Zoning&Development Items:
1. No additional Development Applications have been received—thus far only
the Nelson Driveway&the Sodie's Cigar Shop expansion.We are now sz:. -
expecting a Fill/Grading application—that is needed to be completed by CUP
for a project at Fury Motors site. Fury asked to temp-place some fill on a $� r
grass area while they secure a CUP and complete their land acquisition from
the Americlnn site. Pending a final CUP, they we given temporary permission ' ` , ,.
with several conditions—see the enclosed permit.There are no expected
impacts to floodplain, wetlands,trees, etc. See images.
2, Please see the response to the property owner on Peacan Ave for their proposed slope/
trailway project. In addition,this site is a general mess and we have required clean up.

Temporary Administrative Permit—City of Oak Park Heights
Leonard Investments LLC and OSHI PROPERTIES LLC &TJB LLC (collectively referred herein as the Owner) have requested the
installation of temporary fill—not to exceed 500 Cubic yards (CY)of clean-fill to be temporarily stored in a location as outlined in
Exhibit A to this document.Such action requires a CONDITIONAL USE PEMRIT pursuant to City Ord 308.08 for its permanent storage
and/or use.
Pending that application and possible approvals,the City will allow the temporary placement
of up to 500 cubic yards pf clean-fill to be placed on the site as shown in Exhibit A.There are w . ,,,.•, „u •r,.�R. �:•.N�

1. The Owner,by 4:00 pm on 9/7/22,shall install complete silt fencing around the entire perimeter ..°°°` "'bl•° ••'at'o^'a,"•111Ya Mil Wattle Mt ^

property in the event of rain.The City will inspect at 4:45 PM on such date for compliance.The
Deposit Area shall be fully on the Owner's properties and may only be accessed for the purposes of this permit from the asphalt drive of Fury Motors
site.
2. The Owner may not cause or seek to cause the leveling of any such piles or materials deposited at the site until a final Conditional Use Permit is
secured and issued by the City. The piles shall remain as deposited from the unloading vehicle. A complete Development Application for a
Conditional Use Permit has been supplied to the Owner.It is the Owners duty to provide complete application materials by 9/9/22 including a final
grading plan.
3. The Owner,by the 4:00 pm on 9/9/22 shall apply for a Conditional Use Permit for the proposed land spreading of this temporarily placed material.
Should the Owner not apply for or should Owner's application be denied,the Owner at their sole expense shall remove all deposed fill from the site
and remove same from the City within 30 days of such written demand of the City regardless of weather conditions.
4. The Owner is hereby noticed that they may require a BCWD permit for such activities and they are to contact them immediately.
5. By issuance of this Temporary Administrative Permit, the City is not waiving its authority or rights to enforce any related Ordinances, Rules or
Policies that may also govern or have jurisdiction upon these areas.The City may revoke this Permit at any time and for any reason, upon which
Owner shall immediately remove all installations including such fill and fully restore the areas to previous conditions—in the City's opinion-at
Owner's expense.Should Owner fail to comply with the required terms and conditions of this Permit,the City may seek all remedies allowed under
law,and all such enforcement actions,including but not limited to administrative,legal,corrective and engineering costs to compel enforcement or
actions and shall be fully recoverable by the City from Owner—including by special assessment upon such properties to complete such work.The
Owner hereby waives all special assessment requirements as may be found in Minnesota Statute.
6. The Owner,by 9/7/22 shall provide a$5,000 escrow that shall be refundable,minus any out-of-pocket inspection costs the City deems reasonable
to ensure compliance with the provisions of the Permit.Additional fees,deposits and escrows will be required as part of the Conditional Use Permit
process.
