Zoning & Development Items:
1.The City has received two applications for the OCTOBER Planning Commission – for the 80+ unit apt building on the west side of
th
Menards and the general plan submission for the VSSA apartment building on the north side of 58street behind Walmart. Staff
is reviewing these for completeness at this stage.Staff has issued letters to these applicantsthat outline current needs / status.
2.A project close-out letter under MN 15.99 was sent to the 6385 PecanAve. – slope / trail project. It is not proceeding and they
have almost completed their site clean-ups.
3.TheCIty did supply aletter of support for Chuck LeRoux reappointment to the BCWD – the Council did let us know that he did
receive a re-appointment – See enclosed.
Other Items:
TheNorellProject is moving forward…enclosedis the weekly update.
Mayor McComber, Jenni Pinski, Chris Eng fromtheWCCDA and Brian Behm,
MGRfrom theKING PLANT received theCity’s MN APA AWARD forPartnership

RE: Development Application – SITE CLEAN-UP - 6385 Peacan Ave.
The purpose of this letter is two-fold related to the activities occurring on your property with the above address and relate to two
issues: Issue 1) your proposed land-reclamation project falling under CITY ORDINANCE 308 and which requires a Conditional
Use Permit and; Issue 2) the general site conditions found at your property. While these are certainly related matters I will
address each in respective order:
Issue 1: You (in conjunction with A WORK OF ART LANDSCAPES LLC – the “applicant” – CC BELOW) supplied an
application – received by the City on 8/30/22 for a Conditional Use Permit – to install certain walkways, trails, retaining walls,
patios, dry-stream, etc. to the east of your home all as generally depicted in the supplied drawing. As this is a massive proposal
that can have life-safety issues downslope should it fail--- This application is generally incomplete at this time; in order for the
City to provide a complete review the following materials are required to be provided:
1.Complete Engineered Design and drawings by a registered Civil or Structural Engineer showing: the exact current and
exact proposed grades, showing proposed engineered designs for the retaining walls, switchback trails and their
designs, their structural loads including a certification of responsibility for all design, site review, installation oversight
and ultimate project sign off.
2.Provide a complete survey showing the final locations of all proposed structures. The current sketch – while interesting
is not a survey.
3.Provide detailed drawings for the patio including its exact location on the above survey as well as its foundations
design and drainage.
4.A parcel search obtained from Washington County of all properties located within 500 feet of the exterior boundaries of
the property
5.Staging/Phasing Plan outlining exact timelines and how procedurally the work will be completed.
Please provide these materials to my attention not later than 9/16/22.
The City is hereby notifying you that the City is extending its period of time for agency/city review of the application for an
addition 60- day period – for a total of 120 days from the date of a complete application in as much as the City has determined
that additional research and study by City staff relative to the complexity of the project as proposed will be required.
At this time, except for restoration and clean-up; all work is to cease.
Issue 2: Your site is in general disarray with mud-flowing into the street, piles/stacks of bricks (pavers), unsafe slopes,
washouts, etc. You (the OWNER) are hereby directed to address these issues and bring the site into stability by September

30, 2022. hese conditions are a NUISNCE under City Ordinances and not acceptable. The work requires and
includes but is not limited to:

o Clean and removeall mud and debris from the street and ensuring that no other such flow reaches the street.Re-
establish the grass areas directly adjacent to the curbalong the entire run of the west abutment of PecanAveand
south side of property.
o Remove all the bricks / pallets from the front and or side yards from the property – or you may store these in your
garage. You may see me about a permit for these pavers to be installed inside the fenced area directly adjacent to
your home.
o Stabilize the dirt mound in your front yard with grass and hay and/or mesh erosion cover so that grass may grow (a
tarp is not acceptable).
o Remove the dirt piles from your drivewayas this too is unsightly and flowing into the street.
o Stabilize and mow/clean-up the southern yard as it is muddy and unsightly – ensure tracks are removed.
o The excavated “trail-way” in the eastern lot will fail, these areas need to be stabilized, seeded and meshed
immediately.
A site inspection will occur on 10/3/22 tocheck for compliance. Should these fail to be completed in good faith the CIty will move
this concern to our STEP 2 notice process and may include furtherenforcement on the OWNER.

Weekly Project Update #22
For the Week Ending 9/23/2022
What work was completed on the
project this week?
The City’s contractor finished
installing concrete curb on the
project and began work on
sidewalks. TheWal-Mart and

Kohlsparking lots and 59Street
willhavetheir first layer of asphalt
completed this Friday afternoon.

A bike trail was paved along 60
Street as well.
What work is expected for next
week?
The contractor will completethe
concrete sidewalks and medians on Tuesday. Black dirt placement will occurthroughout the
week. Trees will be planted at the parking lot islands on Wednesday.
Will there beany changes to the traffic detour or access to businessesnext week?
No changes in traffic access will occur next week. Norell Avenue from Highway 36will be open

as well as the roundabout and 59Street.

Phase 3 includes closures at Krueger Lane and Norwich Avenuewhile the remainder of 59
Streetis constructed. Access via these entrances will be limited or restricted.
