HomeMy WebLinkAbout2022-06-09 Planning Commission Meeting Minutes CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Thursday,June 9,2022 Call to Order/Pledge of Allegiance: Chair White called the meeting to order @ 6:00 p.m. Present: Commissioners Freeman, Husby, Van Denburgh, VanDyke and White; City Administrator Johnson, City Planner Richards, and City Councilmember Liaison Representative Liljegren. II. Approval of Agenda: Commissioner Freeman, seconded by Commissioner VanDyke, moved to approve the Agenda as amended, adding Oak Park Heights Condos update to New Business. Carried 5-0. III. Approval of March 10, 2022 Meeting Minutes: Commissioner Freeman, seconded by Commissioner VanDyke, moved to approve the Minutes as presented. Carried 5-0. IV. Department/Commission Liaison/Other Reports: City Councilmember Liaison Representative Liljegren reported that Minnehaha Transportation was approved by City Council. City Administrator Johnson provide an update to legislative outcomes with regard to those associated with the A.S. King Plant closure plan and also discussed traffic to in the area of the Norell Ave. construction,noting that the 3.6-million-dollar project was moving quickly and was currently ahead of schedule. It is anticipated that there will be a 58th St. to Hwy. 36 traffic connection my mid-August. V. Visitors/Public Comment: None. VI. Public Hearings: A. Chase Bank: Review and consider requests for Planned Unit Development Amendment, Conditional Use Permit to allow a drive-through & sign allowances, and Site Plan/Design Standards Review at 5907 Neal Ave. N. City Planner Richards reviewed the June 2, 2022 Planning Report to the request, providing background information with regard to earlier approvals to the site. Richards provided an issue analysis and discussed the same, noting that overall, there will be no change to the site layout and traffic flow with the new use and that staff recommendation is for approval, subject to conditions as noted within the planning report. Brief discussion was has clarifying the modular teller station location and signage. Planning Commission Minutes June 9,2022 Page 2 of 5 Chair White opened the public hearing at 6:22 p.m. and invited the applicant to address the Commission. Scott Wrasman from Bergmann Architects, introduced himself. Bergmann Architects is the applicant to the request. Mr. Wrasman stated that he agrees with the planning report and that he looks forward to spiffing the building up and made himself available for questions. Discussion ensued as to the shared parking with the daycare adjacent to the site and shared parking agreements in place as part of the retail center PUD, that will remain in place. Chair White invited public comment. There being none, Commissioner Freeman, seconded by Commissioner Van Denburgh, moved to close the public hearing. Carried 5-0. Brief discussion ensued as to the conditions of the planning report. Commissioner Van Denburgh, seconded by Commissioner VanDyke, moved to recommend City Council approval of the request subject to the conditions, including amendment of condition 8, of the June 2, 2022 Planning Report, specifically, that: 1. The final plans for the ATM and associated lighting shall be subject to review and approval of the City. 2. Any proposed directional signage shall be subject to review of the City and can only include the name and logo of the business. 3. Any changes to the grading, drainage, erosion control, utility plans are subject to review and approval of the City Engineer. 4. The landscape plan shall be subject to the review and approval of the City Arborist. All required landscape plan details shall be submitted to the satisfaction of the City Arborist. 5. All mechanical equipment on the roof or on the site shall be fully screened in accordance with the provisions of the Zoning Ordinance. 6. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. The maximum height of parking lot poles and fixtures is not to exceed 25 feet as per the Zoning Ordinance. 7. One wall sign per façade shall be allowed. The Chase/logo signs shall be counted as one sign. Planning Commission Minutes June 9,2022 Page 3 of 5 8. All signs shall be designed to comply with Zoning Ordinance requirements for size and internal illumination. 9. The Planning Commission was favorable to the building design and building materials. 10. A bike rack should be identified on the site plan and placed on site. Carried 5-0. B. Popeye's Louisiana Kitchen Restaurant: Review and consider requests for Planned Unit Development-General Plan, Conditional Use Permit to allow a drive-through & sign allowances, and Site Plan/Design Standards Review for site located south of Panera Bread— 13523 60th St. N. City Planner Richards reviewed the June 2, 2022 Planning Report to the request, providing background information with regard to earlier approvals to the overall development site. Richards provided an issue analysis and discussed the same, noting staff recommendation for approval, subject to the conditions noted within the planning report. Discussion ensued as to adjacent property ownership, trail connections, traffic increase at shared access with Stillwater Family Dental and how the new round about at Norell Ave. N. will affect traffic in the area, and proposed building signage. Chair White opened the public hearing at 6:54 p.m. and invited the applicant to address the Commission. Richard Gerdeman introduced himself from Woolpert, the project engineer and responded to questions as to the business product,building design style, sign design, drive through design and clarified that several of the parking spaces will be utilized for snow storage. Chair White invited public comment. There being none, Commissioner Van Denburgh, seconded by Commissioner Freeman, moved to close the public hearing. Carried 5-0. Discussion ensued with feedback being provided to the City Planner with regard to conditions 1, 10 and 13 noted within the planning report. Commissioner Freeman, seconded by Commissioner VanDyke, moved to recommend City Council approval of the request subject to the conditions of the June 2, 2022 Planning Report, specifically,that: 1. The Planning Commission was favorable to the drive through lane setback of five feet from the south property line. Planning Commission Minutes June 9,2022 Page 4 of 5 2. The final plans for the menu boards, canopies and associated lighting shall be subject to review and approval of the City. 3. Any proposed directional signage shall be subject to review of the City and can only include the name and logo of the business. 4. The site plan shall be subject to review and approval of the Fire Marshal. 5. All grading, drainage, erosion control, utility plans, and access driveways are subject to review and approval of the City Engineer. Stormwater plans are also subject to review and approval of the Brown's Creek Watershed District. 6. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. 7. The landscape plan shall be subject to review and approval of the City Arborist. All required landscape plan details shall be submitted to the satisfaction of the City Arborist. 8. All mechanical equipment on the roof or on the site shall be fully screened in accordance with the provisions of the Zoning Ordinance. 9. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. The maximum height of the parking lot poles and fixtures is not to exceed 25 feet as per the Zoning Ordinance. 10. One wall sign per façade shall be allowed, with the choice of the sign at the discretion of the Applicant if the total wall signage does not exceed 150 square feet or 80 square feet per sign. If a sign is not placed on the rear façade, two signs may be placed on one of the facades. Plans shall be provided to the City prior to the City Council meeting and subject to City Council review. 11. All signs, the order boards and canopies shall be designed to comply with the Zoning Ordinance requirements for internal illumination. 12. The monument sign shall be landscaped at the base. A plan shall be provided subject to City Arborist review and approval. 13. The Planning Commission was favorable to the building design and building materials. Improvements with detailing and materials to the rear façade that faces Norell Avenue shall be provided to the City prior to the City Council meeting and subject to City Council review. 14. Oak Park Heights Condos: City Administrator Johnson updated the Commission as to a proposed condo project at 58th St. N. and Oakgreen Ave. N. by the party that owns the property and single-family dwelling at the site. Johnson noted that the City has not received a development application for the proposed project but has met with the owner and that the owner has had several neighborhood meetings regarding his proposal for two 3-story buildings of 24 to 36 units. Johnson noted that the property is currently zoned 0, Open Space and that the City's Comprehensive Plan directs the site to be low density residential. VIII. Old Business: None. IX. Informational: A.
