Call to Order/Pledge of Allegiance: Chair Van Denburgh called the meeting to order at 6:01 p.m. Present: Commissioners Husby, Kremer and Van Dyke; City Administrator Johnson, City Planner Richards, and City Councilmember Liaison Representative Liljegren. Approval of May 11, 2023 Meeting Minutes: Commissioner Husby, seconded by Commissioner Kremer,moved to approve the Minutes as presented. Carried 4-0. IV. Department/Commission Liaison/ Other Reports: City Councilmember Liaison Representative Liljegren provided a City Council update and retiring City Administrator Johnson expressed his pleasure with having worked with the Planning Commission. Chris & Kim Hayes: Consider request for a Conditional Use Permit to allow front, rear and side-yard property line setback reductions for proposed new single family dwelling construction at 15405 57th St. N. City Planner Richards reviewed the August 3, 2023 Memorandum, provided an issue analysis, approval conditions for consideration, and discussed the same. Commission discussion was had as to setbacks and tree preservation. Chair Van Denburgh invited the applicant to address the Commission. Chris Hayes, the applicant, discussed several aspects of the site and ways that the trees could be protected. Commissioner Kremer, seconded by Commissioner Van Dyke moved to close the public hearing. Carried 5-0. Planning Commission Minutes August 10,2023 Page 2 of 3 Chair Van Denburgh allowed visitor Tom Thiets of 5665 Peller Ave. to speak. Mr. Thiets stated that he is the adjacent neighbor to the property and voiced support to the project on behalf of himself and conversations with several of the neighbors within the neighborhood. Commission discussion ensued as to the site layout, setbacks, and tree preservation. Commissioner Kremer, seconded by Commissioner Freeman moved to recommend City Council approval subject to the amended conditions within the August 3, 2023 Planning Memorandum, specifically that: 1. The City Engineer will review the drainage for the site, the final grading for the proposed structure shall be subject to approval of the City Engineer. Carried 5-0. B. Croixview Holdings, LLC: Review and consider request for an Amended Conditional Use Permit and Design Guidelines/Site Plan Review for proposed construction of an office/warehouse building at the property located at 5416 Stagecoach Trail, N. City Planner Richards reviewed the August 3, 2023 Planning Report, provided an issue analysis with regard to the requested site plan changes, approval conditions for consideration, and discussed the same. Tim Siegfried — Croixview Holdings addressed the issue of the two drive access points and updated the Commission as to the status of conversation with Washington County. Stephan Mastey— Landscape Architecture Inc. — reviewed and discussed the site layout, proposed systems for stormwater handling, landscaping, and screening for the adjacent residential property. Commissioner Kremer, seconded by Commissioner Freeman moved to close the public hearing. Carried 5-0. Commission discussion ensued as to the waterway easement, planting, and landscaping. Commissioner Kremer, seconded by Commissioner Husby moved to recommend City Council approval, subject to the conditions noted within the August 3,2023 Planning Report. Carried 5-0. VII. The Conditional Use Permit would allow separate signs for HealthPartners and Lakeview EMS on the south facade of the building facing Highway 36. The site is zoned B-2 General Business District. The HealthPartners and Lakeview EMS use is permitted in this district. EXHIBITS The review is based upon the following submittals: Exhibit 1: Sign Plan Exhibit 2: Air Photo with Property Lines ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map of the Comprehensive Plan. The current use and proposed signage are consistent with this land use designation. Zoning. The site is zoned B-2 General Business District. Section 401.15.G.8.d of the Zoning Ordinance allows for a total of three wall signs on any building, with each sign placed on a separate façade. The Applicant has proposed two wall signs on the south façade. The HealthPartners sign is 118.75 square feet, the Lakeview EMS sign is 48.67 square feet. The Ordinance allows for a maximum of 120 square feet for an individual sign and a total of 300 square feet of signage for the site. There are no other wall or freestanding signs on the building or property. The criteria found in Section 401.03.A.7 of the Zoning Ordinance must be considered when reviewing a request of this type. Conditional Use Permit. The Planning Commission should consider the following issues and impacts of the proposed project in making its recommendation. The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, are found as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). Comment: The use is consistent with the Comprehensive Plan and in conformity with present and future land uses. There will be no environmental issues or impact to surrounding property owners. There is no impact upon public services and facilities. City Staff finds no issues with the signage as proposed and other businesses on the Highway 36 corridor have received a Conditional Use Permit to allow for multiple signs on a façade. Sign Lighting. The plans show that the signs will be flat cut aluminum letters with no back lighting. If any lighting is proposed, it shall be subject to review by City Staff and comply with the provisions of the Zoning Ordinance. CONCLUSION / RECOMMENDATION Upon review of the request for a Conditional Use Permit to allow two signs on one façade at 14702 60th Street North, City Staff would recommend the project with the conditions as follows: 2 1. Any signage to be installed on site shall be in compliance with Section 401.15.G.8 of the Zoning Ordinance and will require a sign permit. 2. Any sign lighting shall be subject to review by City Staff and comply with the lighting requirements 401.15.G.4 of the Zoning Ordinance. (Applicant) on behalf of Hall Properties, LLC, the owner, has submitted an application for an Amended Conditional Use Permit/Planned Unit Development and Design Guideline/Site Plan Review for 13341 60th Street North. The Applicant has requested a fourth wall sign and the construction of a tire storage building. The Conditional Use Permit (CUP) was approved for Discount Tire in May of 2004. Discount Tire is part of the Shoppes of Oak Park Heights, a Planned Unit Development (PUD) approved in April 2004 that allowed the shopping center anchored by Kohl's. The Amended Conditional Use Permit and Planned Unit Development is required to allow for a fourth wall sign on a separate façade of the building and to add the storage building that was not a part of the original approvals. EXHIBITS The review is based upon the following submittals: Exhibit 1: Preliminary Site Plan (S100) Exhibit 2: Conceptual 1St Floor Plan (A.1) Exhibit 3: Conceptual Elevations (A.2) Exhibit 4: Conceptual Colored Elevations (A.3) Exhibit 5: Conceptual Elevations — Tire Storage Building (A.4) Exhibit 6: Sign Plan — Elevations (Sheet 4) Exhibit 7: Sign Plan — North Elevation (Sheet 5) Exhibit 8: Sign Plan — West Elevation (Sheet 6) Exhibit 9: Sign Plan — East Elevation (Sheet 7) Exhibit 10: Sign Plan — South Elevation (Sheet 8) Exhibit 11: Sign Plan — Lighting (Sheet 9) Exhibit 12: Review of the City Arborist — August 28, 2023 PROJECT DESCRIPTION The Applicant has indicated that the project is an "Amendment to a CUP/PUD to allow for construction of a tire storage building, and a brand refresh to the existing building". The new tire storage building is a 28 square foot x 28 square foot building to be constructed to the east of the Discount Storage building in the parking lot. Ten parking stalls will be removed as part of the construction. The building is to be constructed with CMU and EFS trim to match the primary structure. The building will have a metal roof. The signs on the building are being changed out and one added with the new corporate logo. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The continued use of the site for retail and service commercial use is consistent with the Comprehensive Plan. Zoning. The property is zoned B-2 General Business District. The Shoppes of Oak Park Heights development, which includes the Discount Tire, was approved as a PUD in 2004 to allow multiple commercial buildings within the development with shared access and parking. The PUD is an overlay of the B-2 District. The approval of Discount Tire in 2004 allowed for three wall signs. At the time, only two were allowed per freestanding business. A CUP/PUD is required for the addition of the tire storage building. An amended CUP is required to allow the fourth wall sign. Signage. The four wall signs proposed are all 60 square feet for a total of 240 square feet. The ordinance allows for a total of 200 square feet of wall signage. The request for the fourth sign will also include the allowance for the additional 40 square feet of signage. The signs are to be back lit. Setbacks. The tire storage building meets all accessory building setback requirements. Traffic Circulation. Traffic circulation within the site will not be impacted by this site change and the addition of the building. Parking. Ten parking stalls are being removed that makes the site more in conformance with the new parking standards. Lighting. The plans do not show any additional lighting being added as part of the tire storage building. If fixtures are added, lighting shall be full cut off and shall be consistent with Section 401.15.6.7 of the Zoning Ordinance as it relates to lighting requirements. 2 Trees/Landscaping. The City Arborist has provided a report addressing the tree removal and replacement. The final landscape plan is subject to the review and approval of the City Arborist. Grading, Drainage, Erosion Control and Utilities. No grading, drainage and utility plans were required for this project. Design Guidelines. The proposed structure and site changes are consistent with the Design Guidelines. The accessory building will match the existing Discount Tire building in materials and colors. Building Height. The building height maximum for accessory buildings is 20 feet. The proposed building is 11 feet. Section 401.03.A.7 City Council and Planning Commission Considerations. The Planning Commission and City Council should also consider the conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). Comment: The Planning Commission and City Council should review the above criteria regarding the request for the Conditional Use Permit. The storage building and sign changes will not have an adverse impact on the surrounding area or neighbors. The City Arborist has provided a review of the tree replacement to improve the appearance of the site. City Staff has no issues with the request as proposed and would recommend with conditions. CONCLUSION / RECOMMENDATION Subject to the preceding review, City staff recommends approval of the Amended Conditional Use Permit/Planned Unit Development and Design Guideline/Site Plan Review for 13341 60th Street North for the following and subject to the conditions that follow: 3 • Amended Conditional Use Permit/Planned Unit Development for the tire storage building. • Amended Conditional Use Permit to allow the fourth wall sign and to allow 240 square feet of wall sign area. • Site Plan/Design Standards Review. 1 . All light fixtures shall be full cut off and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. 2. The final landscape plan is subject to the review and approval of the City Arborist 3. The following includes my comments and/or recommendations: Preliminary Site Plan (Sheet Number S100) The overall landscaping plan items submitted with this plan set was very minor. Additional plan information must be submitted as noted in each section below. The plan includes removal of (2) two large existing spruce trees and planting of(2) two Velvet Pillar Crabapple trees. Landscape Details (Sheet L4.0) Planting Notes/Planting Detail The landscape notes and planting detail was not submitted. Please include the following items on the final plans: 1. All trees must be landscape grade trees of good form and structure not Park Grade trees. Trees with poor form will be more prone to storm damage and failure in the future. Please include this in the planting notes. 2. The trees included in the plan are hardy under local growing conditions, tolerant and/or fairly resistant to major insect and disease problems and fairly low maintenance. All plant sizes, root and container classes included in the plan must conform to the City of Oak Park Heights zoning ordinance requirements. 3. I would recommend substituting the Velvet Pillar Crabapple trees with a variety that has an excellent resistance to apple scab. Some suggested varieties include Royal Raindrops or Prairifire Crabapple. Please see Photo #3 of the existing site conditions for the island where these trees are proposed to be planted. 4. Burlap; wire and all rope must be removed from the top 12° of the root ball on all trees. 5. All trees must be straight and not need staking after planting. Contractor shall stake trees only if the tree(s) begin to lean within the guarantee period, please include this in the final planting notes. 6. The landscape contractor is required to plant trees and shrubs according to the approved planting detail diagrams and landscape notes submitted with the final approved landscape plan. This will be checked after planting and any deviations from the plans must be corrected before the landscaping will be approved by the City, this needs to be noted in the final plans. 7. Planting detail diagrams and notes must be included on the plan sheet(s) for: -Deciduous Trees -Evergreen Trees -Shrubs -Perennials -Maintenance Strip (Sod edge, seeding, landscape edging. mulch) 8. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Workers License for 2023 from the City of Oak Park Heights Building Department. All required documents must be submitted with the application. 9. The City Arborist will conduct an Initial Landscape Inspection after all plants/trees, mulch, ed. have been installed. 10. The City Arborist will conduct a Final Landscape Inspection typically (1) year after installation, at the end of the plant guarantee period. For Final Acceptance of the landscaping portion of the project the specified planting procedures must have been followed and all plants must be alive and in good condition at the end of the plant guarantee period. Tree Protection and Removal Plan (Sheet L1.0) A Tree Protection and Removal Plan was not submitted. Please include the following items on the final plans: 1. A tree inventory of all the significant trees currently located on the site must be submitted. 2 Please see the attached photo (Photo#2) of the (2) two large spruce trees that are planned to be removed. 3. I recommend also removing the spruce tree in poor condition. Please see Photo#1. Page 2 of 3 4. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Worker's License for 2023 from the City of Oak Park Heights Building Department.
