Per our conversation, the missing rim board and guard sections on your deck to need to be reinstalled. The guards required by Minnesota Residential Building Code Section R312 does require gua;ds to be located along the open side of the deck as it is greater than 30 inches above grade to the deck walking surface. I have enclosed this Code section for your reference. Your pool is directly adjacent to your deck; as such, the guard at the deck serves to meet the R312 deck guard Code requirements and also serves as closure to pool access for safety per Swimming Pool Ordinance 1303. You indicated your desire to continue access to your pool from your deck. A guard placement, with a gate meeting the height and spacing criteria of R312, and which is closed and locked when the pool is not in use, would be acceptable. Also, with the deck serving as the access point to the pool, the stairway to the deck should also have a gate that is locked so that the pool area cannot be accessed when not in use. The existing guards are prefabricated and should be readily available. Kindly submit your permit application with a plan and/or detailed description of what is proposed for the rim, guard, and any gates to the deck/pool area, to my attention at your earliest.
