The Council is aware that a resident Mr. Mike Houde who resides at 14529 Upper 55approached the City
Council in February indicating if there is a possibility to consider the allowance of the keeping of bees in
the City. The City’s current rules 602.08 prohibit that as outlined in City Ordinance.
The City Council did discuss the matter in its Annual Goal Setting discussion and indicated a desire to
hold a public hearing on the matter and was ultimately set for May 23, 2023. The City Staff did send out a
PUBIC HEARING NOTICE – Copy enclosed.
SPECIFIC HISTORY:
I do recall that concerns for this 10 years ago+/- was that there was a dispute between a neighbor who cited
that their child was allergic to bees and sought some prohibition prior to any establishment of such un the
City – perhaps beyond the one known the neighborhood. Since that time, it appears that – like the keeping
of chickens – perhaps due to COVID – there is some desire for a “cottage” industry of these things. Many
cities now allowchickens – including OPH that did not 10 years ago. Perhaps Apiaries are the same?
Mr. Houde has supplied a letter and several examples of communities in the metro area that allow some
limited bee keeping. In comparing these – including Stillwater’s – they substantivelyfollow the MODEL
ORDINACE as offered from the Minnesota Hobby Bee Keepers Association MN Hobby Beekeepers
(mnbeekeepers.com) – this website offers significant MN based data on the issue.

OTHER IMPACTS?
Residential Use / Commercial Use.
If the City assumes that such uses would be compact, non-
commercial in scale and similar to other communities – and would
essentially be a one-hive operation – is not likely to result in a
COMMERICAL operation of otherwise residential properties
While anecdotally, I have not personally heard of issues with this
type of land –use as being wholly incompatible with a residential
nature in a low density setting. The City can require permitting and
limitations similar to chickens and is what other communities
utilize.

Can hold 10,000 bees.
Risk of Bee Stings / Allergies.
I am not sure the City can foster a clear discussion of who or what
party is correct in this analysis. I have enclosed two perspectives – one
from the Allergy Advocacy Association and its related data from the CDC.
Also, data from various Bee Keeping associations that offer the “chances
of death by Bees – from National Safety Council”
City Liability.
There has not been a particular report that would indicate that a city would
incur specific liability if it uses its zoning code to allow such use. The
question I suppose is such a limited use reasonably compatible for a particular zone?
Staff have surveyed other communities that allow a limited use for a small apiary – that there have been no
know issues – See enclosed MEMO.
Model Ordinance.
Ultimately, if the Council did desire to allow a limited use, a model ordinance – similar to what is adopted
in several metro-communities is enclosed. This could be tailored to include a prior public hearing, or
require access to an adjacent large open area or third party inspections.

TOPIC: Residential Honey Bee Keeping – Apiaries
The City Council has received a request from a City resident to review and discuss the current prohibition
on the keeping of honey-bees (apiaries) in the City. The current ordinance states:
602.08 Hazards and Nuisances.
On parcels less than forty (40) acres, which are not part of a larger crop
producing commercial agricultural farm, keeping of horses, cattle, livestock,
or other domestic farm animals on a site with less than two (2) acres of existing
grazable land per animal is hereby declared to be a nuisance. No domestic
farm animals shall be placed on any site of less than five (5) acres. Keeping
of bees or operating an apiary is prohibited within the City limits.
While there is data available from various Minnesota –Based Bee Keeping organizations and from other
metro citiesabout this experience, the City Council would like to hear from City residents and the public
about the concept before it considers any particular action or any possible amendments to the City rules
that may allow such limited practice or with specific conditions.

Therefore – at 6 pm on Tuesday, May 23, 2023 the City Council will be hosting a public hearing on the
topic / matter.The meeting will be held at the Oak Park Heights City Hall – located at 14168 Oak Park
Blvd.
A short brief will be presented by City Staff that:
1.Outlines the City’s current rules.
2.Nature of the request to Amend such rules.
3.Some Background about Residential Bee Keeping& Model Ordinances used by cities.
Thereafter, the City Council would offer an opportunity for anyone who would like to offer comment on
thispossibility.

As part of the request by City resident Mr. Mike Houde, 14529 Upper 55 Street North, for the
City Council to consider amending City Ordinances to allow the keeping of bees in the City, he
provided staff with examples of communities in the metro area that allow some limitedbee
keeping: Shorewood, Lake Elmo, Maplewood, and White Bear Lake.
Staff reached out to the clerks for each of those communities to request feedback on
experiences with bees and beekeeping. All four communities responded that they have not had
any negative experiences or complaints.
From Shorewood: We have not yet had problems with beekeeping. I can send you the
handout we give to the urban farmers and also a section from the code book.
From Lake Elmo: We have issued about a dozen bee keeping permits since the licensing
process was first developed in 2014. We have only had one complaint, and that
was from a neighbor of the bee keeper who called constantly to complain during
construction of the neighboring home. I think the bee complaints were just a
continuation of her campaign against the neighbor and not really about the bees.
The complainer eventually moved and we have had no issues since.
From Maplewood: We have not received any complaints regarding residential or
commercial properties that keep bees. Our ordinance does not require a permit
for the keeping of bees so we don’t know who has them. The only way we would
know is through a complaint or questions on the ordinance. In summary, good
experience so far.
From White Bear Lake: We haven’t issued many permits since we adopted the ordinance
in 2013 – my records indicate seven permits. Overall, the city hasn’t had any
negative experiences with the property owners who keep bees on their land and
they’ve generally submitted all the documentation we need with little push back.
We require all property owners within 100 feet of the subject property to sign an
agreement and we have only had a few instances where neighbors have been
hesitant to sign. Those apprehensive neighbors have signed with the condition that
they can rescind their approval if any issues arise, and to date, none of them have.
In my experience, the permitting hasn’t added to staff’s workload and there
haven’t been any code enforcement concerns raised by surrounding residents.

surrounding residents. The City has received one written comment:
I am writing in support of Michael Houde and his quest to be allowed to
keep bees in Oak Park Heights. We are a direct neighbor and will be out
of town so we are unable to attend the meeting. Please take this email as a
show of our support of the amendment to allow bee keeping in OPH.

The City Council has yet to discuss our Council’s planned goals, desired skill sets, and
expectations for the next City Administrator. We, as a Council, will need to be able to articulate
these expectations with any potential candidate or interested party. Further, this informationis
necessary for us to assess a candidate and determine success of the next City Administrator. This
will make sure we are clear and we are not setting up the next Administrator with unclear
expectations or diverging Council opinions.
It is important that we promptly identify our desired (1) goals the City Administrator must act on,
(2)our desired skill set, and (3) our expectations. I propose a facilitated discussion with the
Council, the outgoing City Administrator, and any Department Heads that are uninterested in the
position is likely the best way to proceed. It is especially important to hear Department Heads’
thoughts in what they need—since they have a day-in-day-out working relationship with the City
Administrator. When we hired the Police Chief, we surveyed our officers for their feedback, and
it was incredibly beneficial to our hiring process—and the Chief’s first year of leadership. Would
the City Council be willing to invite someone to hold a facilitated discussion about these critical
goals and skill set envisioned for the City’s next administrator?
Lida Bannink of Eckberg Lammers, may be willing to facilitate such a discussion. However, if we
want someone with more direct expertise, we could aska former City Administrator, like Dr. Craig
Waldron. As Dr. Waldron noted in his comments (sent to us on 5-2-2023 by Eric Johnson and
attached for reference), a search firm may do something of this sort when framing the solicitation,
but it would not be a discussion that will help us evaluate and set expectations, so this may be
beneficial to do regardless of our decision on process.
I suggest that our selected facilitator (or Eric/Kevin) talk or survey all participants and provide us
food for thought/homework in advance, so that we can have productive and efficient discussions
related to goals, skill sets, and expectations. To be specific,I suggest we discuss skills related to

our goals and expectations, such as expectations related to public engagement, attending external
meetings, participating in lobbying efforts/visiting the Capitol, responsibilities (right now Eric
writes resolutions which is sometimes a responsibility left to the City Attorney), frequency of staff
meetings, frequency of contacting Councilmembers, willingness to speak on staff’s behalf/desire
for staff to attend Council meetings, and openness to new ideas, among plenty of other examples.
Following the meeting, there would be a written memo memorializing the discussions.
After we hire the next City Administrator, I also recommend that our Council sit down with the
Administrator to discuss our goals and expectations. Also, to hear their expectations and any
boundaries they may have to the extent it is not discussed in the interview process (e.g., since I
have talked to Eric outside of business hours, I’ll use that example, is the next Administrator okay
with phone calls or texts in non-emergency/crisis situations after business hours?), so that everyone
is clear on expectations in the new working relationship, and no one is left frustrated.

The City has been approached by the STW. SCHOOL DISTRICT toseeking permissions at theHigh
School to host the 202 Special Olympics over a Two-Day period - June 2-2. Such an event is required
to secure a SPEICAL EVENT PERMIT fromthe City. To date, Staff has hada couple of meetings and
the entire event seems workable froma security and operationalstandpoint. ChiefHansenis working with
them to finalize security planning and how the OPH PoliceDept. can be involved- such as a booth.

As this is well beyonda garage sale, or basketball tournamentand yes, the Special Olympics is a
benevolent organization, but an event of this size (1,200 athletes, 1,200 volunteers, 400 coaches, 500
spectators) can put responsibilities and burdens on City resources.
To helpfostera more secure environment, Staffis proposinga requirementthat OPH Police Officers
(likely one to two)be on official duty at the site – and which the City would expect to bill the DISTRICT
for such costs and is in the $3,500+/ range.

2023 SOMN Summer Games
Description Summer Gamesis Special Olympics Minnesota (SOMN)’s most attended singular sporting
competition of the year. SOMN is hosting both basketball and track and field at Stillwater Area
High School. Participants will be athletes (folks with intellectual disabilities), Unified Partners
(folks without intellectual disabilities), and coaches. Additionally, participants will bring
family/friends along to support/cheer at the competitions. Aside from the competition, we will
have many vendors, health screenings, fun activities, and sponsor tents set up in the entryway
area to the track, which we call “Athlete Village”. This provides a full couple of days to all
participants, and lots of fun things to do and see!
Date of the Event Friday,June 23-Sunday,June25
Time of the Event Set up during the week:Monday-Wednesday a staff memberwill beonsite outdoors with
UltimateEventsgettingtents in theoutdoor“athlete village” set up.OnThursdayduringthe
day (~9am-5pm), various staff members will be outdoors, completing set up of the athlete
village and setting up the track & field area. On Friday morning (~7am), staff and volunteers
will arrive to set up what is needed indoors, and complete setting up outdoor things if there is
any remaining set up.
Event itself: Friday afternoon, at approximately 1:30pm, competitions for both basketball and
track & field will begin, running until approximately 5pm that evening. On Saturday, staff and
volunteers will arrive at approximately 6:30am, with competitions beginning at about 9am and
running until about 4pm. This will mirror the schedule for Sunday as well, with staff and
volunteers cleaning up following the event on Sunday. We anticipate completing tear down by
8pm on Sunday evening, with Ultimate Events coming to break down their tents the week of
June 26.
High Level Plan The event will havetwo EMTsfromSave A Life onsite. One EMT will bestationed indoors for
basketball, and one will be stationed outdoors in a medical tent for track and field. All staff
(approximately 35) will have direction on who to call if they see a medical issue, and will have a
radio to get directly in touch with EMT services. Staff will be wearing red event management
shirts, as to be easily identifiable for any emergency needs. Staff and medical are prepared to
call 911 with cell phones in case ambulance is needed.
