As you are aware, the consideration of the preliminary plat, final plat, conditional use
permit/planned unit development (CUP/PUD), and site plan approval for the 4th Addition
to Valley View Estates was not acted upon by the City Council at their August 8, 2000
meeting. In order to act upon a concept plan for the CUP/PUD, an affirmative vote of four-
fifth's of the City Council is required. Only three members of the Council were present that
evening. The consideration by the Council on this matter was held over the following
meeting of August 22, 2000.
Randy Kurth of Kurth Surveying has recognized the need to vacate a roadway easement
within the property being considered for Valley View Estates 4th Addition (see attached).
The easement has appeared in the memorials of the certificate of title for this property.
As part of the consideration of the Valley View Estates 4th Addition, the City Council
should vacate the roadway easement through a resolution. The City Attorney has
indicated that a vacation should be done with a public hearing and at least a two week
published notice. This matter will need to be addressed at a September meeting to allow
a notice to be advertised.

Please be advised that the Planning Commission, at their July 13, 2000 meeting,
recommended approval of a request by Jack Krongard for a preliminary
,.� conditional use permit/planned unit development (CUP/PUD), and site plan approvaltoallow for the construction of three twinhomes on the property located on the
northeastern corner of Osgood Avenue and Upper 56th Street.
The proposed development is the 4th Addition to Valley View Estates. The subject
property was originally platted as an outlot and is now proposed for subdivision into six
residential lots. The PUD/CUP is necessary in this case to allow flexibility in lot size
standards and to allow access via a private street.
Residents of the neighborhood were present at the

opinions related to their specific units and the project being cons de esd.and

had concerns about their unit or their development. One resident, who lives across
Upper 56th Street from the 4th Addition, preferred the proposed development over the
previous multiple family units that had been considered last year.
The applicant clarified two of the conditions by indicating a market value has been
established for park dedication (condition 11). Additionally, credit from the park
dedication would be given to the applicant in exchange for construction of the bike trail
on Osgood Avenue from Upper 564Street North to the site's northern property line.
The Planning Commission recommended the project with the following conditions:
1. The owners of Lots 1, 2 and 3 enter into a joint maintenance agreement to
ensure prompt snow removal and maintenance of the shared access.

2. The land area of Outlot A shall be incorporated into Lots 1, 2 and 3 to ensure
proper maintenance. A 30 foot shared access easement shall be created to
enable access to Lots 1, 2 and 3 from 57th Street.
3. The City Engineer shall review and approve all grading and drainage plans. The
yard areas between Units 4 and 5 and the yard area east of Unit 6 have slopes
that will require measures to prevent erosion. The applicant shall provide plans,
subject to City approval, to address this issue.
4. An erosion control plan with locations of silt fencing shall be submitted to the City
Engineer for review and approval.
5. The sanitary sewer and water main utilities, installed as part of, and serving this
development shall be privately owned and maintained.
6. Any additional hydrants, as required by the Bayport Fire Department, shall be
installed at the applicant's expense and to City specifications.
7. All engineering plans shall be signed by a professional engineer registered in the
State of Minnesota.
8. The existing 20 foot and 60 foot easements on the property shall be included on
the preliminary plat and indicated on all site plans.
9. A development agreement shall be executed between the City and the applicant.
The agreement should indicate that if the sanitary sewer main within the property
needs repair, the City will not be responsible for any costs associated with
restoring the driveways or other privately owned improvements within the
easement area.
10. Create a 20 foot pedestrian trail easement over the drainage and utility easement

11. The applicant must pay the City a cash payment equal to 14 percent of the fair
market value of the subject property. To determine the appropriate park
dedication fee, the applicant shall submit an appraisal of the site in accordance
with Section 402.08.B.9 of the Subdivision Ordinance.
12. The applicant submit and receive approval of a detailed landscape plan from City
staff and the City Arborist.
13. All exterior lighting shall comply with Section 401.15.B.7 of the City Code.
14. The applicant submit detailed patio and porch plans for each unit.

16. The applicant is advised that City approval is not inclusive of other necessary

Re: Stormwater Improvements
In my May 13, 1999 letter I suggested a series of stormwater improvements for the rear
yards of the homes along 57th Street and stated that I wanted to complete an elevation
survey of the area and observe a significant rainstorm. My target for making the
improvements was by Labor Day. The elevation survey was competed in June and
refined this last week by surveying the proposed route for the diversion ditch. On
Wednesday August 18, 1999 I was finally able to observe a significant storm. The storm
was a typical summer downpour that lasted about 30 minutes. My observations during
the,storm and research performed this summer lead me to the following
conclusions/observations:
1. The amount of stormwater coming from the neighborhood to the south is minor as
compared to the rain from the roofs in your neighborhood. Creating a ditch to catch
the water from the south, as suggested in the May 13, 1999 letter, would not be
effective.
2. The drain located behind 14855 57th Street is capturing the majority of the stormwater
coming from the homes to the west of 14855. The stormwater coming off of the roof
of 14855 is only partially captured by this drain.
3. The water coming off of the roofs of 14855 and the homes to the east is the majority
of the water flowing through the rest of the yards to the east.
4. The design of the garage roofs directs a significant portion of the stormwater from the
front roofs and garage roofs to the back yards. This is especially true for 14865 and
14873 where almost all of the water from the garage roof is directed to the back yard.
5. The elevation of the stormsewer inlet behind 14875 is higher than the backyard and is
not intercepting any stormwater.
6. The stormsewer inlet behind 14975 cannot lowered without a large expenditure.
7. There is a utility easement extending from the back property line 25 feet into your
properties where the City can make improvements. This area is almost entirely
within the woods.

8. A diversion ditch starting at the center of the low area behind 14865 is feasible. For
the diversion ditch to be effective will have to begin outside of the utility easement.
The diversion ditch would catch the water from the roofs of 14855, 14863, and
14865, as well as, most of the water from the neighborhood to the south. The
diversion could have a maximum slope of 3.5%.
9. Some trees will be lost during construction of the diversion ditch. One tree near the
edge of the proposed ditch is already leaning and may be starting to fall -
10. Lining of the ditch would be with rocks. Grass will not grow in the woods.
11. There are downed branches/trees/limbs that need to be cleared from the area by the
homeowners or association.
12. The City of Oak Park Heights does not have a stormwater utility fund or any other
source of funding for this project other than assessing the work back to the benefiting
homeowners.
13. Once completed the City does not have stormwater utility fund to maintain the ditch.
Diversion Ditch: The proposed diversion ditch is shown on the enclosed drawing. It
starts behind 14865 and leads to the stormwater drain behind 14875. It will capture the
water from 14855, 14863 and part of the water from 14865 and the neighborhood to the
south. I have installed stakes at the centerline of the proposed ditch; grade stakes in holes .
showing the depth of the diversion and fill stakes at the downhill edge of the ditch where
the dirt from the ditch will be deposited. The proposed ditch will start approximately 3
feet south of the centerline matching the existing grade. It will be tapered to the depth
designated at the centerline and then taper to match grade at approximately 3 feet north of
the centerline. Starting three feet north of the centerline the dirt from the ditch will be'
deposited to form short berm at an elevation at least 6 inches higher than the centerline
elevation. This ditch would best be dug by hand. Hand digging will create the least harm
to the vegetation in the area.Now that firm plans are prepared I have contacted the
Washington County Sentence to Serve Program and scheduled the digging of the
diversion ditch for October 21 and 22. If the property owners or association could clear
out the dead branches and clear the area too four feet either side of the centerline of the
ditch it would be helpful. The area to the north of the proposed ditch where the dirt from
the ditch will be deposited to form the downhill bank needs the most clearing. The
second best option is to rent a very small backhoe. The last choice is to use the skid-
loader we will be renting in September or October for some work in our hockey rinks and
a few other sites. As noted above there are no funds set aside for stormwater
improvements in the 1999 budget.
Re-direct Garage roof water to the front: The diversion ditch will help 14873
eliminate the water flowing into his yard from behind his partially completed wall. It will
not stop the large amount of roof water coming off of his and 14865's garage roofs and
flowing between their homes. This water needs to be re-directed to the front of their
homes by the use of roof gutters. The fronts of the homes already have gutters. Gutters
on all of the homes will help to reduce the amount of roof water flowing through the back
yards. The roof gutters are a homeowner's choice and cannot be funded by City funds.

Other items: The repairs to stormwater drain behind 14913 are still recommended to
reduce the erosion of the yards. The extension of the horseshoe berm that was added last
year is not going to be necessary. The diversion ditch should capture the water that
would have been captured by the extension.
Stormwater Utility: The City Council will be holding public hearings for the creation of
a stormwater utility fund. The fund would be used to finance stormwater improvements
and maintenance activities. The proposal is to finance the fund with a$1.00 per
household fee on the monthly utility bills. Commercial developments would be charged
based on acreage and at a higher rate since they have larger amounts of impervious
surfaces. If this utility were formed then funds would be available for maintenance and -
to study other improvements.
