Notice of Violation—OPH Nuisance Ordinance 1109
Dear Jared:
On March 20, 2023 we visited and discussed the trash outside the side of your store. You
stated that the trash compactor had broken and was unable to be serviced due to snow and
access.
You were advised of violation of City Nuisance Ordinance 1109 due to the accumulations of
rubbish and debris, and the trash cans not placed within their enclosures, such as that found
at the premise, as well as the traffic safety hazard created by the trash container blocking the
"Do Not Enter" sign to that side of the building.
Additionally, the Fire Department Key Box was missing its door, requiring repair or
replacement. I was contacted by a vendor regarding process to purchase a new box and you
advised that a key for it had been ordered. As of today, I have not yet received response that
it has been replaced and the key installed to it by the City's contract Fire Marshal.
My March 20, 2023 letter to you directed corrective activity to be completed no later than
Thursday, April 20, 2023. Since that time, we have communicated once at my initiation, on
April 26, 2023, where you indicated that you were having trouble with your third-party
vendors regarding collection of the carboard bales and the removal of the trash container.
During our conversation, I also noted that a branch had fallen over the fence at your
pharmacy drive through and that it needed to be removed and that temporary signage at
Osgood required removal.
Per my visit to day, I did see that the temporary sign had been removed. There are still
carboard bales sitting outside the trash enclosures, the branch remains over the fence,
garbage remains to be collected through the store site and the trash container remains
outside the enclosure area.

This letter serves as the City's second and final request for compliance and requests that:
1). All trash be placed within the enclosures or be collected by your sanitation hauler;
2). The trash/recycling container be returned to your enclosures or removed from the
premises;
3). All accumulated rubbish throughout your site collected and discarded properly;
4). The branch be removed from the fence at your pharmacy drive through area; and
5). The Fire Department Key Box b in place and key installed.
Compliance shall be fully addressed prior to Thursday, May 4 2023. A compliance check will
again be made to verify compliance. If compliance is not found,the matter will be forwarded
to the Oak Park Heights Police Department and City Attorney for legal remedies available,
including citation and revocation of the store's tobacco sales license.
