BOX 2007' STILLWATER, MN 55082 2007 TO: CITIES SUBJECT TO MARKET VALUE CREDIT REDUCTIONS RE: Extension of Market Value Credit Homestead Reimbursement Reductions for 2005 and 2006 First Special Session Laws 2005, Chapter 3, Article 2, Section 5, extends the market value homestead credit (MVHC) reimbursement reductions for reimbursements payable in 2005 and payable in 2006. The amount of the reduction is the same as the dollar amount of the 2003 reduction in credit reimbursements due to Laws 2003, First Special Session, Chapter 21, Article 5, Section 12. These reductions only apply to the 103 cities which have received reductions for payable 2003 and payable 2004 reimbursements. Following are the amounts of your city's payable 2005 MVHC reimbursement before and after the reduction amount as determined. 2006 amounts will not be available until next summer. A. 2005 Established MVHC Reimbursement: $ 85,647 B. 2003 Reduction Amount: $ 88,487 C. 2005 Reduction Amount (lesser of A or B): $ 85,647 D. 2005 Net MVHC Reimbursement (A - C): $ 0 Please Note: Because the MVHC reimbursement is part of the city's certified levy, this reduction means your city will not receive the total amount of its 2004 certified levy for taxes payable in 2005. Tzhe city will receive the portion of the levy received and remitted by the county, but the portion of the levy paid by the State as MVHC reimbursement will be reduced by the amount listed above. The reduction to the MVHC reimbursement should account for the difference between your 2004 certified levy and your final 2005 receipts (excluding any adjustments for delinquencies or rounding). 2006 reimbursement cuts will similarly affect 2005 levies for taxes payable in 2006. Also note that these amounts do not include credits to be paid to Tax Increment Financing Districts, prior year adjustments, or residential homestead market value credit to be paid on manufactured homes assessed as personal property. The amounts were reported on the 2005 Abstract of Tax Lists. Amounts are apportioned to taxing districts according to their share of the local tax rate. The MVHC reimbursement amounts will be posted on the Department of Revenue web site in the near future. The 2005 legislature made several changes to the program including: • Increasing the general appropriation by $44 million, • Increasing the aid base by $6 per capita for cities under 5,000 population, • Implementing a new transition mechanism for cities moving from the small city need formula to the large city need formula, and • Eliminating the taconite aid offset for seven iron range cities. Changes made to the program in 2003, including the elimination of most of the grandfathered aid base, have made the LGA program more volatile. That is, modest changes in city conditions can result in significant changes in city LGA distribution. This has made estimating LGA less precise and, more importantly, has made city budgeting more challenging. The program contains caps and floors on appropriation increases and decreases: • For all cities, the maximum increase in LGA is ten percent of its previous years' levy; • For cities over 2,500 population, the maximum decrease in LGA is ten percent of its previous years' levy; • For cities under 2,500 population, the maximum decrease in LGA is five percent of it certified 2003 LGA. The committee may want to consider policy changes that would further limit the magnitude of year -to -year changes in LGA. Column Descriptions Column 1: 2005 Certified LGA. This is the amount of LGA actually distributed to each city in 2005 Column 2: 2006 LGA July LMC estimate. This is the estimate of 2006 LGA posted by LMC and House Research in July based on the special session law and preliminary data. Column 3: 2006 LGA Estimate under 2005 law. This column shows what each city's LGA would have been in 2006 if the 2005 legislature had made no changes to the LGA program. Column 4: 2006 Certified LGA. This is the amount of LGA that will be distributed to each city in 2006. Comparing column 4 to column 3 shows the short-term impact of the 2005 changes. Column 5: Full phase in estimate under 2005 law. This is an estimate of what each city's LGA distribution would have been under the old law if there were no caps or floors in place. This indicates the general direction each city's LGA would have headed in future years if no changes had been made to the program in 2005. Column 6: Full phase in estimate under new law. This is a rough estimate of what each city's LGA distribution would be under the new law if there were no caps or floors in place. This is a rough estimate, but it is useful indicator of the general direction a city's LGA is likely to head in future years. Comparing column 6 and column 5 approximates the long -term impacts of the 2005 law changes.
