This will be on the DECEMBER planning Commission Agenda. 2.TIRE PROS has commenced its project and Omaha Ave. will be closed this week for part of the day. TP also asked for permission – relative to their approved site plan – to expand their parking lot near theirdumpster slightly. That permission was granted –adding about two parking spaces. The CIty has no objection to this removal of the curbing and its asphalting of such areas, contingent upon: By 11/1/23 new concrete curb shall be installed as shown on the south as well as on east line where it joins the existingcurb. And, this area of impacted landshall be paved not later than 11/1/23. Please appropriatelyplace striping or markings on this newly paved land consistent with industry standard practices. Segment Dear Chair Johnson and Commissioners, I am proud to represent our constituents in Council of Oak Park Heights. I am writing you out of concern for then regarding the proposed project RB-2652. These comments and opinions are my own and do not represent any action or opinions by my Council as a whole. In general, I am commenting on this Project because the proposal currently under consideration is a very expensive failure. The design does not serve to provide a rational connection between Manning Avenue and Stillwater Blvd and the design is for the purpose of only servicing a proposed development in Stillwater and tying it into the city street system of my City. The process by which the current design came about was improper in that it did not follow reasonable public procedure by seeking public input or engagement of all local partners prior to selecting a specific design. Traffic Concerns First, please look at the long-term goal of making connections. We know the County staff makes a note of an Environmental Assessment Worksheet prepared in 1997 in a public documentation. In 1997 three proposed routes were studied. None were chosen but what must be remembered as to why being major projects in Oak Park Heights that significantly affected traffic on then Highway 5 (now CSAH 15). 1. Construction and opening of Stillwater Area High School, Fall 1993. th 2. Construction and opening of 58 Street from Hwy.5 to Oakgreen Avenue, 1992-1995. 3. Realignment by MNDOT of Hwy 36 frontage road east of Hwy 5. th The convergence of these projects at Neal Ave and 58 Street and the further construction of the th intersection at 58 and Hwy 5. Resulted in a great impact on traffic in and around the intersection on Hwy 5. Thus, when the county deemed it appropriate to investigate a connection th away from 58 St. Thus, all three concept connections were to south by .3 to 1.7 miles of the th intersection and was designed for traffic to avoid the intersection of Hwy 5 and 58 St. Further a County Sub Regional Study of Manning Avenue between Interstate 94 and Highway 36. Done in the 2015 Included a map showing that then Hwy 5 from Hwy 36 up to and including th the intersection of Hwy 5 and 58St. was already over capacity. The current proposal would make the situation worse by directing more traffic toward an already overburden intersection. 23 of 49 Design does not Meet County Goals County staff in the past has explained to my council what they feel is the “Goal” of a county highway. Notably when they were pressing us to take over the north frontage road of Hwy.36 explaining that the “Goal” is to move traffic through municipalities with little cross traffic higher speeds and minimal traffic controls. Applying this rationale, the Project fails in many ways and is contrary to this “Goal” position. The Project’s seems to have done by those who were working primarily for the interests of the developer. The plan is not conducive to flow through traffic. It does not travel in a direct line between its two end points but rather it includes several turns that will require slower speeds along with several traffic controls, stop signs, traffic lights or maybe a roundabout. It will then th enter our City street system. Even if the County were to take over part of 58 St. it would be expected to respect access to our current businesses. Kwik Trip needs to maintain their accesses in order to service their gas pumps and allow access to their diesel pumps and tanker deliveries. It would also spill traffic onto other adjoining city streets. If these parameters meet the definition of a County Highway, then you should take over the north frontage road. In that case it would better fit your staff’s “Goal” and would have connect County Highway 66 into the rest of your system. Lack of Engagement with Crucial Partners and the Public Under County “Justification” your CIP states, “Coordination with MNDOT and local partners, and developers strengthened the county’s goal to complete this gap on the CSAH 15 corridor.” Problem is in deciding to go ahead and designing this connection the County failed to involve at least two critical party’s – Being - The City of Oak Park Heights along with General Public. This is a massive failure on the part of County Elected Officials and Staff who have disregarded the public trust. On January 16, 2019. I personally attended the second public open house the county had concerning the Manning 36 project. At that meeting the county staff had a board showing the “preferred layout” for that project. On that layout there were two sets of small yellow arrows, one set north of 36 and one set south of 36. The accompanying key stated these were “possible future” connections. I inquired with the staff person standing by the board about the set of arrows on the south side since it showed a connection into my city. First, I was told that was a possible future project and something not being covered today. When I explained my interest and inquired more, I was told “…no corridors had been studied in fact the location of an intersection with Manning Avenue had yet to be determined…” Forward one year, February 2020, Oak Park City staff is verbally informed at a meeting with county on another matter that the county was looking at moving forward with a possible th connection. One month later March 18 staff received letter requesting a letter of support for a grant request and city participation in a group to help oversee the Project. This was at the outbreak of COVID and the county’s third open house for Manning 36 (not this project) became an online version OPH staff response the first week in April was that we would require more th information. My Council next met on April 28. At that time, we authorized a letter to the County making clear we had not authorized any road construction and needed more information before we could take any action. On May 4,2020, I sent a personal email to Commissioner Kriesel in which I noted, “The County has never even ASKED us if we want or support this road. Therefore, we HAVE NOT and MAY NOT provide approval for this road.” I then listed some of our concerns and ended with, “Before anyone gets moving too fast it might be better if these concerns were addressed. I do not want to 24 of 49 have a situation where the County comes to Oak Park Heights and tries to tell us. You must approve the road because of all the money and planning others have done assuming we would approve.” Unfortunately, that warning appears have been too late or not listened to. By the time my th Council met on April 28a number of actions had already taken place – namely - from a planning report and minutes from an April 22, 2020 meeting of the City of Stillwater Planning Commission. I found that the developer of Central Commons had been working for some time with Washington County and had reached a general agreement on the platted right of way and dimensions for the proposed road. With that information preliminary plat and PUD were approved. Final approval would eventually be given by the Stillwater City Council on November 17, 2020. So, at that point, April 2020, someone representing the county had given assurances to the developer and the City of Stillwater that a new county road would be built and the corridor into OPH had been chosen. Who did this, who was speaking for the County? Also in the report was a mention of the fact that the developer had already received conditional approval for his layout and drainage plan from Brown’s Creek Watershed. I found the action was taken on November 19, 2019 well before OPH was brought into the loop. I guess to sum it up one can look to a question asked by a Stillwater council member at their November 17, 2020 meeting when they were approving the plat and PUD for the development. The question was about an update on the county road. The Community Development Director gave a rather vague answer. But he noted that the project was not officially in the county’s CIP but that he knew that elected officials were working, “BEHIND THE SCENES” to move it up. Seems there is a lot being done behind the scenes to limit input by the Public or other interested parties – again without any permissions or formal input being sought from the City of Oak Park Heights In summary the plan does not meet the goals established in the past and in will make the th situation worse at 58 Street. The road does not meet the definition your staff laid out for a County Highway. By allowing the design to be made to the developer’s desires it shows no regard to negative effects it would cause by routing the traffic to an overcapacity intersection or resulting cut through traffic on OPH’s city streets. That said, perhaps the most egregious failures on the part of County Elected Officials and County Engineers is the utter lack of regard to a public process or the City in which this project is to run through. This is not in keeping with what one would expect of those operating in the public’s trust. I believe better and less costly solutions could have been found. But actions taken have now tainted any action at this time. This final connection of Manning Avenue undoubtedly will prove invaluable to the County and local communities, and also is an integral part of our planned development on the south side of TH 36.We encourage the County to maintain its long-term commitment to constructing this Project. As the owner ofapproximately 35 acres located south of TH 36, alongside the proposed corridor, and the developer ofaplanned60-million-dollarprojecton that site, Central Commons, LLC (Summit Management)continues to rely on the completion of Project #RB2652.On October 28, 2020 and November 17, 2020, the Stillwater Planning Commission and Stillwater City Council respectively, approved the final plat and plans for our project. As part of such approval, we agreed to undertake substantial public improvements, including public water and sewer improvements, stormwater system improvements, and the refurbishing of Manning Avenue South, among others, in reliance on the City constructing a trunk utility extension, and the 58th street project being completed by the County. Prior to and following approval in 2020, our project has continued through multiple phases of planning based on the longstanding commitment and understanding that the 58th Street extension/CSAH 15segment would be completed. Our planned project consistsof a phased, mixed use Planned Unit Development including multi-family apartment buildings, retail (including potentially HyVee grocery and convenience stores), and two additional 3 acre lots for potential retail, commercial, or multi-family development. Construction is currently proposed to begin by no later than December 31, 2025. The proposed connection, in conjunction withthe interchange project the County recently undertook on TH 36, will provide an integral access point to our development and the businesses within it.Our project has been designed in reliance on the planned 58th street extension and CSAH 15 segmentbeing completed. As such,it is critical to our development that Project #RB2652is completed.Furthermore, this corridor will make for a seamless connection to other potential future developments on the south side of TH 36 and from Manning Avenue to Stillwater Boulevard. In addition to its benefits to local commerce, this project will also address traffic concerns along TH 36. As is noted in the CIP, this new CSAH 15 highway segment will address many regional traffic and safety goals while also making the final connection from Manning Avenue to Stillwater Boulevard.
