Dear Mr. Larson:
The City received your application materials on January 24, 2024 for a Rezoning,
Conditional Use Permit and Design Guidelines/Site Plan review for a proposed multi-
unit apartment building on 581h Street, to the west of Menards. The application has been
deemed incomplete. As of this date, not all of items have been received and the
application is rejected. The remaining required items are:
1. A new application form shall be submitted that adds the Comprehensive Land
Use Plan Amendment and the Major Subdivision.
2. Documentation that demonstrates how the proposal complies with the
Supplemental Agreement, dated March 9, 2004, or alternately, how the proposed
site plan can be designed to comply with the provisions of the Supplemental
Agreement, such as limiting access only onto 58th Street.
As per our previous meetings, the key issue is access. Your team has not sufficiently
provided a site plan and demonstrated solutions for access that can comply with the
Supplemental Agreement and provide safe ingress and egrees to and from the site. We
welcome a meeting with you and the property owner, Bob Brackey, when you have new
solutions to the access issue.
The items received by the City including the application form, fees and hard copies of
the plans will be sent to you separately. If you have any questions please do not
