This is 0.5 feet above the high water level of the pond and slightly above the top of the stormwater sewer. The maximum elevation can be below this level but should not be less than 942.0. Additionally there needs to be a soil grade difference of at least 1.5 feet between the bottom of the swale and your home. This will require your yard to be graded to an elevation of 944 feet if the drainage swale is installed at 942.5 feet. Your back yard needs to be graded such that it drains primarily to the drainage swale and then to Newgate Circle. To accomplish this the drainage swale from you backyard needs to intersect the emergency overflow at a point below the overflows high point towards the circle. Also as stated in Ms. Karen Shimon's of Bonestroo, Rosene, Anderlik& Associates, Inc., letter dated June 16, 1998 the berm which has been removed at the back of your lot needs to be reestablished. I have also discussed the drainage situation with Mr. and Mrs. Kirk Schultz of 5660 Newgate Circle North and highly encourage you to coordinate with them on the drainage issue. Without agreement from the Schultz's you cannot alter the grade on their side of the property line. While the drainage easement is 10 feet wide on both property it appears that the developer of the land choose to locate most of overflow on your side of the property at the back of the lot and mostly on their property at the front of the lot. By curving the swale through both yards they have achieved a more natural look than the overflow on the opposite side of the circle. ciassici.aoc Tree City U.S.A.
