HomeMy WebLinkAboutweekly notes 1-20-23 CITY OF OAK PARK HEIGHTS – WEEKLY NOTES for: January 20th, 2023 TO: City Council Members& Staff FROM: Eric Johnson, City Administrator Zoning & Development Items: 1.No new applications have been received for the February Planning Commission. 2.Staff does have a planned meeting next week with a possible end- user / developer for the former A1 site – along STAGECOACH. We have not yet heard of specifics, but we have advised the possible purchaser that the site is zoned Business / Transitional. 3.The Planning Commission has a vacancy and Staff has initiated the recruitment notice. If you know anyone who wouldlike to serve, please ask them to reach out to myself of Julie Hultman for an application packet. 4.Staff has been communicating with the KOHLS site manager about the sign hanging on their north face, that is poor condition and was not permitted initially. It was removed on 1/15/23 however – Staff does need to chase these from time to time as the on-site managers often appear indifferent to these type of situation. 5.Bremer Bank has been asked to clean the side of their building; and install black/screening in their lit sign. The Starbucks developer has taken care of this for them. Other Items: The City has received a responsefrom the Valley Branch Watershed District related to its comments on their proposed rule changes. These are enclosed and we will communicate with the City Engineer for any necessary follow-up. The CIty has completed the 2023 Washington County Hazardous Waste Generation Report and Application for 2023. We are awaiting our final License. The fee was $106.00. I received your comments on October 26, 2022. Oak Park Heights’ land within the VBWD includes Stillwater Area High School, the Oak Park Ponds/Kowalski’s shopping area, and the businesses south of TH 36 and east of Stillwater Boulevard. All parcels appear to be developed. Attached is a table of comments received by the August 15, 2022, deadline for comments and responses to those comments. Below are your comments and VBWD responses. 1.Page 22 - Rule 2 – Policies – Item 9. – Requires land used for stormwater management facilities be preserved by dedication and/or perpetual easement to the VBWD. Since VBWD is a MS4 permittee, we understand they are required to have a legal mechanism that allows them to conduct inspections of privately owned BMP’s. The easement seems to go beyond the terms of the permit. VBWD requires easements over areas used for stormwater management so that stormwater management continues into perpetuity. This has been a VBWD policy for decades. In practice, VBWD has not required easements over stormwater management practices of projects implemented by MS4 (Municipal Separate Storm Sewer System) operators. From the draft rules out for review last summer, the policy was revised to reflect this practice. Submittal requirement K in Rule 1 and Standard 10.A of Rule 2 were also revised. In addition, VBWD has a Memorandum of Understanding with one VBWD community regarding easements within private developments. If the City of Oak Park Heights would like to discuss this option, please contact me. 2.Page 23 - Rule 2 – Standards – Item 6.A – acre of impervious needing to treat 1.3 inches times the impervious surface. This is 18% more than increase in treatment volume for larger sites? If a soil management plan is provided so that at least 50% of the remaining pervious area disturbed by the project will be restored, the volume control standard remains at 1.1 inches times the new impervious surface area. The additional 0.2 inch of required volume control is based on an analysis of compacted soils summarized in Barr Engineering Co.’s report to the MPCA, Assessment of MIDS Performance Goal Alternatives: Runoff Volumes, Runoff Rates, and Pollutant Removal Efficiencies, June 30, 2011. 3. Page 25 - Rule 2 – Standards – Item 6.D.i. – States that a project must provide the required volume control onsite through a different mechanism than infiltration. Since the city does not allow infiltration within the DWSMA, filtration is the primary means of water quality treatment. Does VBWD consider filtration a volume control mechanism? Or will property owners be required to try other volume control practices prior to filtration (e.g. stormwater reuse via irrigation)? OPH will not permit filtration in its DWSMA and will not be permitted to be violated by VBWD rules or policies. Filtration provides little, if any, stormwater volume control. VBWD requires stormwater volume control. If in filtration is infeasible, the permit applicant needs to explore other stormwater volume control mechanisms (e.g., capture and use for irrigation). Permit applicants must conform to the city’s rules and the VBWD’s rules. 4. Page 32 - Rule 2 – Standards – Item 17 – States that projects creating a total of 1 acre or more of new or fully reconstructed impervious surface that the permit holder must provide a chloride management plan. Does this apply to city road reconstruction projects? PLEASE LET US KNOW. Chloride management plans will be required with city road reconstruction projects. However, MS4 operators with Winter Road Materials (salt) Management Plans will be exempt from this requirement. 5. One thing to note related to MS4 rules – since both VBWD and OPH are MS4 permittees, they will both be required to have maintenance agreements with property owners. This seems very redundant. Noted. The VBWD Board will be holding a public hearing regarding the rules at 8 p.m. on January 26, 2023, at Baytown Community Hall. If the Managers adopt the rules, the City of Oak Park Heights will receive additional information on the implementation steps. Sincerely, John P.
