is proposed, it shall be subject to review of the
City.
Parking/Access. The parking and access for the site will not change from existing.
The parking lot will be resurfaced and restriped.
Setbacks. Building, parking, and driveway setbacks will not be changed with the
improvements to the site.
Pedestrian Access. The site plan indicates that a sidewalk from the trail on Neal
Avenue to the building is to be constructed.
Parking. The parking for the site will not change. The site has cross easements for
access and parking throughout the Oak Park Ponds Development. Adequate parking is
provided for the shopping center.
Landscaping. The submitted landscape plan is subject to City Arborist review and
approval. City Arborist comments are found as Exhibit 11.
Lighting. The lighting plan indicates the locations of the parking lot and site fixtures.
The lighting specifications indicate that the fixtures to be used in the parking lot will be
full cut off and LED. The maximum height of the pole and fixture is not to exceed 25 feet
as per the Zoning Ordinance. The building light fixtures indicate the use of a compliant,
full cut off fixture. The photometric plan has been provided and is consistent with the
requirements of the Zoning Ordinance.
All light fixtures shall be full cut off, compliant with the height requirements, and be
consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to lighting
requirements.
Trash/Recycling. All trash and recycling storage shall be within the building. No
outside storage area is proposed.
Mechanical Screening. All mechanical equipment shall be required to be screened as
provided in accordance with the Zoning Ordinance requirements.

Grading, Drainage, Erosion Control and Utilities. No changes are proposed that
would require grading, drainage, erosion control, and utility plans. Any change to the
site that requires engineering review is subject to review and approval by the City
Engineer.
Signage.
Freestanding Sign. No freestanding sign is proposed for this site.
Wall Signage. The Zoning Ordinance would allow for three wall signs, each on a
separate facade for the Chase building. The elevation plans indicate the Chase name
with the logo on three sides of the building, and the logo on just the south facade. Staff
would allow the Chase/Logo signs even though they are not connected, as one sign.
The Ordinance would allow a total of 150 square feet of wall signage and the four signs
total 135 square feet. The fourth sign can be allowed through Conditional Use
Permit/Planned Unit Development approvals. The Planning Commission should
discuss this request.
Sign Illumination. The signs will be required to comply with the Zoning Ordinance
lighting requirements. Staff will approve the lighting specifications for the signs at the
time of permitting. The building signage will be individual lit channel letters, attached to
the face of each elevation. The sign lighting should be designed such that only the text
and logo portions of the signs are to be lit at night. The sign background will need to be
dark.
Design Guidelines.
Architectural Guidelines.
Façade Treatments
The façades feature differences in materials, strong vertical and horizontal
elements, and a varied roof line to provide architectural interest.
Ground Level Expression
The building is one story with visibility to Neal Avenue North. The building has
been constructed such that the brick, windows and detailing will be featured on
each elevation other than the rear that faces an adjacent building.
Transparency
The design of the building and transparency is not changing with this existing
building. There is significant transparency at the front entrance that faces the
corner of Neal Avenue North and the entrance to the shopping center.
Entries
The building features a prominent entry on the two facades with entry doors. A
canopy will be installed to mark the main entrance.

Roof Design
The roofline of the building features varying parapet heights to break up the
roofline. The rooftop mechanical equipment will be completely screened within
the parapet of the buildings. The building is one story and less than 35 feet in
height.
Building Materials and Colors
The Applicant has provided color elevations for review. The primary building
materials of the buildings are masonry, stone, EIFS, glass, and Nichia Fiber
cement accent panels. Building material samples will be available at the Planning
Commission meeting.
Franchise Architecture
The building was originally a franchise design, but the new design and materials
comply with the Design Standards.
Site Design Guidelines
Building Placement
The building is existing and will not be altered in size.
Parking Areas
The parking area is not changed with this project.
Storm water
No grading or drainage changes are proposed.
Pedestrian and Common Space
Pedestrian access to Neal Avenue North has been added from the building.
Landscaping
Building perimeter plantings are provided for the building. The landscape plan
has been reviewed by the City Arborist.
Trees/Shrubs
The trees and shrubs used in the landscape plan shall be subject to the review
and approval of the City Arborist.
Utilites
Addressed elsewhere in the planning report.
Lighting
Addressed elsewhere in the planning report.
Signage
Addressed elsewhere in the planning report.

Pedestrian/ Bicycle Routes
A bike rack will be required for the building. The Applicant should identify a
location.
CONCLUSION / RECOMMENDATION
Subject to the preceding review, City staff recommends approval of the following listed
requests for a Chase Bank at 5907 Neal Avenue North, subject to the conditions that
follow:
• Planned Unit Development Amendment
• Conditional Use Permit for ATM Drive Thru and Signage
• Design Guidelines/Site Plan Review
1. The final plans for the ATM and associated lighting shall be subject to review and
approval of the City.
2. Any proposed directional signage shall be subject to review of the City and can
only include the name and logo of the business.
3. Any changes to the grading, drainage, erosion control, utility plans are subject to
review and approval of the City Engineer.
4. The landscape plan shall be subject to the review and approval of the City
Arborist. All required landscape plan details shall be submitted to the satisfaction
of the City Arborist.
5. All mechanical equipment on the roof or on the site shall be fully screened in
accordance with the provisions of the Zoning Ordinance.
6. All light fixtures shall be full cut off, compliant with the height requirements, and
be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to
lighting requirements. The maximum height of the parking lot poles and fixtures
is not to exceed 25 feet as per the Zoning Ordinance.
7. One wall sign per façade shall be allowed. The Chase/Logo signs shall be
counted as one sign.
8. All signs shall be designed to comply with the Zoning Ordinance requirements for
internal illumination.
9. The Planning Commission shall comment on the building design and building
materials.
10.A bike rack should be identified on the site plan and placed on site.

Sustainable Development:
• Site Planning:
o The proposed improvements occupy the existing site envelop and will limit the environment impacts of
building and the surrounding ecosystem.
• Indoor Environmental Quality:
o Equipment specified in for Chase Bank projects is designed per ASHRAE 90.1 indoor ventilation standards to
exceed outside air requirements for all conditioned spaces within the building.Calculations factor in zone
population and area to ensure adequate fresh air is provided to building occupants at all times.All RTUs are
provided with economizers allowing them to provide up to 100%of their supply air volume with outside air
when conditions allow.The air distribution system is also provided with controls allowing for separate
temperature control of commonly occupied spaces including,bank lobbies,offices and break rooms,as well
as separate systems to control heat from ATM and IT equipment.

CHASE,NEAL AVENUE-CONDITIONAL USE PERMIT APPLICATION
• Energy:
o Energy-efficient equipment, BMS system and lighting controls will be installed to help reduce the amount of
energy required and that have less impact to the environment.Systems modified as part of this project will
be upgraded to comply with the 2018 International Energy Conservation Code requirements as adopted by
the state of Minnesota, including energy efficiency and ventilation standards for all new HVAC equipment.
• Material Use:
o Sustainable materials and construction activities,including recycled material,renewable materials,and the
use of local materials,will be implemented in the design and construction as applicable.
• Water Management:
o Chase Banks design standards specify low flow plumbing fixtures wherever possible to reduce water use.
Typically,water closets are the greatest source of water consumption in most banks,and as a standard these
are replaced with 1.0 gpf low flow fixtures as part of the plumbing design. New water heaters are also
provided with recirculation pumps as a means to save energy and water consumption by ensuring how water
is available as close to fixtures as possible.
Architectural Guidelines
• Facade Treatments
o Defined Base, Middle and Top
• Facade improvements include addition of Nichia Fiber cement accents panels at the new entry
(base/middle)canopy,upper(Top) parapet of the existing tower,and new(base/middle)ATM
Canopy.The other existing accents and EIFS cornices are to be cleaned repaired and reused. (See
color elevations attached to this application.)
o Distinct Modules
• Chase proposes breaking up the articulation of the east and west facades of the existing building by
adding Nichia Fiber cement accents panels at the new entry canopy, upper and new ATM Canopy.
o Entries
• The existing entry on east side of building is proposed to be reused.Chase is proposing installation
of a new sidewalk to provide foot traffic access from the right of way.A new entry canopy will be
installed to mark the main entrance and is intended to match existing storefront system.
o Awnings
• Awnings are not proposed.Chase is proposing a new front entry canopy.(Noted above.)
• Ground Level Expression:
o Location is a single-story building.
• Transparency-Window&Door Openings
o Window and Door Design/Levels of Transparency
• Existing storefront design and entry to remain. Floor plan has been oriented in such a fashion as to
use existing building elements of entry,corner tower and drive thru. Back of house functions have
been placed in such a location as to make use areas without glazing.
• Entries
o The existing entry on east side of building is proposed to be reused.Chase is proposing installation of a new
sidewalk to provide foot traffic access from the right of way.A new entry canopy will be installed to mark the
main entrance and is intended to match existing storefront system.Chase is also proposing a material
change with the inclusion of Nichia Fiber cement accents panels to mark the entry on the east.

proposed as part of the redevelopment.

• Existing shade trees and ornamental shrubs are located within the Neal Avenue right-of-way.

• The proposed wall signs are positioned so they are an integral design feature.The proposed signs

DESCRIPTION
Lanterra 9004-W7 (Up or Down) and 9004-W2 (Up and Down) are 4.25"
O.D., line voltage cylinder fixtures with dimmable LED. The luminiare comes
in various mountings, surface mount with integral driver in the housing, remote
driver mount with round and square wall plates and square wall integral
driver, all of which can be mounted over standard 4 inch j -box. The luminaire
also comes with various field replaceable optics. It also comes with various
lens, louvers and colors or dichroic filters, which ran combine up to two at
once to create multiple lighting effects. The fixture may be used indoors or
outdoors and carries IP66 rating.
SPECIFICATION FEATURES
Material
Housing, hood and mounting stem are
precision -machined from corrosion
resistant billet stock 6061-T6 aluminum.
Finish
Fixtures constructed from 6061-T6
aluminum are double protected by
an ROHS complaint chemical film
undercoating and polyester powder coat
paint finish, surpassing the rigorous
demands of the outdoor environment. A
variety of standard colors are available.
Hood
Hood is removable and accepts up
to two internal accessories at once
(lenses, louvers and filters) to achieve
multiple lighting effects. Weep holes
prevents water and mineral stains
from collecting on the lens, even in
the straight up position.The flush lens
design reduces fixture length, minimizes
debris collection and prevents water
and mineral stains from collecting on
the lens.
DIMENSIONS
Gasket
Housing and hood are sealed with a high
temperature silicone O-ring gasket to
prevent water intrusion.
Lens
Tempered glass lens, factory sealed
with high temperature silicone O-ring to
prevent water intrusion and breakage
due to thermal stock.
Hardware
Stainless steel hardware is standard to
provide maximum corrosion resistance.
Electrical
Long life LED system coupled with
electronic driver (120-277V/50-60Hz) is
compatible with TRIAC (Trailing Edge),
ELV (Forward phase) and 0-10V dimming
to deliver optical performance. Light
can be dimmed from 100-1% while
maintaining constant CCT. It will operate
in -30-C to 50-C unless noted otherwise.
The driver incorporates surge protection.
LED's are available in 2700K, 3000K,
3500K at 90CRI and 97CRI, 4000K at
80CR1 and 97CRI, 5000K at SOCRI and are

Re: Chase Bank Landscape Plan Review
I have reviewed the landscape plans submitted by Bergmann for the Chase Bank plans dated
5/6/2022. The following includes my comments and/or recommendations:
Landscape Plan (Sheet C7-0)
The landscape plan submitted includes keeping the existing plantings already located on the site
with no new plantings proposed. After reviewing the landscape plan and visiting the site I noticed
many of the existing trees located on this site are ash and maple. There are also a few trees on
this site that are in poor condition.
1. Due to Emerald Ash Borer (EAB) being found within the City of Oak Park Heights last
summer and infestations currently expanding throughout the City, I would recommend
removing all of the ash trees on the site along with the trees in poor condition and replacing
the trees with something other than maple trees to work towards the Minnesota DNR
community tree canopy 20-10-5 guidelines. This means a community has no more than
20% of their trees within a single family, no more than 10% of their trees within a single
genus and no more than 5% of their trees within a single species. As the City of Oak Park
Heights strives to work towards this goal this means avoiding planting any additional
maple trees throughout the City.
2. Replacement trees to be planted must be hardy under local growing conditions, tolerant
and/or resistant to major insect and disease problems and fairly low maintenance.All plant
sizes, root and container classes included in the plan must conform to the City of Oak
Park Heights zoning ordinance requirements.

3. Update the Landscape Plant List to include the replacement trees to be planted and
updated information.
4. Update the Landscape Plan to include the proposed locations of the replacement trees to
be planted.
Landscape Details
Planting Notes/Planting Detail
The landscape notes and planting detail was not submitted. Please include the following items on
the final plans:
1. All trees must be landscape grade trees of good form and structure not Park Grade trees.
Trees with poor form will be more prone to storm damage and failure in the future. Please
include this in the planting notes.
2. Burlap, wire and all rope must be removed from the top 12" of the root ball on all trees.
3. All trees must be straight and not need staking after planting. Contractor shall stake trees
only if the tree(s) begin to lean within the guarantee period, please include this in the final
planting notes.
4. The landscape contractor is required to plant trees and shrubs according to the approved
planting detail diagrams and landscape notes submitted with the final approved landscape
plan. This will be checked after planting and any deviations from the plans must be
corrected before the landscaping will be approved by the City, this needs to be noted in
the final plans.
5. Planting detail diagrams must be included on the plan sheet(s)for:
-Deciduous Trees
-Evergreen Trees
-Shrubs
-Perennials
-Maintenance Strip (Sod edge, seeding, landscape edging, mulch)
6. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree
Worker's License for 2022 from the City of Oak Park Heights Building Department. All
required documents must be submitted with the application.
7. The City Arborist will conduct an Initial Landscape Inspection after all plants/trees, mulch,
ect. have been installed.
8. The City Arborist will conduct a Final Landscape Inspection typically (1) year after
installation, at the end of the plant guarantee period. For Final Acceptance of Installation
and Landscape Plants the specified planting procedures must have been followed and all
plants must be alive and in good condition at the end of the plant guarantee period.
