A revised landscape plan for the new Rapid Oil Change development
has been submitted to our office in response to the City
Council ' s directive ( see 30 March 1990 NAC letter) . A copy of
this plan is attached.
Review of the revised plan reveals the amount of landscaping has
been increased to conform with the Ordinance (although at a
minimum level) . In addition, the sizes and types of plantings
proposed also meet Ordinance requirements . It should be noted,
however, that the description for the Common Junipers around the
pylon sign and the northwest corner of the building should he
JCS-12 rather than JCS-6 . This is to reflect six plantings to be
installed at each location. It should also be required that a
wood or rock mulch be installed in each planting bed to control
weed growth and provide for the proper maintenance of the
landscaping. Given these comments, our office finds the revised
landscaping plan acceptable and we recommend its implementation.
As a related matter regarding this development, it has been
noticed as recently as 7 April 1990 that continuous concrete
curbing has yet to be installed around the perimeter of the
parking lot and driveway surfaces . I did, however, witness
concrete tire stops lined up on the west side of the parking lot,
although this does not satisfy the Ordinance requirement nor the
previous site plans ( see second Exhibit) . You may wish to have
the Building Official check on this matter to ensure .that
concrete curbing is to be installed.

D. The Developer shall be responsible for
maintaining the location of and protecting
curb stops, water services and sewer services .
Any service or curb stop damaged shall be
repaired or replaced as specified by the City.
The Developer shall make all necessary
adjustments to the curb stops to bring them
flush with the topsoil (after grading) or
driveway surface.
E. The Developer shall be required to provide
landscaping and screening as determined by
the City and as required by the ordinances
of the City.
F. The Developer shall remove all dead and
diseased trees before building permits will
be issued.
G. The Developer shall be responsible for street
maintenance, including curbs, boulevards,
sod and street sweeping until the project is
complete. The repair of any damage done to
the streets or public utilities shall be the
financial responsibility of the Developer .
H. The Developer shall pay to City the sum of
$1,750 .00 per acre to the park fund in lieu of
any park dedication.
M. The Developer shall be responsible for
securing all necessary approvals and permits
from all appropriate federal, state,
regional and local jurisdictions prior to
the commencement of site grading or construction
and prior to the City awarding construction
contracts for public utilities.

3. Construction of Plan A Improvements.
A. Construction. The construction, installation,
materials and equipment shall be in accordance
with the plans and specifications approved by
the City.
B. Inspection. All of the work shall be under
and subject to the inspection and approval of
the City and, where appropriate, any other
governmental agency having jurisdiction.
C. Easements. The Developer shall dedicate to
the City, prior to approval of the final plat,
at no cost to the City, all permanent or
temporary easements necessary for the
construction and installation of the Plan A and
Plan B Improvements as determined by the City.
All such easements required by the City shall
be in writing, and in recordable form,
containing such terms and conditions as the
City shall determine.
D. Faithful Performance of Construction Contracts.
The Developer will fully and faithfully comply
with all terms and conditions of any and all
contracts entered into by the Developer for the
installation and construction of all Plan A
Improvements and hereby guarantees the
workmanship and materials for a period of one
year following the City's final acceptance of
the Plan A Improvements. Concurrently with
the execution hereof by the Developer, the
Developer will furnish to, and at all times
hereinafter maintain with the City, a cash
deposit, certified check, or an Irrevocable
Letter of Credit, based on one hundred and
twenty-five percent (125% ) of the total
