Guidelines/Site Plan Review.

Dear Mr. Larson:
The City received your application materials on September 13, 2022 for a Rezoning,
Conditional Use Permit and Design Guidelines/Site Plan review for a proposed multi-
unit apartment building on 58th Street, to the west of Menards. The application was
deemed incomplete on September 21, 2022. The letter that outlined the required
information and specific resposes is found as attached. As of this date, not all of items
have been received and the application is rejected. Please recall the remaining items
were:
1. A new application form shall be submitted that adds the Comprehensive Land
Use Plan Amendment and the Major Subdivision.
2. Documentation that demonstrates how the proposal complies with the
Supplemental Agreement, dated March 9, 2004, or alternately, how the proposed
site plan can be designed to comply with the provisions of the Supplemental
Agreement, such as limiting access only onto 58th Street.
As per our meeting October 10, 2022, the key issue is access. Your team has not
sufficiently provided a site plan and demonstrated solutions for access that can comply
with the Supplemental Agreement and provide safe ingress and egrees to and from the
site. We welcome additional meetings with you and the property owner, Bob Brackey to
work on the access issues for this site.
The items received by the City including the application form, fees and hard copies of
the plans will be sent to your separately. If you have any questions please do not

Dear Mr. Larson:
The City received your application materials on September 13, 2022 for a Rezoning,
Conditional Use Permit and Design Guidelines/Site Plan review for a proposed multi-
unit apartment building on 58th Street to the west of Menards. The property is
designated under the Comprehensive Land Use Plan as Commerical, as a result, the
City will require a land use amendment to a classification appropriate for high density
residential development. A 4/5 vote is required to adopt a Comprehensive Plan
amendment in accordance with Minnesota Statute 462.355 Subd 3. Additionally, the
property will need to be platted as a block and lot. The Zoning Ordinance does not
allow construction on an Outlot.
The application is deemed incomplete. The City may deem it complete with receipt of
the following items by September 28, 2022. If the items are not submitted as required
by that date, the application will be rejected. As we receive additional materials, the City
further reserves the right to request additional supplementary information.
1. A new application form shall be submitted that adds the Comprehensive Land
Use Plan Amendment and the Major Subdivision.
2. A letter of support from the adjacent property owner related to the required
access to the west from the subject property.
3. A Preliminary and Final Plat for the subject property.
4. Please review the Supplemental Agreement to the Developers Agreement dated
March 9, 2004, which was entered into by the Property Owner. Please provide
detailed information as to how your proposal complies with this Agreement, or

alternatively, how the proposed site plan can be designed to comply with the
provisions of the Agreement, such as limiting access only onto 58th Street
5. Update on your discussions with the Brown's Creek Watershed District related to
the project.
6. Locations of all lighting fixtures ground or wall mounted and fixture specifications.
These must be a full cut off design with a site photometric plan.
We invite you and your representatives to a meeting with City Staff to discuss this
application on September 28, 2022 10:30 A.M. at City Hall. Please confirm your ability
to attend.
Pursuant to Minnesota Statutes 15.99, Sub. 3(f), the City of Oak Park Heights is
herewith extending the period of time for agency/city review of the application for an
additional 60-day period (for a total of 120 days from the date of a complete application)
inasmuch as the City has determined that additional research and study by the City staff
relative to the complexity of the project as proposed will be required.
