The Tire Pros businesses have steadily grown and intend to expand their offering by adding the St. Croix Car Wash for their existing clients and the retail public. The car wash will have a modern, well-maintained facility with both automatic choice wash and a self- serve wash with capacity for large vehicles and trailers. The City of Oak Park Heights approved an application from Judd Andrews and Jay Andrews Jr. for a Conditional Use Permit and Design Guideline Review of St. Croix Car Wash. The car wash will be built on an open lot located between the Tire Pros and Speedway gas station. The site is currently paved with a parking lot with access to 60th Street North and Omaha Avenue but is otherwise vacant.The City approved the conditional use permit to construct a car wash at the site address on 60th Street North, adjacent to the Tire Pros. Conditional Use Permits allow for the car wash and to allow no setback for the driveway on the east side of the site. 1 The applicants requested and the City approved a conditional use variation from the 10-foot property line setback along the east property line for the bypass driveway around the building. The Planning Commission held a public hearing and made a recommendation in favor of the application with stated conditions on August 11,2022. The City Council also considered the matter and approved the application with stated conditions at its August 23, 2022. The application is approved subject to the restrictions and conditions as follows: II. ADDITIONAL RESTRICTIONS AND CONDITIONS. 1. An access permit for 60th Street North shall be required from MnDOT, with a copy provided to the City. 2. The reduction of the 10-foot property line setback adjacent to the building is reduced to allow placement and installation of the bypass driveway within the setback and up to the property line. 3. At the time of consideration of this resolution, the City had not received all supplemental drainage information as requested. The final grading and drainage plans shall be subject to the review and approval of the City Engineer and the Middle St. Croix Watershed District. 4. If the vacuum system creates noise issues for surrounding property owners,the City may require the Applicant to take additional sound dampening measures. 5. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. The total height of the ground mounted light fixtures shall not exceed 25 feet. A revised photometric plan shall be required indicating the light intensity to all property lines. 6. The outdoor lighting shall be turned off one hour after closing,except for approved security lighting. 7. The landscape plan shall be subject to City Arborist review and approval. 8. Mechanical equipment that is located on the roof or visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building façade materials. 9. The reader board on the monument sign shall not exceed 35 percent of the total sign face. 10. Specifications for the 3-form exterior resin panel with LED illumination on the east elevation shall be provided. If the panel lighting is not full cut off, it shall not be allowed. 11. All signage shall be subject to final review and approval of City Staff for conformance with Zoning Ordinance standards. The sign lighting should be designed such that only the text and logo portions of the signs are to be lit at night. Staff shall approve the lighting specifications for signs at the time of permitting. 12. The Planning Commission recommended, and the City Council approved the building material selection and colors. 2 13.The Planning Commission was favorable to,and the City Council approved the proposed level of transparency of the north elevation. Abandonment:This permit requires continuous use in order to preserve the Conditional Uses granted by the City under the terms hereof. The application consists of a request for a Conditional Use Permits to allow for the car wash and to allow no setback for the driveway on the east side of the site, and Site Plan/Design Guidelines review. The property is zoned B-2 General Business District. The car wash will be located on an open lot between the Tire Pros and Speedway gas station. The lot is currently paved with access to 60th Street North and Omaha Avenue. Since 2006, the brothers have steadily grown their business and are now ready to expand their offering by adding the St. Croix Car Wash for their existing clients and the retail public. The Andrews family has a strong connection to the community and identified the need for this car wash. The viability of a new car wash was confirmed by the Reliable Car Wash analytics program that analyzed demand based on traffic volume and speed, median income, neighboring gas stations, etc. Maintaining their reputation from Tire Pros & Wheel Experts, this car wash will have a state-of-the-art, impeccably maintained facility with both an in-bay automatic choice wash and a self-serve wash with capacity for large vehicles and trailers, unlike any competition in the area. Known for their ability to service luxury and highly customized vehicles, this wash will cater to their currently underserved clientele. While this will be an unmanned operation, the Andrews brothers will leverage their advantage of local staff in the adjacent facility to maintain the car wash multiple times daily or as needed. The Andrews brothers'plans include the ability for users to select a soft-touch or touch- free experience and will have premium options such as ceramic coatings, which have been a tremendously popular recent trend. Users will have the ability to use any payment method or join a monthly car wash subscription. The Andrews brothers are also owners of property in New Richmond, WI and have aspirations to subsequently expand info that area. The Andrews brothers believe in the power of small business, being active participants in the Chamber of Commerce and local events. They have a customer-focused passion in business that has fueled their growth thus far in the tire & automotive industry and will continue to guide their success for the automotive wash industry. The building will include an automatic car wash bay, a self-service car wash bay and a storage area. The Applicant shall identity how the user will pay for the services, by a freestanding kiosk or internal to the structure ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The car wash is consistent with that land use designation. 2 Zoning. The property is zoned B-2 General Business District, and a Conditional Use Permit is required to allow car washes in this District. Section 401.30.E.2 of the Zoning Ordinance lists the criteria for review of a car wash. A review of those criteria is included in this report. Design Standards/Site Plan review is also required. The District requires a 40-foot front yard setback,10-foot side yard setback and 20-foot rear yard setback. The building is conforming with the setback requirements. The building height maximum in the B-2 District is 35 feet. At its highest point, the building will be 22 feet, 8 inches. At the east property line, adjacent to Speedway, the bypass driveway around the building is proposed to be set at the line, with no setback. Section 401.15.F.4.h.17) requires a 10-foot landscape area between the property line and the driveway. The drive lane will be used as a bypass around the building and for emergency vehicle access. A Conditional Use Permit is required to vary from the setback standard. Due to the commercial nature of the area and that no landscape setback is provided on the Speedway property, Staff does not have an issue with the request. Access. The site is currently accessed from the Tire Pros site. Two accesses are proposed, the entrance from Omaha Avenue and the exit to 60th Street North. The traffic flow is designed so that adequate stacking for cars will occur at the rear of the site. 60th Street North requires an access permit from MnDOT. The preliminary review by MnDOT, found as Exhibit 14, indicates that 60th Street is to be used only as an exit. The site plan is conforming. Car Stacking. The site plans show the three lanes entering the site from Omaha Avenue. The east lane will provide access to the parking area and the bypass lane around the building. The middle lane will provide stacking for the automatic car wash and the west lane for the self-service car wash. The sign plan indicates that directional signs shall provide guidance to cash wash users at the entrance into the site. There will be adequate space for approximately 20 cars in both lanes, which is compliant with ordinance standards and adequate for the site. Parking. Section 401.15.F.9 of the Zoning Ordinance requires 10 parking spaces and one space for each employee on the maximum shift. There will be no dedicated employees for the car wash, but it will be attended by personnel from Tire Pros. The site plan indicates that 14 parking spaces will be added along with four additional spaces for the vacuum area. One of those stalls is disability accessible. Some of the stalls may be used by Tire Pros employees, but that may need to be determined by the Applicants once the car wash is operable. The parking is compliant with the requirements. Grading/Drainage/Utilities. A grading and drainage plan for the site has been provided by the Applicant. The City Engineer will provide a separate report on engineering issues once drainage calculations are provided. The grading, drainage and utility plans shall be subject to review and approval of the City Engineer and the Middle St. Croix Watershed District. 3 Car Vacuums. The plans also indicate the location of the two car vacuums. A spec sheet for the vacuum system has been provided. At 10 feet the sound will be 79 decibels and at 100 feet, 59 decibels. There are no neighborhoods or residents that live within 100 feet of the vacuums. If the vacuum system creates issues for surrounding businesses, the City Council may require the Applicant to take additional sound dampening measures. Pay Stations. For the automatic wash, there will be one pay kiosk 12 feet from the entrance. The self-service car wash will have a pay station inside the car wash entrance. Lighting Plans. Fixtures. The lighting plan indicates the locations of the freestanding fixtures and wall packs. The fixtures will be LED and full cut off. The Zoning Ordinance specifies a total height of not more than 25 feet for the freestanding fixtures. Photometrics. The photometric plan indicates that some areas of the site adjacent to the property line will exceed the allowable intensity. The light intensity is required to be less than one-foot candle at the centerline of adjacent streets and 0.4-foot candles at the property line. The plan should be revised to comply with the lighting standards. Hours. Outdoor lighting for parking lots shall be turned off one hour after closing, except for approved security lighting. Landscaping. A landscape plan has been provided indicating the trees to be removed and the new plantings. The submitted landscape plan is subject to City Arborist review and approval. Mechanical Screening. The plans do not indicate details of ground or roof mounted mechanical equipment. The front of the building includes a raised parapet that should serve as screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened in accordance with Section 401.15.E.10.e. of the Zoning Ordinance. Trash/Recycling Storage. The applicant has indicated that all trash/recycling storage shall be interior to the building. Signage. Freestanding Sign. The Zoning Ordinance allows for one freestanding sign not exceeding 15 feet in height if a pylon and 8 feet if a monument with a total of 60 square feet in sign area. The plans indicate that one monument sign is proposed that will be 33 square feet and eight feet in height. A reader board is also proposed as part of the pole sign that is 12 square feet. The sign regulations require the reader board sign to be no more than 35 4 percent of the total sign area. Additionally, the message is not allowed to change any more than every 10 seconds. Wall Signage. The Zoning Ordinance allows for a total of three wall signs, each on separate facades. The proposed sign plan indicates three wall signs, one on the north, a second on the east elevation and a third on the west elevation. There are a total of four directional signs on the south and north elevations above the service doors that read, "Self Service 14 ft", "Automatic 10 ft" or "Exit". These signs do not count as wall signage that is subject to Ordinance limits. Total Allowable Wall Signage. The total square footage of signage shall not exceed 150 square feet of wall signs for the site and each of the signs cannot exceed 80 square feet each or 15 percent of the wall area. Directional Signage. The sign plan provides a list of the locations and size of the freestanding directional signage. These signs are adequate for the site. Sign Illumination. The monument sign will be internally LED lit. The wall signs are individual channel letters with internal LED illumination which is compliant. The directional signs will not be lit. The sign lighting should be designed such that only the text and logo portions of the signs are to be lit at night. The sign background will need to be dark. Staff will approve the lighting specifications for the signs at the time of permitting. On the east elevation, the plans show a 3-form exterior resin panel with LED illumination. Details of the design feature are not included in the plans, but if the panel is not full cut off, it cannot be allowed. Design Guidelines. Architectural Guidelines. 5 Facade Treatments The building will have a definite base, middle and top on all facades. The elevations are broken by design features and different materials. Ground Level Expression This is a one-story building with a raised roof feature at the north elevation. Transparency The building uses glass on the north, south and east facades. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The transparency of the north elevation that faces 60th Street North and Highway 36 is less than 20 percent. The Planning Commission should comment. Entries The building features the main entrance and exit for vehicles on the north and south elevations. Roof Design The roofline is broken by a varying roof line. Building Colors The Design Guidelines indicate that building materials should accent, blend with, or complement the surroundings. Warm toned colors are encouraged and will be used for this building. The Planning Commission should comment. Building Materials and Colors The applicant has provided elevations color elevations for review. The facades will include CMU, fiber cement panels, fiber cement with a wood look, and cultured stone. The materials are consistent with the Design Guidelines. The Planning Commission should comment on the acceptability of this building material. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building is not a franchise design. Site Design Guidelines Building Placement The proposed building has the main entrance facing the access driveway. Parking Areas The parking area is landscaped with perimeter plantings. Stormwater Stormwater will be addressed in the City Engineer's report. 6 Pedestrian and Common Space Currently, there is a trail adjacent to the subject property on 60th Street North. Landscaping The plans indicate the proposed landscaping subject to City Arborist review. Trees/Shrubs Subject to City Arborist review. Fencing No fencing is proposed. Utilites/Service/Loading/Drive-Through/Storage Areas Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. Signage Addressed elsewhere in the planning report. Pedestrian/Bicycle Routes As indicated, a trail is located along 60th Street North adjacent to the site. Conditional Use Permit Review Criteria. The CUP criteria found in Section 401.30.E.2. for review are found as follows with staff comments: 2. Car washes(drive through, mechanical and self-service)provided that: a. The architectural appearance and functional plan of the building and site shall not be dissimilar to the existing buildings or area as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. Comment: The building exterior finishes are consistent with the Design Guidelines. b. Magazining or stacking space is constructed to accommodate that number of vehicles which can be washed during a maximum thirty (30) minute period and shall be subject to the approval of the City Engineer. Comment: There is adequate stacking space for vehicles. 7 c. At the boundaries of a residential district, a strip of not less than five (5) feet shall be landscaped and screened in compliance with Section 401.15.E. of this Ordinance. Comment: The site is not adjacent to a residential use. A conditional use permit is required to allow no setback for the drive lane on the east side of the site. d. Parking or car magazining storage space shall be screened from view of abutting residential districts in compliance with Section 401.15.E. of this Ordinance. Comment: There is no residential use that is impacted by this use. e. The entire area other than occupied by the building or plantings shall be surfaced with material which will control dust and drainage which is subject to the approval of the City Engineer. Comment: The driveways and parking areas are paved. f. The entire area shall have a drainage system which is subject to the approval of the City Engineer. Comment: A stormwater drainage system will be installed. g. All lighting shall be hooded and so directed that the light source is not visible from the public right-of-way or from an abutting residence and shall be in compliance with Section 401.15.8.7 of this Ordinance. Comment: All lighting will be required to be in compliance with the Zoning Ordinance. h. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer. Comment: There is one vehicle access point and traffic movements are well defined for the site. L All signing and informational or visual communication devices shall be in compliance with Section 401.15.G. of this Ordinance. Comment: The signs will be required to be in compliance with the Zoning Ordinance. j. Provisions are made to control and reduce noise. 8 Comment: A vacuum system will be installed. The City Council may require the Applicant to take additional sound dampening measures if noise from the vacuum system is an issue. k. The provisions of Section 401.03.A.8 of this Ordinance are considered and satisfactorily met. Comment: The provisions of Section 401.03.A.8 of the Zoning Ordinance have been reviewed and City Staff and has determined that there are no conflicts with the criteria. The Planning Commission should review the criteria as part of making their findings. CONCLUSION / RECOMMENDATION Upon review of the requests for a Conditional Use Permit to allow for the car wash and to allow no setback for the driveway on the east side of the site, and Site Plan/Design Guidelines review, City Staff would recommend the project with the conditions as follows: 1. An access permit for 60th Street North shall be required from MnDOT, with a copy provided to the City. 2. The L-shape building will house 2 car wash bays and storage space. Building construction will comply with City of Oak Park guidelines with access that is efficient and user-friendly. Site planning will address traffic flow, parking, landscaping and drainage in addition to compliance with MNDOT requirements for the new exit at 60th Street. The following information describes architectural and engineering concepts for the car wash building and site improvements. Exterior The building construction will use CMU panel walls;cementitious architectural panels with wood or stone patterns will be applied to feature walls to enhance the facade. Roof This will consist of a Precast plank with a parapet wall and a EPDM applied rubber roof Structural Estephan engineering will design the structural system using CMU footing and floor Flooring Concrete pad;concrete is 6"thick with a 4500 PSI fiber mesh mix design HVAC Reliable Car Wash will provide equipment and installation for the complete car wash system.
