Dear Ms. Kloos:
Thank you for visiting with City Administrator Johnson and myself yesterday with regard to rental
activity at your home, located at 5652 Ozark Ave. N. It is the City goal to ensure stable neighborhoods
with uses consistent with Single-family — non transient occupancy.
Per our conversation, you may not operate transient rental lodging (such as an
Air B&B) at your home without first having applied for and received a
Conditional Use Permit for such a transient lodging home occupation.
Operations without that are wholly illegal and the City will promptly seek
enforcement action against you. If any advertisements are found advertising
transient rental (such as an AIR B&B), it will induce the City to seek evidence of
such rental occurring — for which if it is found prompt enforcement and all legal
remedy will be pursued as appropriate.
You however then indicated that your intent is to rent your single-family home, long term. By City
Ordinance 401 definitions, you may rent the home to those as defined under the definition of"family."
For your convenience, the definitions for family, transient guest(s), and transient lodging are noted
at the end of this letter. The property is zoned R-1, Single Family Residential. Only one family
may reside within it at a given time If you are renting the home to someone, you may not reside
within the home also as secondary living space, creating a dual occupancy of the home, may not be
established for any duration of use. You may not stay a that property — in the garage or other
areas.
With the understanding that you will be renting the home as a long-term rental, the current occupants
are required to vacate the premises no later than February 14, 2023, unless you have a new contract
with them for a long-term rental and have provided this verification to the City prior to February 14th

Should you opt to consider renting your home as an Air B and B, VRBO or similar transient rental,
please see City Ordinance 401.15.M.4 Transient Lodging for criteria required to be FIRST satisfied
and contact the City to discuss the steps you will need to follow to seek potential approval. City
Ordinance 401 can be viewed in full at the City's webpage: www.cityofoakparkheights.com.
Finally, please note that MN State law requires work permits for work that is done to your home and
that contractor's performing work service are legally required to have an issued contractor license
for their trade, pull their work permits and have their work inspected. You, as the homeowner, are
required to verify that this is done.

401.02 Definitions:
Family:
An individual or two (2) or more persons related by blood, marriage, adoption or a group of not more
than three (3) persons who need not be related by blood or marriage living together in a dwelling unit
except for transient guests being accommodated in a bed and breakfast or transient lodging facility.
(The number of persons herein defined are the basis upon which performance standards are
established within this Ordinance).
Transient Guest(s): A person or persons who maintains a permanent residence not in the transient
housing and rents or occupies a room or home for a limited duration of less than thirty-one days.
Transient Lodging: A building or facility constructed solely as a single-family home and where
compensation of any kind is provided to the owner or their designee in exchange for period lodging
to transient guests.
