BACKGROUND
Eric Bjelland of Stillwater Crossing LLC has made application for a Site Plan Review for
consideration of a parking lot on MnDOT right of way at 60th Street and Osgood
Avenue. MnDOT has a permanent easement on the frontage road that will not be used
when the frontage road is closed to the west at Oren Avenue and to the east at Osgood
Avenue. MnDOT is proposing to lease the use of a portion of the frontage road to
Stillwater Crossing LLC for expanded parking.

PROJECT DESCRIPTION
The applicant's narrative for the project is found as Exhibit 1.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Commercial on the Proposed
Land Use Map. The continued use of the site as a mixed-use shopping center with the
additional parking is consistent with the Comprehensive Plan.

Zoning. The property is zoned B-2 General Business District. The retail and restaurant
use are permitted in the B-2 Limited Business District. While the site complies with the
parking requirements of the Zoning Ordinance, additional parking is often required to
accommodate the Carbone's restaurant.
It was determined that this parking expansion is on a permanent MnDOT easement that
is not subject to provisions of the Design Standards. It would require review by the City
Council for site plan approval. A public hearing is not required.
Parking. Section 401.15.F.9 of the Zoning Ordinance requires six spaces per each
1,000 square feet of gross floor area for a shopping center. The parking calculation for
this site is as follows:
Suite 9000 and 9010 —2,548 sq ft x .9 = 2,293 / 167 = 14
Suite 9020 — 2,579 sq ft x .9 = 2,321 / 167 = 14
Suite 9040 - 944sgftx .9 = 849 / 167 = 4
Suite 9050 — 4,078 sq ft x .9 = 3,670 / 167 = 22
Suite 9100 — 3,325 sq ft x .9 = 2,992 / 167 = 18
Suite 9120 - 973sgftx .9 = 876 / 167 = 5
Total 77 Stalls
The building requires 77 parking stalls. The shopping center currently has 94 parking
spaces, four of which are disability accessible. There is a surplus of parking. The
additional parking will accommodate overflow for the Carbone's.
The additional parking area will access from the existing parking lot to the south and
include 30 parking stalls. All the spaces and drive aisles will comply with Zoning
Ordinance standards.
Landscaping. A landscape plan has not been provided. There is adequate area
surrounding the parking lot to provide landscaping. A landscape plan shall be submitted
for City Arborist review and approval.
Lighting. No lighting plans were included as part of the application. If site lighting is to
be installed, lighting specifications will need to be submitted, the fixtures shall be full cut
off, and be consistent with Section 401.15.6.7 of the Zoning Ordinance.
Grading, Drainage, Erosion Control and Utilities. The City Engineer has no issues
with the proposed parking lot and drainage. The grading and drainage shall be subject
to the conditions of the Middle St. Croix Watershed Management Organization as
outlined in their July 15, 2022, letter(Exhibit 4).
Signage. No signage is proposed.
Design Guidelines. The proposed parking lot is not subject to Design Guidelines, but
review by the City Council is required.

CONCLUSION / RECOMMENDATION
Subject to the preceding review, City Staff recommends approval of the Site Plan
subject to the conditions that follow:
1. The plans shall be subject to review and approval of the Minnesota Department
of Transportation.
2. The grading and drainage shall be subject to the conditions of the Middle St.
Crois Watershed Management Organization as outlined in their July 15, 2022,
letter.
3. A landscape plan shall be submitted for City Arborist review and approval.
4. If site lighting is to be installed, light fixtures shall be full cut off and be consistent
with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting
requirements.
5. If signage is to be installed, it shall be designed to comply with the Zoning
Ordinance requirements for size and internal illumination.

Dear Mr.Johnson,
The Middle St. Croix Watershed Management Organization (MSCWMO) received an application from Washington
County for project review on June 17th, 2021 for the Osgood Ave and TH 36 Frontage Road project, located within
MSCWMO boundaries and in the City of Oak Park Heights. The proposed project qualifies for full review under the
MSCWMO 2015 MSCWMO Watershed Management Plan(WMP). The Washington County project was initially reviewed
and found to satisfy all MSCWMO performance standards and satisfied volume retention standards by removing a
substantial amount of impervious and converting it to pervious vegetated area which changed the hydrologic condition
and utilized the turf to stormwater credits to meet volume retention goals.
After the initial MSCWMO review and recommended approval of Washington County's project, Midwest Retail
Ventures, proposed a plan to utilize a portion of the frontage road slated to be converted to pervious vegetated area as
an expansion of the parking lot for Stillwater Crossing (Carbone's).The frontage road will be leased from MNDOT and a
proposed filtration basin on the Stillwater Crossing property will provide stormwater treatment for the Washington
County project as well as the new impervious drive constructed to connect the existing parking lot to the proposed
parking lot in existing frontage road. Because the area is within a high vulnerability DWSMA and the use If Infiltration
practices is prohibited, the proposed basin is designed as a filtration practice and meets MSCWMO performance
standards by complying with the MIDS flexible treatment option #2 by providing 60%annual TP removal as summarized
in the attached table.
The MSCMO recommends conditional approval of the project with the following two condition:
1. Submittal of a maintenance agreement,in a format approved by MSCWMO or Oak Park Heights,and
2. Recording of a dedication and/or perpetual easement including maintenance access to Washington County
and/or Oak Park Heights over the portion of the Stillwater Crossing property below the 100-year flood elevation
of the stormwater management facility.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY,MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST FROM STILLWATER CROSSING LLC, OWNERS OF
THE STILLWATER CROSSING SHOPPING CENTER, FOR SITE
PLAN REVIEW TO ALLOW CONSTRUCTION OF A PARKING
LOT ON A MINNESOTA DEPARTMENT OF TRANSPORTATION
EASEMENT, LOCATED AT 5950 OSGOOD AVENUE, BE
APPROVED WITH CONDITIONS
WHEREAS,the City of Oak Park Heights has received a request from Stillwater
Crossing LLC,owners of the Stillwater Crossing Shopping Center, for Site Plan review
to allow construction of a parking lot on a Minnesota Department of Transportation
easement at 5950 Osgood Avenue. The City Council of the City of Oak Park Heights
makes the following findings of fact and resolution:
1. The real property affected by said application is legally described as
follows,to wit:

and
2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

and
3. The property is zoned B-2 General Business District in which the
shopping center is a permitted use; and
4. MnDOT has a permanent easement on the frontage road that will not be
used when the frontage road is closed to the west at Oren Avenue North, and to the east
at Osgood Avenue North;
5. MnDOT is proposing to lease the use of the portion of the frontage road to
Stillwater Crossing LLC for 30 additional parking spaces; and

6. A Site Plan review is required by the City Council; and
7. City staff prepared a planning report dated July 21, 2022,reviewing the
request; and
8. Said report recommended approval of the request, with conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES
THE FOLLOWING:
A. The application submitted by Stillwater Crossing LLC,owners of the Stillwater
Crossing Shopping Center, for Site Plan review to allow construction of a parking lot on
a Minnesota Department of Transportation easement at 5950 Osgood Avenue, shall be
approved and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
with the following conditions:
1. The plans shall be subject to review and approval of the Minnesota Department of
Transportation.
2. The grading and drainage shall be subject to the conditions of the Middle St.
Crois Watershed Management Organization as outlined in their July 15, 2022,
letter.
3. A landscape plan shall be submitted for City Arborist review and approval.
4. If site lighting is to be installed, light fixtures shall be full cut off and be
consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to
lighting requirements.
5. If signage is to be installed, it shall be designed to comply with the Zoning
Ordinance requirements for size and internal illumination
