AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed
according to: (1)the conditions of this permit;(2)the
approval plans and specifications;(3)the applicable city
approvals, Ordinances, and Codes;and,(4)the State Building
Code. This permit is for only the work described,and does
not grant permission for additional or related work which
requires separate permits. This permit will expire and become
null and void if work is not started within 180 days,or if work
is suspended or abandoned for a period of 180 days any time
after work has commenced. The applicant is responsible for
assuring all required inspections are requested in conformance
with the Minnesota State Building Code.

Installation Plan
Northern's contractor will install an 8-foot privacy fence along the north,east and west facility
boundaries, backed with a chain-link fence on the inside of the facility directly behind the 8-foot privacy
fence for security purposes.The 8-foot privacy fence will not be installed on the southern facility
boundary.The southern boundary will be fenced with chain-link only to allow Northern Natural Gas
personnel line of sight into the facility.
Northern's fencing will extend as follows:
• 75-feet along the north boundary line in the City of Oak Park Heights
• 154-feet along the east boundary line in the City of Oak Park Heights
o In this section Northern will have a 20-foot wooden gate
• 46-feet along the east boundary line in the Township of Baytown
• 75-feet along the south boundary line in the Township of Baytown
• 154-feet along the west boundary line in the City of Oak Park Heights
• 46-feet along the west boundary line in the Township of Baytown

BACKGROUND
Northern Natural Gas has proposed construction of an eight-foot security and screening
fence at their substation located at 55th Street and Oakgreen Avenue North. The
substation was constructed in the 1960's before the current Zoning requirements for
screening of commercial properties. The property is zoned R-1 Single Family
Residential District in which essential services are a permitted accessory use.
There is an existing chain link fence which is a grandfathered non-conforming fence that
does not provide screening. That fence can be maintained and repaired as is, but now
that Northern Natural Gas is proposing a new fence, they must follow the provisions of
Section 401.15.E.8 which requires City Council review of the design and materials. A
Conditional Use Permit and public hearing are not required for this review.

ISSUES ANALYSIS
Project Description. The eight-foot wood fence is proposed on all sides of the
substation. Behind the wood fence a chain link fence would be constructed for security
reasons. The 20-foot gate for entry into the enclosure would be on the east side of the
site facing Oakgreen Avenue. The gate would be chain link so that emergency
personnel would be able to view the inside of the enclosure. The fence would be
located on the property line with no landscaping proposed.
Required Fencing and Screening. Section 401.15.E.8 of the Zoning Ordinance
provides requirements for fencing and screening for a business or industrial use that
abuts property zoned for residential use. In the case of the substation, the property to
the north, east and west is zoned R-1 Single Family Residential District. To the south is
Baytown Township. The Zoning Ordinance specifies the following:
8. Required Fencing and Screening. Where any public, institutional, business
or industrial use (i.e., structure, parking or storage) abuts property zoned for residential
use, that public, institutional, business or industrial use shall provide screening along
the boundary of the residential property. Screening shall also be provided where a
public, institutional, business or industrial use is across the street from a residential
zone, but not on that side of a public, institutional, business or industrial use considered
to be the front (as determined by the Building Official). All the fencing and screening
specifically required by this Ordinance shall be subject to Section 401.15.E.3. and shall
consist of either a fence or a green belt planting strip as provided for below.
b. A required screening fence shall be constructed of masonry, brick, wood
or metal. Such fence shall provide a solid screening effect and not exceed eight
(8) feet in height or be less than six (6) feet in height. The design and materials
used in constructing a required screening fence shall be subject to the approval
of the City Council based upon a recommendation by the City staff.
The proposed eight-foot wood fence will provide the required screening on the west and
north sides of the property. The fence is not required on the east side in that that is
considered the front of the lot, but Northern Natural Gas proposes to provide the
screening fence on east side of their property, including that portion that is in Baytown
Township.
The City Council should consider the proposal for the fence as it relates to the design
and materials. City Staff is favorable to the design of the fence and sees it as a
significant improvement to the existing chain link fence that provides no screening.
Odors and Noise. There have been complaints of odor and noise at the site. The
representatives of Northern Natural Gas have indicated that the odor is caused during
those times when a scent is added to the gas and should not be a constant issue. The
wood fence will help with the noise issues.
CONCLUSION AND RECOMMENDATION
Based upon the preceding review, City staff recommends the City Council approve the
construction of an eight-foot security and screening fence, according to the submitted
plans, at the Northern Natural Gas substation located at 55th Street and Oakgreen
Avenue North.
