HomeMy WebLinkAboutweekly notes September 2nd 2022 CITY OF OAK PARK HEIGHTS – WEEKLY NOTES for: September 2nd, 2022 TO: City Council Members& Staff FROM: Eric Johnson, City Administrator Zoning & Development Items: 1.No additional Development Applications have been received – thus far only the Nelson Driveway & the Sodie’s Cigar Shop expansion. We are now expectinga Fill/Grading application – that is needed to be completed by CUP for aproject at Fury Motors site. Fury asked totemp-place some fill on a grassarea while they secure a CUP and complete their land acquisitionfrom the AmericInn site. Pending a final CUP, they we given temporary permission with several conditions – see the enclosed permit. There are no expected impacts to floodplain, wetlands, trees, etc. See images. 2.Please see the response to the property owner on Peacan Ave for their proposedslope / trailway project. In addition, this site is a general mess and we have requiredclean up. 3.The last image here shows why the City requires ROW permits as often times a contractor place large structures on curbs (unprotected), scrape and damage the road leading to shorter life. In this instance on Lookout Trail – no ROW Permit was requested. Other Items: The Norell Project is moving forward…enclosed is the weekly update. The Mill & Overlay Project is moving forward…enclosed is the weekly update. Mayor McComber Provided 1.NLC Update for 8-29-22 2.The ETAC Survey portal is still open – See Enclosed. 1 of 13 Temporary AdministrativePermit – City of Oak Park Heights Leonard InvestmentsLLC and OSHI PROPERTIES LLC & TJB LLC (collectively referred herein as the Owner) haverequested the installation of temporaryfill – not to exceed 500 Cubicyards (CY) of clean-fill to be temporarilystored in a location as outlined in Exhibit A to this document. Such action requires a CONDITIONAL USE PEMRIT pursuant to City Ord 308.08for its permanent storage and/or use. Pending that application and possible approvals, the City will allow the temporary placement of up to 500 cubic yards pf clean-fill to beplaced on the site as shown in Exhibit A.There are no apparent wetlands, trees, floodplains, erosion dangers or other impacts to health, safety and welfare of the immediatearea. This Permit, once issuedis subject to the following conditions: 1.The Owner, by 4:00pmon9/7/22, shall install complete silt fencing around the entire perimeter of this “Deposit Area”– totally enclosing this deposit area so that no materialmay flow from the property in the event of rain. The City will inspect at 4:45 PM on such date for compliance. The Deposit Area shall be fully on the Owner’s propertiesandmay only be accessedfor the purposes of this permit from theasphaltdrive of Fury Motors site. 2.The Owner may not causeor seek to causethe leveling of any such piles or materials deposited at the site until a final Conditional Use Permit is secured and issued by the City.The piles shall remain as depositedfrom the unloading vehicle. A complete Development Application for a Conditional Use Permit has been supplied to the Owner. It is the Owners duty to provide complete application materials by 9/9/22including a final grading plan. 3.The Owner, by the 4:00 pm on 9/9/22 shall apply for a Conditional Use Permit for the proposed land spreading of this temporarily placed material. Should the Owner not apply for or should Owner’s applicationbe denied,theOwner at their sole expense shall remove all deposedfill from the site and remove same from the City within 30 days of such written demand of the Cityregardless of weather conditions. 4.The Owneris hereby noticed that they may require a BCWD permit for such activities and they are to contact them immediately. 5.By issuance of this Temporary Administrative Permit, the City is not waiving its authority or rights to enforce anyrelated Ordinances, Rules or Policies that may also govern orhave jurisdiction upon these areas. The City may revoke this Permit at any timeand for any reason, upon which Ownershall immediately remove all installationsincludingsuch filland fully restore the areas to previous conditions – in the City’s opinion - at Owner’s expense. Should Ownerfail to comply with the required terms and conditions of this Permit, the City may seek all remedies allowed under law, and all such enforcement actions, including but not limitedto administrative, legal, corrective and engineering costs to compel enforcement or actions and shall be fully recoverable by the City from Owner – including by special assessmentupon such propertiesto complete such work. The Owner hereby waives all special assessment requirementsas may be found in Minnesota Statute. 6.The Owner, by 9/7/22 shall provide a $5,000 escrow that shall be refundable, minus any out-of-pocket inspection costs the City deems reasonable to ensure compliance with the provisions of the Permit.Additional fees, deposits and escrows will be required as part of the Conditional Use Permit process. While these are certainly related matters I will address each in respective order: Issue 1: You (in conjunction with A WORK OF ART LANDSCAPES LLC – the “applicant” – CC BELOW) supplied an application – received by the City on 8/30/22 for a Conditional Use Permit – to install certain walkways, trails, retaining walls, patios, dry-stream, etc. to the east of your home all as generally depicted in the supplied drawing. As this is a massive proposal that can have life-safety issues downslope should it fail--- This application is generally incomplete at this time; in order for the City to provide a complete review the following materials are required to be provided: 1.Complete Engineered Design and drawings by a registered Civil or Structural Engineer showing: the exact current and exact proposed grades, showing proposed engineered designs for the retaining walls, switchback trails and their designs, their structural loads including a certification of responsibility for all design, site review, installation oversight and ultimate project sign off. 2.Provide a complete survey showing the final locations of all proposed structures. The current sketch – while interesting is not a survey. 3.Provide detailed drawings for the patio including its exact location on the above survey as well as its foundations design and drainage. 4.A parcel search obtained from Washington County of all properties located within 500 feet of the exterior boundaries of the property 5.Staging/Phasing Plan outlining exact timelines and how procedurally the work will be completed. Please provide these materials to my attention not later than 9/16/22. The City is hereby notifying you that the City is extending its period of time for agency/city review of the application for an addition 60- day period – for a total of 120 days from the date of a complete application in as much as the City has determined that additional research and study by City staff relative to the complexity of the project as proposed will be required. At this time, except for restoration and clean-up; all work is to cease. Issue 2: Your site is in general disarray with mud-flowing into the street, piles/stacks of bricks (pavers), unsafe slopes, washouts, etc. You (the OWNER) are hereby directed to address these issues and bring the site into stability by September th 30, 2022. hese conditions are a NUISNCE under City Ordinances and not acceptable. The work requires and includes but is not limited to: 4 of 13 o Clean and removeall mud and debris from the street and ensuring that no other such flow reaches the street.Re- establish the grass areas directly adjacent to the curbalong the entire run of the west abutment of PecanAveand south side of property. o Remove all the bricks / pallets from the front and or side yards from the property – or you may store these in your garage. You may see me about a permit for these pavers to be installed inside the fenced area directly adjacent to your home. o Stabilize the dirt mound in your front yard with grass and hay and/or mesh erosion cover so that grass may grow (a tarp is not acceptable). o Remove the dirt piles from your drivewayas this too is unsightly and flowing into the street. o Stabilize and mow/clean-up the southern yard as it is muddy and unsightly – ensure tracks are removed. o The excavated “trail-way” in the eastern lot will fail, these areas need to be stabilized, seeded and meshed immediately. A site inspection will occur on 10/3/22 tocheck for compliance. Should these fail to be completed in good faith the CIty will move this concern to our STEP 2 notice process and may include furtherenforcement on the OWNER. The bituminous in front of driveways was paved and driveways will became fully accessible to residents on Wednesday(8/31). th The bituminous for the pedestrianramps at Nova Scotia and Upper 58St N and Norwich Pkwy at Autumn Hills Park waspaved on Wednesday (8/31). What work is expected for next week? No work is scheduled for next week. Will there beany changes to accessibility and traffic next week? No delays to residents next week. The City’s contractor built the th road base on 59Street at the Wal Mart Parking Lotas well as th the road and trail on 60Street Xcel Energy installedGas main along Norell Avenue. What work is expected for next week? th The remaining portion of 59at the Kohl’s parking lot will be constructed. Concrete curb will be installed late in the week pending weather. Will there beany changes to the traffic detour or access to businessesnext week? No changes in traffic access will occur next week. Norell Avenue from Highway 36will be open th as well as the roundabout and 59St. th Phase 3includes closures at Kruger Ln and Norwich Ave while the remainder of 59St is constructed.
