The buildin will be one stor and will include onl the g rocer y store. The site is 2.24 acres and has not been previousl developed. An application for the Si Carpet store had been previousl approved for this site but construction did not move forward. The propert is zoned B-4 Limited Business District in which retail g rocer y stores are a permitted use. The site had not been previousl platted and now re a preliminar and final plat. The Aldi site will include an 83 stall parkin lot, two utilities storm draina li and landscapin The two site accesses site accesses, I It will utilize the existin drivewa aprons, one in the southwest corner comin from Nova Scotia Avenue and the other in the northeast comin from 60th Street. The loadin dock for the g rocer y store will be in the southeast corner of the site which is out of view from Hi 36. Grocer carts are not taken outside of the facilit thus there is no need for cart stora in the parkin lot. ISSUES ANALYSIS Comprehensive Plan. The propert is desi as Commercial on the Proposed Land Use Map. The Aldi g rocer y store will be consistent with this land use desi Zonin The propert is zoned B-4 Limited Business District. Retail sales are a permitted use in that district. The District re a 40 foot front y ard setback, 10 foot side y ard setback and 20 foot rear y ard setback. The buildin meets or exceeds these re The buildin hei maximum in the B-4 District is 35 feet. At its hi point, the buildin will be 22 feet, 10 inches. Subdivision. A preliminar and final plat has been provided for review. The propert would be platted as Lot 1, Block 1 of Aldi Addition. The final plat indicated the appropriate draina and utilit easements as well as existin trail easements on Nova Scotia Avenue. The final plat shall be subject to review and approval of the Cit En and Cit Attorney. Park dedication will be re as part of the final plat. Section 402.08.E of the Subdivision Ordinance re a pa of cash dedication e to ten percent of the g ross land area in the plat. The cash park dedication amount will be calculated b the Cit and will be re prior to recordin the final plat. Access. As indicated, the site will be accessed b existin curb cuts on 60th Street and and Nova Scotia. These drivewa should allow for ade customer and deliver access. Parkin Section 401.15.17.9 of the Zonin Ordinance re one off street parkin stall for each 200 s feet of retail space. The parkin calculation for this site is as follows: 17,886 s ft x .9 = 16,0971 200 = 81 parkin stalls The site plan indicates that there are 83 parkin stalls planned for the development, four of which are disabilit accessible. The la as desi will meet the re number of parkin stalls and disabilit accessible stalls. The parkin stalls are 9 feet x 20 feet with 24 foot drivewa aisles in compliance with the Zonin Ordinance. The parkin area will be completel surrounded b curb and g utter. All of the parkin areas are placed at least 10 feet from the propert lines. There will be landscaped islands within the parkin areas. Loadin Dock/Trash Enclosure Location. A loadin dock has been added on the southeast corner of the buildin The dock is set down three feet from the parkin lot level. The trash/rec area will be located at the lower level of the loadin dock and will be provided an enclosure with a g ate. The Plannin Commission should comment on the screenin for the loadin dock in that trucks will be visible while unloadin Grad i n g elutilitles. Gradin draina and utilit plans have been provided b the applicant. The Cit En has provided a separate report on en issues. The li plan indicated a shoe box st full cut off li fixture mounted on a pole and base with a total hei of 25 feet in compliance with the li re All of the parkin lot fixtures are ade setback from propert lines. The plans indicate the locations of two different st of full cut off wall mounted fixtures. Both of these fixtures are consistent with Zonin re 3 The plans do not include details of the li within the structure, but behind the windows. All visible interior li shall also be full cut off. Photometrics. The li plan is in compliance with Zonin re for li intensit The li intensit is re to be less than one foot candle at the centerline of adjacent streets and 0.4 foot candles at the propert line. Hours. Outdoor li for parkin lots shall be turned off one hour after closin except for approved securit li Landscapin The submitted plans indicate plantin within the parkin lot, alon Nova Scotia Avenue and at the rear of the site. An existin g roupin g of trees on the south ed of the propert will remain. The landscape plans are subject to review and approval of the Cit Arborist. Mechanical Screenin The plans indicate a roof detail of where the mechanical units will be placed and the t of screenin that would be used. The Plannin Commission should discuss these screenin devices. Si Freestandin Monument Si A monument si is proposed at the corner of Nova Scotia Avenue and 60th Street. The si is 13 feet, 10 inches in hei ( 20 feet allowed) and the si is 80 feet (100 feet allowed). The si is surrounded b landscapin in conformance with the Zonin Ordinance. Wall Si The Zonin Ordinance allows for a total of two wall si each on separate facades. The proposed si plan indicates four wall si two facin Nova Scotia and two facin 60t" Street. The two additional si would re a variance which has been re b the applicant. A review of the si variance is in a followin section. Total Allowable Si The total s foota of si includin the monument si shall not exceed 300 s feet for the site. The total of all re si is 185 s feet or 115 s feet below the maximum. Si Illumination. The Aldi si within the freestandin si will be internall lit. The back is a dark color with the Aldi lo and name illuminated in compliance with the Zonin Ordinance. The two Aldi lo si in the buildin corner tower will also be internall lit. The si that read Food Market are not lit. The si as desi should compl with the Zonin Ordinance li re Staff will approve the li specifications for the si at the time of permittin Si Variance. Variance criteria are provided in Section 401.04 of the Oak Park Hei Zonin Ordinance. The Plannin Commission and the Cit Council should review the followin criteria and conditions to determine if the variance is justified. 4 Review Criteria. The Planning Commission and City Council should make a finding of fact that the proposed action will not: a. Impair an adequate supply of light and air to adjacent property. b. Unreasonably increase the congestion in the public street. c. Have the effect of allowing any district uses prohibited therein, permit a lesser degree of flood protection than the flood protection elevation for the particular area or permit standards which are lower than those required by state law. d. Increase the danger of fire or endanger the public safety. e. Unreasonably diminish or impair established property values within the neighborhood, or in any way be contrary to the intent of this ordinance. f. Violate the intent and purpose of the comprehensive Plan. g. Violate any of the terms or conditions of Item 5, below. Conditions for Approval. A variance from the terms of this ordinance shall not be granted unless it can be demonstrated that: a. Undue hardship will result if the variance is denied due to the existence of special conditions and circumstances which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district. 1} special cases may include exceptional topographic or water conditions or, in the case of an existing lot or parcel of record, narrowness, shallowness, insufficient area or shape of the property. 2} Undue hardship caused by the special conditions and circumstances may not be solely economic in nature, if a reasonable use of the property exists under the terms of this Title. 3} special conditions and circumstances causing undue hardship shall not be a result of lot size or building location when the lot qualifies as a buildable parcel. b. Literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance or deny the applicant the ability to put the property in question to a reasonable use. c. The special conditions and circumstances causing the undue hardship do not result from the actions of the applicant. d. Granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structure or buildings n the same district under the same conditions. e. The request is not a result of non - conforming lands, structures or buildings in the same district. f. The request is not a use variance. g. The variance requested is the minimum variance necessary to accomplish the intended purpose of the applicant. h. The request does not create an inconvenience to neighboring properties and uses. The applicant has provided a narrative found as Exhibit 20 with an explanation of hardship and justification for the variance. The main justification given is corporate identity and not desiring to vary from standard store appearance. A number of other businesses along the Highway 36 corridor have asked for a similar variance request. The proposed signs are relatively small in size and granting a variance request for two additional signs will not create an inconvenience to neighboring properties and uses. The overall proposed signage is 115 square feet less than what is allowable. The city has granted additional signs to allow better visibility from Highway 36 for other businesses in this area. The most recent example was the additional wall sign allowed for the Bremer bank. For these reasons, city staff recommends that the two additional wall signs be approved. 5 Desi Guidelines Sustainable Guidelines. Cit staff has q uestioned the applicant on how the pro has been desi to achieve at least a certain de of sustainabilit The applicant will need to discuss the methods in buildin construction and site desi with the Plannin Commission of how these issues have been addressed. Architectural Guidelines. Facade Treatments The buildin will have a definite base, middle and top. The base is defined b a horizontal trim feature and the top b the row of windows on the most visible facades. The buildin is broken up b vertical pillars on all facades. There is a primar entrance well defined b the tower and awnin feature. Ground Level Ex ression This is a one stor buildin with a tower feature at the corner. The main entrance is well defined with a lar area of g lass. Transparenc The buildin uses g lass on all but the fa that is least visible. The Desi Guidelines re at least a 20 percent transparenc on g round floor, street facin facades. The fa facing 60th Street is approximatel 27 percent transparent and the Nova Scotia facin fa is 29 percent transparent. Entries The buildin features a prominent entr with a tower and awnin Roof De The roofline is broken at the entrance corner b a tower feature. The Plannin Commission should comment on the ade of this or if additional roof variation is preferable. The rooftop mechanical e will be screened. The Plannin Commission should also comment on this. Buildin Materials and Colors The applicant has provided color elevations for review. The primar buildin materials of brick and g lass will exceed the 60 percent re None of the prohibited buildin materials will be used. Buildin material samples will be available at the Plannin Commission meetin Franchise Architecture The buildin desi and material selection will be consistent with the Cities desi g oals. 6 Site Desi Guidelines Building Placement The proposed buildin has a well defined entrance facin the two adjacent streets. The buildin is set back to allow for parkin and landscapin Parkinq Areas The parkin area is landscaped with ade sized islands. Stormwater Stormwater will be addressed in the Cit En report. The final plat and development a shall be subject to review and approval of the Cit En and the Cit Attorne 7 2. The cash park dedication amount shall be calculated b the Cit and shall be re prior to recordin the final plat. 3. The Plannin Commission should comment on the screenin for the loadin docks. 4. The g radin g , draina and utilit plans shall be subject to the review and approval of the Cit En 5. All li fixtures shall be full cut off and installed in compliance with the li standards of the Zonin Ordinance. All visible interior li shall also be full cut off. 6. The outdoor li shall be turned off one hour after closin except for approved securit li 7. The landscape plans are subject to review and approval of the Cit Arborist. 8. The Plannin Commission should discuss the si variance and determine whether the re for the two additional si is justified. 9. Mechanical e that is located on the roof and visible from street level or from nei properties shall be screened with materials that blend harmoniousl with the buildin fa materials. The Plannin Commission should comment. 10. The Cit does not object to Aldi's plan to install a conduit in the 60t" Street Ri of Wa to facilitate the possible burial of Xcel distribution powerlines located adjacent to the site. Installation of the conduit and lines shall be subject to the approval of the Cit En 11. The applicant shall address sustainabilit initiatives with the Plannin Commission. 12. The Plannin Commission shall discuss the roof desi and ade of the mechanical screenin 13. The Plannin Commission should comment on the buildin material selection and colors. 14. The Plannin Commission should comment on the need for common space and seatin areas at the front entrance. 15. The applicant shall provide a plan for the addition of front entrance plantin 8 16.
