Call to Order: Mayor McComber called the meeting to order at 5:00 p.m. 2. 2024 Budget: Finance Director Caruso reviewed the summary of 2024 changes to the levy and budget compared to 2023. No action was taken. 3. 2023 Fall Clean-up Day RFP: Assistant City Administrator Pinski reviewed the RFP response as �,i!ell as the quote from Tennis Sanitation. She provided options for the fall clean-up day. Council discussed options and suggested an item be added to the Council Agenda. No action was taken. 4. Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber called the meeting to order at 5:57 p.m. Present: Councilmembers Dougherty, Johnson, Liljegren, and Runk. Staff present: City Administrator Johnson, Police Chief Hansen, Assistant City Administrator/City Clerk Pinski, City Engineer Mann, City Planner Richards, Finance Director Caruso, and City Attorney Sandstrom. Absent: None. Mayor McComber added "Authorize Issuance of the Letter of Endorsement /Support from the City to the State for ETAC Appointment" to the Consent Agenda as Item G and "Fall Clean-up Day' as Old Business Item A. She also reported the Closed Session would be removed from the Agenda and the City Council would hold a Worksession following the meeting to discuss the City Administrator position. Councilmember Runk, seconded by Councilmember Liljegren, moved to approve the Agenda as amended. Carried 5-0. II. Council/Staff Reports: A. Mayor McComber: She reported she had a breakfast meeting with Xcel hierg}r representatives regarding the King Plant, she had a LMC Local Economies meeting, she would be attending the Metro Cities Transportation and General Government meetings, the Regional Council of Mayors meeting, the Minnesota Mayor's Association meeting, and the Lake Elmo Airport Advisory Committee meeting. She also reported she was asked by the LMC Executive Director to be on the NLC Executive Board, however she did decline. B. Councilmember Dougherty: He reported he attended the Parks and Trails Commission meeting where they had continued discussion on the walkthrough list, and there would be a ribbon cutting at Swager Park on October 16 at 5:00 p.m. for the new playground equipment. C. Councilmember Johnson: No report. D. Councilmember Liljegren. He reported he attended the Planning Commission meeting and would be attending the Lake Elmo Airport Advisory Committee meeting. E. Councilmember Runk: No report. F. Staff Police Chief Hansen reported they received the squad car back from the BCA investigation following the active shooter incident in Stillwater in March, and that school would be starting the following Monday. Assistant City Administrator/City Clerk Pinski reported that Sharon Binger at 6385 Peacan Avenue North was chosen as the recycling award winner. III. Visitors/Public Comment: Jim Kremer of 5475 Oakgreen Court North spoke about New Business Item D. He suggested the City would be able to analyze and make decisions based on available data without the need for a study, and staff should meet to look at the problem and come up with common sense solutions. Fall Clean-up Day: Councilmember Johnson, seconded by Councilmember Dougherty, moved to direct staff to enter into an. agreement with Curbside Waste for the Fall Clean-up Day as long as there was a positive referral, otherwise authorization to enter into an agreement with Tennis Sanitation for Fall Clean-up Day with a change in event that the City would not accept appliances and mattresses. Carried 4-1, McComber opposed. VII. New Business: A. Notice of Retirement Finance Director —Betty Caruso: Mayor McComber, seconded by Councilmember Liljebn-en, moved to appoint Mayor McComber, Councilmember Runk, Kari 'egarski, Jennifer Pinski, and Betty Caruso to a committee for the replacement of the Finance Director. Councilmember Johnson reported she spoke with Chief of Police Hansen who did not recommend lowering the speed limit below 25 mph. She suggested staff could internally discuss options without a speed limit study and could come back with a recommendation. Councilmember Dougherty requested a cost estimate to re-sign all City streets for a new speed limit. Councilmember Johnson, seconded by Councilmember Liljegren. moved to direct staff to discuss and come back with recommendations and to obtain a cost estimate for signs. Carried 5-0. E. Approve MNDOT — 60a' Street Turnback of Limited Areas to the City: Councilmember Johnson, seconded by Councilmember Liljegren, moved to approve the Resolution. Roll call vote taken. Carried 5-0. VIII. Other Council Items or Announcements: Mayor McComber reported that an open house would be held on August 30 from noon to 5:00 p.m. at City Hall for City Administrator Eric Johnson's retirement. Councilmember Runk reported that he sent a letter regarding the 58`h Street Extension project which was in Weekly Notes, and he received a response which would be in Weekly Notes. He said he was drafting a response to their response. He said based on his review of the documents received as part of his data request, the developer, Summit Management, Hy -Vee, and the County began the process in mid -2017 which was two and a half years before they came to Oak Park Heights. Stillwater documents indicate they became involved in late-2418/early- 2019 which was a year before involving Oak Park Heights. He said by the time they came to Oak Park Heights, they had reached an understanding that the developer would provide properties for the right-of-way for the Manning/Highway 36 project and a construction easement to allow traffic to get out of the sanctuary during construction, and in exchange the County would build the road and Stillwater would agree to annexation and would run utilities, and Stillwater and the County would provide tax abatement funds in order to pay for the infrastructure. The trees being planted are a variety of different species to replace some of the ash trees that have been removed due to Emerald Ash Borer (EAB). The list includes planting locations, tree species and sizes of trees to be planted. Residents having a boulevard tree planted along the City boulevard right-of-way at their address will be sent a notification letter which will include when the planting will take place (weather dependent) as well as other important details on caring for the new tree. Quote requests were sent out to (2) two tree services. One of the tree services has done many tree plantings for the City in previous years and the other company is a tree service located in Hudson, WI that has many years of experience also but has not worked for the City before. Both of the tree services provided a quote and all requested information by the deadline. Willow River Company provided the lowest quote for $21,763.00, therefore I recommend that Willow River be awarded the project. The work to be performed consists of tree planting, initial watering, mulching and a one (1) -year guarantee after planting of all trees included in this quote request. Any notes or other important comments are also listed. Technical Specifications All trees are to be landscape qualit of good form with straight trunks. Planted tree stock must be no larger than 2" caliper bareroot and/or no larger than #20 container size class unless a different stock is approved by the City Arborist. Please see additional information on each tree size in the Order Total Column on the Tree Planting List page at the end of this packet. Each tree shall be measured according to the American Standard of Nursery Stock (ANSI Z60) standards (most recent edition) and planted in accordance with the standards set in the Minnesota Department of Natural Resources Pocket Guide to Planting Trees. No undersize trees or trees of poor form will be accepted. All trees must be planted plumb and be able to stand straight after planting or the City will require that the tree(s) be replaced. Trees included in this quote request are along City boulevard right-of-ways and in City Parks. (Please see included itemized list for addresses and additional comments regarding the trees to be planted). Contractors also must submit the following items with the itemized quote spreadsheet: A current copy of the contractor's Certificate of Liability Insurance Coverage with the City of Oak Park Heights named as an Page 16 of 110 additional insurer for $1,000,000, current proof of Worker's Compensation Insurance, and the completed page from this packet titled "Contractor Qualifications 2023." (Please see attached itemized list for tree species, sizes and specifics for each tree). The deadline for submission of all completed requested items in this packet is NOON on Wednesday, September 20" 2023 (for consideration at the City of Oak Park Heights City Council Meeting on Tuesday, September 26`' 2023. Basis of Contract Award The City reserves the right to accept or reject any quote. The award of the planting contract is based in part on the lowest quote; however, the City reserves the right to factor past work, references and available equipment into their decision regarding the work award. The awarded contractor will be contacted by phone within a timely manner by the City Arborist after the date of the City Council meeting in which the quote was considered at. Licensing: Tree services working in the City of Oak Park Heights must have a current Tree Worker's License. This license may be obtained from City staff at City Hall upon presentation of proof of current Liability Insurance Coverage, proof of current Worker's Compensation Insurance, and payment of the license fee. A current City of Oak Park Heights Tree Worker's License is required before any contract work is done for the City. Project Completion Date The City of Oak Park Heights Fall 2023 Boulevard & Park Tree Planting is to be completed no later than Friday, December 15' 2023. Final Invoice must also be received by the City at this time also. Subcontractors The planting contract is between the City and the contractor which has submitted the successful quote. The contractor must not execute an agreement with any subcontractor to perform any portion of the work unless the contractor has received written approval for such subcontractor from the City of Oak Park Heights. Payment for Work Performed Payment of the Fall 2023 Planting contract will be made on the basis of the quoted unit prices for the work performed. The tree contractor will be pard for the work performed after completion of work, submission of an itemized invoice to the City of Oak Park Heights, and inspection of completed work by the City Arborist. If it is determined upon inspection that the required work has not been fully completed, the contractor will be notified and will be paid only upon satisfactory completion of all work. Access The contractor may utilize City streets for the operation, provided that traffic access is available and proper traffic control signage/measures are in place. The purpose of this cover memo to the proposal is to outline the specific requirements of the statutes that grant the City authority to set speed limits in particular areas. Per MN Statute 169.14.2.a.7 169,14.2.b Subdivision 2 of the statute states that the road authority having jurisdiction over the residential roadways can adopt 25 miles per hour in residential roadways. The road authority must erect signs designating the speed limit at the beginning and end of the residential roadway on which the speed limit applies. Therefore; the City can choose to lower the speed limit on residential streets from the default statutory 30mph (subd.2.a.1) to 25mph (subd. 2.a.7) without performing an engineering and traffic investigation, Speed limit signage is required as indicated above (subd.2.b). Per MN Statute 169.14.5h Subdivision 5.h states that the City may establish speed limits on city streets in their jurisdiction other than the limits provided in subdivision 2 (25mph in residential roadways for example). If the City chooses to establish different speed limits, lower than 25, down to 20, they must be implemented in a consistent and understandable manner. The City must erect appropriate signs to display the speed limit. The City must develop procedures to set speed limits based on the City's safety, engineering, and traffic analysis. At a minimum, the safety, engineering, and traffic analysis must consider national urban speed limit guidance and studies, local traffic crashes, and methods to effectively communicate the change to the public. Minnesota State Statutes authorize cities to set speed limits with additional study and analysis on select city streets. In order for the City to adopt reduced speed limits, a procedure must be developed to set speed limits based on a safety, engineering and traffic analysis. The total estimated hourly not -to -exceed (without prior authorization) fee for these services is $32,450, including expenses. Task descriptions and a fee summary are provided below. SCOPE OF SERVICES Task 1: Project Management This task includes planning and coordination of all work tasks including budget tracking and coordination as well as correspondence with the City of Oak Park Heights. The City will be kept informed on the project throughout its duration. Task 2: Data Collection Available data will be collected from the City of Oak Park Heights, Washington County and MNDOT as applicable. Data will include, but not necessarily be limited to the following: • Inventory of existing and proposed roadway jurisdiction and functional classification • Existing speed limits on roadways within the City • Crash datalmapping on area roadways for the past three (3) full years • Existing Annual Average Daily Traffic (AADT) Data on area roadways • Existing multimodal facilities • Existing land use, zoning and other mapping data Additionally, Stantec's subconsultant; Quality Counts, will deploy tube counters and collect daily volume and speed data for 24 hours at up to ten (10) locations on city streets. A safety, engineering and traffic analysis will be conducted that identifies which city streets have current crash, safety, speed limit, or capacity issues or concerns. This task will include documentation and the rationale for setting specific speeds in a report. Task 4: Speed Limit Policy/Communication Planlimplementation Recommendation A speed limit policy will be developed based on current Minnesota state rules and documentation for the Safety, Engineering, and Traffic Analysis, outlining what speed limits should be implemented on city streets. The policy will also identify the next steps for implementation including recommendations for when and where speed limit signs should be posted and a communication plan for public outreach and education. Task 5: Meetings Stantec will attend meetings that are necessary to discuss or present the speed limit analysis. Two (2) meetings with City staff, one (1) meeting with the City Council, and two (2) public meetings are assumed as part of this proposal to review and discuss the draft Safety, Engineering, and Traffic Analysis Report/Speed Limit Policy. The two public meetings are for public input and communication of the study results. Subdivision 1. Duty to drive with due care. No person shall drive a vehicle on a highway at a speed greater than is reasonahle and prudent under the conditions. Subd. I a. License revocation for extreme speed. The driver's license of a person who violates any speed limit established in this section, by driving in excess of 100 miles per hour, is revoked for six months under section 171.17, or for a longer minimum period of time applicable under section 169A.53, 169A.54, or 171.174. Subd. 2. Speed limits. (a) Where no special hazard exists the following speeds shall be lawful, but any speeds in excess of such limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful; except that the speed limit within any municipality shall be a maximum limit and any speed in excess thereof shall be unlawful: (1 1) 30 miles per hour in an urban district; (2) 65 miles per hour on noninterstate expressways, as defined in section 160.02, subdivision 18b, and noninterstate freeways, as defined in section 160.02, subdivision 19; (3) 55 miles per hour in locations other than those specified in this section; (4) 70 miles per hour on interstate highways outside the limits of any urbanized area with a population of greater than 50.000 as defined by order of the commissioner of transportation; (5) 65 miles per hour an interstate highways inside the limits of any urbanized area with a population of greater than 50,000 as defined by order of the commissioner of transportation; (6) ten miles per hour in alleys; (7) 25 miles per hour in residential roadways if adopted by the road authority having jurisdiction over the residential roadway; and (8) 35 miles per hour in a rural residential district if adopted by the road authority having jurisdiction over the rural residential district. (b) A speed limit adopted under paragraph (a), clause (7), is not effective unless the road authority has erected signs designating the speed limit and indicating the beginning and end of the residential roadway ort which the speed limit applies. (c) A speed limit adopted under paragraph (a), clause (8), is not effective unless the road authority has erected signs designating the speed limit and indicatingthe beginning and end of the rural residential district far the roadway on which the speed limit applies. (d) Notwithstandincy section 609.0331 or 609.101 or other law to the contrary, a person who violates a speed limit established in this subdivision, ora speed limit designated on an appropriate sign under subdivision 4, 5, 5b, 5c, or 5e, by driving 20 miles per hour or more in excess of the applicable speed limit, is assessed an additional surcharge equal to the amount of the fine imposed for the speed violation, but not less than $25. Notwithstanding subdivision 2; the speed limit is increased by ten miles per hour over the posted speed limit when (lie driver: (I) is on a two-lane highway having one lane for each direction of travel; (2) is on a highway with a posted speed Iimit that is equal to or higher than 55 miles per hour; (3) is overtaking and passing another vehicle proceeding in the same direction of travel; and (4) meets the requirements in section 169.18. Subd. 3. Reduced speed required. (a) The driver of any vehicle shall, consistent with the rcquirements, drive at an appropriate reduced speed when approaching or passing an authorized emergency vehicic Mopped with emergency lights flashing on any street or highway, when approaching and crossing an intersection or railway grade crossing, when approaching and going around a curve, when approaching a hill crest, �ti lien traveling upon any narrow or winding roadway, and when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions. (b) A person who fails to reduce speed appropriately when approaching or passing an authorized emergency vehicle stopped with emergency lights flashing on a street or highway shall be assessed an additional surcharge equal to the ant01111t of the Fine imposed for the speed violation, but not less than $25. Subd. 4. Establishment of zones by coin inissioner. On determining upon the basis of an engineering and traffic investigation that any speed set forth in this section is greater or less than is reasonable or safe under the conditions found to exist on any trunk highway or upon nn�� part thereof, the commissioner may erect appropriate signs designating a reasonable and safe speed limit there,a, which speed limit shall be effective when such signs are erected. Any speeds in excess of such limits shah) be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful; except that any speed limit within any municipality shall be a maximum limit and any sped in excess thereof shall be unlawful. On determining upon that basis that a part of the treinl; hi Yhwav 5v,t, m outside a municipality should be a zone of maximum speed limit, the commissioner may establish that part as such a zone by erecting appropriate signs showing the beginning and end of the zone, designating a reasonable and safe speed therefor, which may be different than the speed set forth in (his section, and that it is a zone of maximum speed limit. The speed so designated by the commissioner within any such zone shall be a maximum speed limit, and speed in excess of such limit shall be unlawful. The commissioner may in the same manner from time to time alter the boundary of such a zone and the speed limit therein or eliminate such zone. Subd. 4a. [Repealed, 1997 c 143 s 20] Subd. 5. Zoning within local area. When local authorities believe that the existing speed limit upon any street or highway, or part thereof, within their respective Jurisdictions and not a part of the trunk highway system is greater or less than is reasonable or safe under existing conditions, they may request the commissioner to authorize, upon the basis of an engineering and traffic investigation, the erection of appropriate signs designating what speed is reasonable and safe, and the commissioner may authorize the erection of appropriate signs designating a reasonable and safe speed limit thereat, which speed limit shall be effective when such signs are erected. Any speeds in excess of these speed limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful; except that any speed limit within any municipality shall be a maximum limit and any speed in excess thereof shall be unlawful. Alteration of speed limits on strects and highways shall be made only upon authority of the commissioner except as provided by law. All such signs shall be erecicd by the local authorities on these streets and highways under their respective jurisdictions and by the commissioner of transportation on trunk highways. (c) For the purpose of this subdivision, "school zone" means that section of a street or highway which abuts the grounds of a school where children have access to the street or highway from the school property or where an established school crossing, is located provided the school advance sign prescribed by the Manual on Uniform Traffic Control Devices adopted by the commissioner of transportation pursuant to section 169.06 is in place. All signs erected by local authorities to designate speed limits in school zones shall conform to the Manual on Uniform Traffic Control Devices. (d) Notwithstanding section 609.0331 or 609.101 or other law to the contrary, a person who violates a speed limit established under this subdivision is assessed an additional surcharge equal to the amount of the fine imposed for the violation, but not than 525. Subd. 5b. Segment in urban district. When any segment of at least a quarter -mile in distance of any city street, municipal state -aid street, or town road on which a speed Iimit in excess of 30 miles per hour has been established pursuant to an engineering and traffic investigation by the commissioner meets the definition of"urban district" as defined in section 169.011, subdivision 90, the governing body of city or town may by resolution declare the segment to be an urban district and may establish on the segment the speed limit for urban districts prescribed in subdivision 2. The speed limit so established shall he effective upon the erection of appropriate signs designating the speed and indicating the beginning and end of the segment on which the speed limit is established, and any speed in excess of such posted limits shall be unlawful. A copy of the resolution shall be transmitted to the commissioner at least ten days prior to the erection of the signs. Subd. 5c. Speed zoning in alleyway. Local authorities may regulate speed limits for alleyways as defined in section 169,011 based on their own engineering and traffic investigations. Alleyway speed limits established at other than ten miles per hour shall be effective when proper signs are posted. Subd. 5d. Speed limit in work zone when workers present. (a) Notwithstanding subdivision 2 and subject to subdivision 3; the speed limit on a road having an established speed limit of 50 miles per hour or greater is adjusted to 45 miles per hour in a work zone when (I) at least one lane or portion of a lane of traffic is closed in either direction, and (2) workers are present. A speed in excess of the adjusted speed limit is unlawful. (b) Paragraph (a) does not apply to a segment of road in which: (1) positive barriers are placed between workers and the traveled portion of the highway; (2) the work zone is in place for less than 24 hours; (3) a different speed limit for the work zone is determined by the road authority following an engineering and traffic investigation and based on accepted engineering practice; or Official Publication of the State of'Minuesota Devisor of` Statutes Page 48 of 110 169. 14 MINNESOTA STATUTES 2022 (4) a different speed limit for the work zone is established by the road authority under paragraph (c). (d) A work zone speed limit under paragraph (c) is effective on erection of appropriate regulatory speed limit signs. The signs must be removed or covered when they are not required. A speed in excess of the posted work zone speed limit is unlawful. (e) For any speed limit under this subdivision, a road authority shall erect signs identifying the speed limit and indicating the beginning and end of the speed limit zone. Subd. 5e, Speed limit on Park road. The political subdivision with authority over a park may estaltfi li a speed limit on a road located within the park. Any speed in excess of the posted speed is unlawful. Subd. 5f. Speed limits on certain rural residential districts. (a) A rural residential district existing and lawfully signed before August I, 2009, continues to qualify as a rural residential district. (b) A rural residential district existing and lawfully signed before August 1, 2009, is subject to the speed limit signed before August I, 2009. [See Note.] Subd. 5g. St. Louis County Road 128. Notwithstanding any provision to the contrary in this section, the speed limit on �,T I ouis County Road 128 in Eagles Nest Township between marked Trunk Highway 169 and County Road : ti9 is 40 miles per hour. The county engineer must erect appropriate signs displaying the 40 miles per hour speed limit. Subd. 5h. Speed limits on city streets. A city may establish speed limits for city streets under the city's jurisdiction other than the limits provided in subdivision 2 without conducting an engineering and traffic investigation. This subdivision does not apply to town roads. county highways, ol- truni, highways in the city. A city that establishes speed limits pursuant to this section must implement speed limit changes in a consistent and understandable manner. The city must erect appropriate signs to display the speed limit. A city that uses the authority under this subdivision must develop procedures to set speed limits based on the city's s�rl,t�. ��n��ineering, and traffic analysis. [Repealed, Ex 1971 c 27 s 49] Subd. 6a. Work zone speed limit violations. A person convicted of operating a motor vehicle in violation of speed limit in a work zone, or any other- provision of this section while in a work zone, shall be required to pay a fine of $300. This fine is in addition to the surcharge under section 357.021. subdivision 6. Subd. 7. Burden of proof. The provisions of this chapter declaring speed limitation shall not be construed to relieve the plaintiff in any civil action from the burden of proving negligence on the part of the defendant as the proximate cause of an accident. Subd. 8. Minimum speeds. On determining upon the basis of an engineering and traffic investigation that a speed at least as great as, or in excess of a specified and determined minimum is necessary to the reasonable and safe use of any trunk ol, portion thereof, the commissioner may erect appropriate signs specifying the minimum spCCd ou Such highway or portion thereof. Subd. 9. Standards of evidence. In any prosecution in which the rate of speed ofa motor vehicle is relevant, evidence ofthe speed of a motor vehicle as indicated oil the speedomctcr lh,�r�-ofshall be admissible on a showing that a vehicle is regularly used in traffic law enforcement and than ilrc tipeedometer thereon is regularly and routinely tested for accuracy and a record of the results of said tests kept on file by the agency having control of said vehicle. Evidence as to the speed indicated on said speedometer shall be prima facie evidence that the said vehicle was, at the tinge said reading ohserved. traveling at the rate of speed so indicated; subject to correction by iht amount ul' error, if arty, shown to exist by the test made closest in time to the time of said reading. Records of speedometer tests kept in the regular course of operations of any law enforcement agency shall be admissible without further foundation, as to the results of said tests. Such records shall be available to the defendant upon demand. Nothing herein shall be construed to preclude or interfere with the cross examination or impeachment of evidence of rate of speed as indicated by speedometer readings, pursuant to the Rules of Evidence. Subd, 10. Radar; speed -measuring device; standards of evidence. (a) In any prosecution in which the rate of speed of a motor vehicle is relevant, evidence of the speed as indicated on radar or other speed -measuring device is admissible in evidence, subject to the following conditions: (1) the officer operating the device has sufficient training to properly operate the equipment, (2) the officer testifies as to the manner in which the device was set up and operated; (3) the device was operated with minimal distortion or interference from outside sources. and (4) the device was tested by an accurate and reliable external mechanism, method, or system at the time it was set up. (b) Records of tests made of such devices and kept in the regular course of operations of any law enforcement agency are admissible ire evidence without further foundation as to the restdts of the tests. The records shall be available to a defcnc:.tnt upon demand. Nothing in this subdivision shall be construed to preclude or interfere with cross cxamination or impeachment of evidence of the rate of speed as indicated on the radar or speed-measurino device. (a) Law enforcement agencies that use handheld radar units shall establish operating procedure, to reduce the operator's exposure to microwave radiation. (b) The procedures, at a minimum, must require: ( I ) that the operator turn the unit off when it is not in use: (2) if the unit has a standby mode, that the operator use this mode except when measuring a vehicle's speed; (3) that the operator not allow the antenna to rest against the operator's body while it is in operation; and (4) that the operator always point the antenna unit away from the operator and any other person in very close proximity to the unit. Subd. 12. Radar jammer. For purposes of this secl ion, "i -cedar jammer" means any instrument, device, or equipment designed or intended for use with a vehicle or otherwise tojam or interfere in any manner with a speed -measuring device operated by a peace officer. No person shall sell, offer for sale, use, or possess any radarjammer in this state. The Applicant has requested a fourth wall sign and the construction of a tire storage building. The Conditional Use Permit (CUP) was approved for Discount Tire in May of 2004. Discount Tire is part of the Shoppes of Oak Park Heights, a Planned Unit Development (PUD) approved in April 2004 that allowed the shopping center anchored by Kohl's. The Amended Conditional Use Permit and Planned Unit Development is required to allow for a fourth wall sign on a separate fagade of the building and to add the storage building that was not a part of the original approvals. The new tire storage building is a 28 square foot x 28 square foot building to be constructed to the east of the Discount Storage building in the parking lot. Ten parking stalls will be removed as part of the construction. The building is to be constructed with CMU and EFS trim to match the primary structure. The building will have a metal roof. The signs on the building are being changed out and one added with the new corporate logo. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The continued use of the site for retail and service commercial use is consistent with the Comprehensive Plan. Zoning. The property is zoned B-2 General Business District. The Shoppes of Oak Park Heights development, which includes the Discount Tire, was approved as a PUD in 2004 to allow multiple commercial buildings within the development with shared access and parking. The PUD is an overlay of the B-2 District. The approval of Discount Tire in 2004 allowed for three wall signs. At the time, only two were allowed per freestanding business. A CUP/PUD is required for the addition of the tire storage building. An amended CUP is required to allow the fourth wall sign. Signage. The four wall signs proposed are all 60 square feet for a total of 240 square feet. The ordinance allows for a total of 200 square feet of wall signage. The request for the fourth sign will also include the allowance for the additional 40 square feet of signage. The signs are to be back lit. Setbacks. The tire storage building meets all accessory building setback requirements Traffic Circulation. Traffic circulation within the site will not be impacted by this site change and the addition of the building. Parking. Ten parking stalls are being removed that makes the site more in conformance with the new parking standards. Lighting. The plans do not show any additional lighting being added as part of the tire storage building. If fixtures are added, lighting shall be full cut off and shall be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. 2 Page 69 of 110 Trees/Landscaping. The City Arborist has provided a report addressing the tree removal and replacement. The final landscape plan is subject to the review and approval of the City Arborist. Grading, Drainage, Erosion Control and Utilities. No grading, drainage and utility plans were required for this project. Design Guidelines. The proposed structure and site changes are consistent with the Design Guidelines. The accessory building will match the existing Discount Tire building in materials and colors. Building Height. The building height maximum for accessory buildings is 20 feet. The proposed building is 11 feet. Section 401.03.A.7 City Council and Planning Commission Considerations. The Planning Commission and City Council should also consider the conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). Comment: The Planning Commission and City Council should review the above criteria regarding the request for the Conditional Use Permit. The storage building and sign changes will not have an adverse impact on the surrounding area or neighbors. The City Arborist has provided a review of the tree replacement to improve the appearance of the site. City Staff has no issues with the request as proposed and would recommend with conditions. CONCLUSION / RECOMMENDATION Subject to the preceding review, City staff recommends approval of the Amended Conditional Use Permit/Planned Unit Development and Design Guideline/Site Plan Review for 13341 60th Street North for the following and subject to the conditions that follow: 3 Page 70 of 110 • Amended Conditional Use Permit/Planned Unit Development for the tire storage building. • Amended Conditional Use Permit to allow the fourth wall sign and to allow 240 square feet of wall sign area. • Site Plan/Design Standards Review. 1. The following includes my comments and/or recommendations: Preliminary Site Plan (Sheet Number 5100) The overall landscaping plan items submitted with this plan set was very minor. Additional plan information must be submitted as noted in each section below. The plan includes removal of (2) two large existing spruce trees and planting of (2) two Velvet Pillar Crabapple trees. Landscape Details (Sheet 1-4.0) Planting Notes/Planting Detail The landscape notes and planting detail was not submitted. Please include the following items on the final plans: 1. All trees must be landscape grade trees of good form and structure not Park Grade trees. Trees with poor form will be more prone to storm damage and failure in the future. Please include this in the planting notes. 2. The trees included in the plan are hardy under local growing conditions, tolerant and/or fairly resistant to major insect and disease problems and fairly low maintenance. All plant sizes, root and container classes included in the plan must conform to the City of Oak Paris Heights zoning ordinance requirements. Page 83 of 110 3. 1 would recommend substituting the Velvet Pillar Crabapple trees with a variety that has an excellent resistance to apple scab. Some suggested varieties include Royal Raindrops or Prairifire Crabapple. Please see Photo #3 of the existing site conditions for the island where these trees are proposed to be planted. 4. Burlap, wire and all rope must be removed from the top 12" of the root ball on all trees. 5. All trees must be straight and not need staking after planting. Contractor shall stake trees only if the tree(s) begin to lean within the guarantee period, please include this in the final planting notes. 6. The landscape contractor is required to plant trees and shrubs according to the approved planting detail diagrams and landscape notes submitted with the final approved landscape plan. This will be checked after planting and any deviations from the plans must be corrected before the landscaping will be approved by the City, this needs to be noted in the final plans. 7. Planting detail diagrams and notes must be included on the plan sheet(s) for: -Deciduous Trees -Evergreen Trees -Shrubs -Perennials -Maintenance Strip (Sod edge, seeding, landscape edging, mulch) 8. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Worker's License for 2023 from the City of Oak Park Heights Building Department. The Applicant has proposed two wall signs on the south Page 98 of 110 facade. The HealthPartners sign is 118.75 square feet, the Lakeview EMS sign is 48.67 square feet. The Ordinance allows for a maximum of 120 square feet for an individual sign and a total of 300 square feet of signage for the site. There are no other wall or freestanding signs on the building or property. The criteria found in Section 401.03.A.7 of the Zoning Ordinance must be considered when reviewing a request of this type. Conditional Use Permit. The Planning Commission should consider the following issues and impacts of the proposed project in making its recommendation. The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, are found as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The demonstrated need for such use. 7. Traffic generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all pen`ormance standards contained herein (i.e., parking, loading, noise, etc.). Comment: The use is consistent with the Comprehensive Plan and in conformity with present and future land uses. There will be no environmental issues or impact to surrounding property owners. There is no impact upon public services and facilities. City Staff finds no issues with the signage as proposed and other businesses on the Highway 36 corridor have received a Conditional Use Permit to allow for multiple signs on a facade. Sign Lighting. The plans show that the signs will be flat cut aluminum letters with no back lighting. If any lighting is proposed, it shall be subject to review by City Staff and comply with the provisions of the Zoning Ordinance. CONCLUSION / RECOMMENDATION Upon review of the request for a Conditional Use Permit to allow two signs on one facade at 14702 60th Street North, City Staff would recommend the project with the conditions as follows: 2 Page 99 of 110 if Any signage to be installed on site shall be in compliance with Section 401.15.G.8 of the Zoning Ordinance and will require a sign permit. 2.
