CITY OF OAK PARK HEIGHTS TO RECOGNIZE
NATIONAL LAW ENFORCEMENT WEEK AND
LAW ENFORCEMENT MEMORIAL DAY
WHEREAS, established by a joint resolution of Congress in 1962 to pay special recognition to
law enforcement officers and the vital contribution they make in public safety; and,
WHEREAS, by the enforcement of our laws, these same officers have given our country internal
freedom from fear of the violence and civil disorder that is presently affecting other nations; and,
WHEREAS, these officers have safeguarded the lives and property of their fellow Americans; and,
WHEREAS, this week is dedicated to honoring law enforcement officers for their service and
sacrifices; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of Oak Park Heights
hereby proclaim May 12, 2024, through May 18, 2024, as Law Enforcement Week, and May 15,
2024, as Law Enforcement Memorial Day.
Approved and adopted this 14" day of May, 2024 by the City Council for the City of Oak

to recycle and to increase fire prevention awareness, the City rewards two
residents each month with their choice of an award of a fire extinguisher
and/or smoke detector.

TUESDAY, APRIL 23, 2024
Present: Mayor McComber, Councilmembers Dougherty, Johnson, Liljegren, and Runk; City
Administrator Rife, Assistant City Administrator Pinski, Police Chief Hansen, Public Works
Director Kegley, and City Engineer Mann. City Attorney Sandstrom arrived at the end of the
meeting. Absent: None.
1. Call to Order: Mayor McComber called the meeting to order at 5:00 p.m.
2. PFAS Update: Public Works Director Kegley provided an update. Councilmember
Johnson suggested staff contact the City of Stillwater to inquire about what types of
questions they were receiving from the public regarding PFAS. Councilmember Liljegren
suggested the City Newsletter article provide a visualization of what one part per trillion
looked like. City Engineer Mann described it as one drop of water in an Olympic sized
swimming pool that was 4,000 feet deep.
No action was taken.
3. Snow Plowing Contract: Public Works Director Kegley asked for direction for the next
snow season. The City Council directed staff to renegotiate a contract with
Raleigh/Miller.
No action was taken.
4. Cover Park Slope: Public Works Director Kegley reported staff was seeking to plant
grass instead of a prairie on the slope in order to reduce maintenance and avoid the need
for a periodic burn. He said staff would also replace the fence and smooth the slope to
make it easier to mow. Council was amenable.
No action was taken.
5. Finance Director Compensation: The City Council would add an item on the Council
Agenda for that evening to authorize the City Administrator to make an offer for the
position.
No action taken.
6. 58" Street: Councilmember Liljegren suggested the Council look into lowering the
speed limit on 58th Street to 35 miles per hour. City Engineer Mann said the Council
would need to pass a Resolution asking the state to review it. It was noted that a speed
limit study could end up resulting in an increase in the speed limit. Liljegren reported
how difficult it was to exit his neighborhood onto 58th Street. Mayor McComber asked if

it may be feasible to have a stoplight installed at Norell Avenue. City Engineer Mann
suggested installing a sign noting intersection ahead.
No action taken.
7. Front Counter Glass/Security: Assistant City Administrator Pinski asked for direction
on security upgrades the City should consider. The Council recommended full bullet
proof glass with a smaller opening for conducting transactions. Mayor McComber
reported there was money in the City Hall Building Fund. Pinski said staff would obtain
quotes and come back to the City Council.
No action taken.
8. City Hall Copy Machine: Assistant City Administrator Pinski reported that the current
copy machine at City Hall was nearing its end of life and parts were no longer being
made for it. She provided quotes and reported she would be asking for municipal
references and product demos. She would come back to the City Council for
authorization to purchase.
No action taken.
9. City Hall Technology Upgrades: Assistant City Administrator Pinski reported the City
received an additional quote that staff would review, and staff would come back to the
City Council for authorization to proceed.
No action taken.
10. Osgood Avenue City -Owned Property: Mayor McComber was seeking input from the
Council on whether the City should sell the property it owned at Osgood Avenue. The
Council directed City Administrator Rife to speak with Jim Leonard, the owner of the
adjacent lot, to determine his plans.
No action taken.

called the meeting to order at 6:05 p.m. Present: Councilmembers Dougherty,
Johnson, Liljegren, and Runk. Staff present: City Administrator Rife, Police Chief
Hansen, Assistant City Administrator/City Clerk Pinski, Finance Director Caruso,
City Engineer Mann, and City Attorney Sandstrom. Absent: None.
Mayor McComber added "Authorize City Administrator to Offer Finance
Director Position" to the Consent Agenda as Item K.
Councilmember Dougherty, seconded by Councilmember Johnson, moved to
approve the Agenda as amended. Carried 5-0.
II. Council/Staff Reports:
A. Mayor McComber: She reported she met with representatives from Xcel
Energy the previous week and they would have more information in 2026
regarding the closure and remediation; she attended the ETAC meeting on
April 23 where she was elected co-chair; there would be upcoming
Minnesota Governor's Association meetings and hearings on the
Integrated Resources Plan which she would provide the dates for; and the
City was awarded the Tree City USA Award.
B. Councilmember Dougherty: He reported he participated in police officer
interviews.
C. Councilmember Johnson: She reported she attended the Middle St. Croix
Watershed Management Organization meeting.
D. Councilmember Liljegren: No report.
E. Councilmember Runk: He reported he also participated in the police
officer interviews.
F. Staff: City Administrator Rife reported he attended the open house on the
Washington County Emergency Housing Services Building, and staff was
drafting a letter to the City of Stillwater.
Police Chief Hansen reported three candidates were going into the
backgrounding phase for the police officer position; the SRO was being
recognized at the School Board that evening; and the Police Department
would be participating in Career Day that Thursday.
Assistant City Administrator/City Clerk Pinski reported that Ryan and
Angela Young at 5510 O'Brien Avenue North were chosen as the

recycling award winners. She also reported clean up day was scheduled
for May 18.
III. Visitors/Public Comment:
A. 2023 Audit Review Presentation: Rebecca Petersen from Redpath and

statements, no internal controls findings, and no items of noncompliance.

AGENDA ITEM: Authorize Permit for Special Olympics at Stillwater Area High School
BACKGROUND:
The City received an application from Stillwater Area Independent School District #834 and Special
Olympics Minnesota for a multi -day event at the Stillwater Area High School. This is the third year
that this event has occurred in the City of Oak Park Heights. Staff reviewed the application and has
drafted a Permit with similar language as in the past two years. Staff is recommending approval of
the Permit subject to final review and any edits.
FINANCIAL IMPACT:

Authorize Permit for Special Olympics Event at Stillwater Area High School subject to final staff
review and edits and submittal of escrow and Certificate of Insurance.

SPECIAL EVENT PERMIT
TERMS AND CONDITIONS
THIS PERMIT is made this day of , 2024 between the City of Oak Park
Heights, Washington County, Minnesota ("City") and Stillwater Area Independent School District
#834 ("ISD834") for Special Olympics Minnesota ("Event").
RECITALS
Event.
The City hereby authorizes ISD834 to organize and conduct a SPECIAL EVENT on June 21-23,
2024, being the Special Olympics at the Stillwater Area High School. The application, site plan,
and general scope of the Event are attached as Exhibit A.
City Costs.
ISD834 is responsible to ensure that the City is reimbursed for all costs incurred by the City that
may result due to the Event including, but not limited to: City Police Department, Public Works
Department, and Fire Department, and as needed to safely respond to such Event if needed.
City Police.
It is acknowledged that any City Police staff assigned during the Event are at the Event as a general
law enforcement presence. The number of City Police Officers, times and their exact roles remains
in the sole discretion of the Chief of Police. The City Police are not responsible for general security
at the Event.
Escrow for Citv Costs.
Prior to the Event, ISD834 shall provide the City with a cash deposit of $2,500, with such amount
serving as security escrow to the City. Said security escrow shall be reimbursed to ISD834 at such
time ISD834 pays to the City all costs incurred, including Police Staff costs, if any for the Event.
The City shall invoice ISD834 within sixty (60) days of the Event for all City costs incurred.
Emergency Plan.
An emergency plan that addresses issues related to injury, evacuation, communication, and other
relatable emergency protocols for the Event, applicable to all spectators, participants, coaches, and
staff, was provided with the application and included in Exhibit A. The emergency plan has
identified the individual who is responsible for issuing public communications at the Event to
provide warning and secure the safety of all persons should inclement and/or dangerous weather
occur. This role is critical and is not the responsibility of the City. ISD834 shall ensure they are
capable of effectively communicating such emergency protocols to all persons at the Event.
Insurance, Hold Harmless, and Indemnity.
ISD834 agrees to and shall indemnify, release, and hold harmless the City with regard to any
claims, causes of action or demands that are brought against the City, arising of the Event
authorized by this Permit. ISD834 shall also indemnify and hold harmless the City with regard to

any claims, causes of action or demands that may be brought against the City from any participants
or attendees of the Event. ISD834 shall provide the City proof of liability insurance in an amount
not less than $1,000,000, with such document listing the City as an additionally insured. This
document shall be supplied to the City not later than June 11, 2024, and shall be attached hereto
as Exhibit B.
City Commitments.
The City has not committed any specific resources to benefit or assist in this Event. ISD834 takes
and assumes full responsibility for any and all site operations.

2024 SOMN Summer Games
Description
Summer Games is Special Olympics Minnesota (SOMN)'s most attended singular sporting
competition of the year. SOMN is hosting both basketball and track and field at Stillwater Area
High School. Participants will be athletes (folks with intellectual disabilities), Unified Partners
(folks without intellectual disabilities), and coaches. Additionally, participants will bring
family/friends along to support/cheer at the competitions. Aside from the competition, we will
have many vendors, health screenings, fun activities, and sponsor tents set up in the entryway
area to the track, which we call "Athlete Village". This provides a full couple of days to all
participants, and lots of fun things to do and see!
Date of the Event
Friday, June 21 -Sunday, June 23
Time of the Event
Set up during the week: Monday -Wednesday a staff member will be onsite outdoors with
Ultimate Events getting tents in the outdoor "athlete village" set up. On Thursday during the
day (-9am-5pm), various staff members will be outdoors, completing set up of the athlete
village and setting up the track & field area. On Friday morning (-7am), staff and volunteers
will arrive to set up what is needed indoors, and complete setting up outdoor things if there is
any remaining set up.
Event itself: Friday afternoon, at approximately 12:30pm, competitions for both basketball and
track & field will begin, running until approximately 5pm that evening. On Saturday, staff and
volunteers will arrive at approximately 6:30/7am, with competitions beginning at about gam
and running until about 4pm. This will mirror the schedule for Sunday as well, with staff and
volunteers cleaning up following the event on Sunday. We anticipate completing tear down by
Bpm on Sunday evening, with Ultimate Events coming to break down their tents the week of
June 24.
High Level Plan
The event will have two EMTs from Save A Life onsite. One EMT will be stationed indoors for
basketball, and one will be stationed outdoors in a medical tent for track and field. All staff
(approximately 35) will have direction on who to call if they see a medical issue, and will have a
radio to get directly in touch with EMT services. Staff will be wearing red event management
shirts, as to be easily identifiable for any emergency needs. Staff and medical are prepared to
call 911 with cell phones in case ambulance is needed.

at 8 vendors and recommend the Stalker Street Dynamics SAM trailer. This radar trailer comes in
under budget and will meet our needs.

BACKGROUND:
An independent audit of the police department's body worn camera system was conducted on
December 15, 2023 with the final report completed May 2, 2024. The audit was completed by
Lynn Lembcke Consulting and this independent audit is required every two years per MN State
Law. Additionally, this audit report will be forwarded to the MN Legislative Commission on Data
Practices Privacy along with the chairs and ranking minority members of the committees of the
house of representatives and the senate with jurisdiction.
The audit was positive with the exception of one discrepancy noted in the area of department
policy missing an updated section that was approved by legislation August 1st 2023, under
minimum requirements MN Statute 626. 8473.Subd 3. That BWC policy was quickly updated and
complete as of Jan 1st 2024.

Dear Chief Hansen:
An independent audit of the Oak Park Heights Police Department's Portable Recording System (body -
worn cameras (BWCs)) was conducted on December 15, 2023. The objective of the audit was to
verify Oak Park Heights Police Department's compliance with Minnesota Statutes §§13.825 and
626.8473.

The Oak Park Heights Police Department is located in Washington County, Minnesota and employs
eleven (11) peace officers. The Oak Park Heights Police Department utilizes Motorola WatchGuard
BWCs and Evidence Library software. BWC data is stored on a local file server. The audit covers the
time period December 16, 2021, through November 30, 2023.
Audit Requirement: Data Classification
Determine if the data collected by BWCs are appropriately classified.
Oak Park Heights Police Department BWC data is presumptively private. During the audit period, the
Oak Heights Police Department collected both public and private or nonpublic BWC data. Publicly
classified BWC data captured the discharge of a firearm and use of force that resulted in substantial
bodily harm by another law enforcement agency. The Oak Heights Police Department had no requests
from data subjects for the data to be made accessible to the public or court orders directing the agency
to release the BWC data to the public.

Audit Requirement: Retention of Data
Determine that the data collected by BWC's are appropriately retained and destroyed in accordance
with statutes.
The Oak Park Heights Police Department utilizes the General Records Retention Schedule for
Minnesota Cities and agency specified retention periods in WatchGuard. At the conclusion of a BWC
recording, a WatchGuard category type is assigned. Each WatchGuard category type has an associated
retention period. Upon reaching the retention date, data is systematically deleted.
Event log reports of all BWC data collected and deleted during the audit period were produced.
Randomly selected records from the purged event log report were reviewed and the date the data was
collected was verified against the delete date. Each of the records were deleted in accordance with the
record retention schedule. All BWC data was retained for at least the minimum ninety (90) days
required by statute.
Active BWC data and audit logs are accessible in the WatchGuard Evidence Library. The server log
maintains a listing of active and deleted BWC data.
The Oak Park Heights Police Department has received no requests from data subjects to retain BWC
data beyond the applicable retention period.
No discrepancies noted.
Audit Requirement: Access by Data Subjects
Determine if individuals who are the subject of collected data have access to the data, and if the data
subject requests a copy of the data, other individuals who do not consent to its release must be
redacted.
BWC data is available to data subjects and access may be requested by submission of an Oak Park
Heights Police Department Information Disclosure Request form. During the audit period, the Oak
Park Heights Police Department had received no requests to view BWC data but did receive and fulfill
requests for copies of BWC video from data subjects. Data subjects who had not consented to the
release of data were redacted. Data requests are documented on an Excel spreadsheet, and Information
Disclosure Request forms are maintained in a file.
No discrepancies noted.
Audit Requirement: Inventory of Portable Recording System Technology
Determine the total number of recording devices owned and maintained by the agency; a daily
record of the total number of recording devices actually deployed and used by officers, the policies
and procedures for use ofportable recording systems by required by section 626.8473; and the total
amount of recorded audio and video collected by the portable recording system and maintained by the
agency, the agency's retention schedule for the data, the agency's procedures

for destruction of the data, and that the data are available to the public.
Oak Park Heights Police Department's BWC inventory consists of eleven (11) devices. Device
inventory is maintained in the WatchGuard Evidence Library.
The Oak Park Heights Police Department has established and enforces a BWC policy that governs the
use of portable recording systems by peace officers while in the performance of their duties. The Oak
Park Heights Police Department's BWC policy requires officers to conduct a function test at the
beginning of each shift and to promptly report any malfunctions to their supervisor. Peace officers
were trained on the use of the BWC system and policies and procedures during implementation. New
officers are trained as part of their field training program.
Officers working on randomly selected dates, and randomly selected calls for service, were compared
to the event log reports and confirmed that BWCs are being deployed and used by officers. The event
log reports provide a daily record of the total number of recording devices activated by officers. A
review of BWC data collected per quarter shows a consistent and increase in the collection of data.
The total amount of active data is accessible in the WatchGuard Evidence Library. The total amount
of active and deleted data is available in server log reports.
The Oak Park Heights Police Department utilizes the General Records Retention Schedule for
Minnesota Cities and agency specified retention in WatchGuard. BWC video is fully deleted from the
local file server when deleted. Meta data information is maintained on the server. BWC data is
available upon request, and access may be requested by submission of an Information Disclosure
Request form.
No discrepancies noted.
Audit Requirement: Use of Agency -Issued Portable Recording Systems
Determine ifpeace officers are only allowed to use portable recording systems issued and maintained
by the officer's agency.
The Oak Park Heights Police Department's BWC policy states officers may use only department -
issued BWCs while engaged in the performance of official duties.
No discrepancies noted.
Audit Requirement: Authorization to Access Data
Determine ifthe agency complies with sections 13.05, Subd. 5, and 13.055 in the operation ofportable
recording systems and in maintaining portable recording system data.
Sergeants conduct reviews of BWC videos to ensure that BWC data is properly labeled and that BWCs
are being utilized in compliance with policy.
Nonpublic BWC data is only available to persons whose work assignment reasonably requires access
to the data. User access to BWC data is managed by the assignment of group roles and permissions in

WatchGuard. Permissions are based on staff work assignments. Permissions are administered by the
Chief of Police. Access to WatchGuard Evidence Library is password protected.
The BWC policy governs access to BWC data. Agency personnel are authorized to access and view
BWC data only when there is a business need for doing so for legitimate law enforcement or data
administration purposes. The Oak Park Heights Police Department's BWC policy requires officers to
document their reason for accessing BWC data within Evidence Library. Agency personnel are
prohibited from accessing BWC data for nonbusiness reasons or from sharing or disseminating data for
non -law enforcement purposes. Access to data is captured in the audit trail. The BWC policy states
that the unauthorized access to or disclosure of BWC data may constitute and subject individuals to
disciplinary action and criminal penalties pursuant to Minn. Stat. § 13.09.
When BWC data is deleted from WatchGuard, its contents cannot be determined. The Oak Park
Heights Police Department has had no security breaches. A BCA CJIS security audit was conducted in
June of 2023.
No discrepancies noted.
Audit Requirement: Sharing Among Agencies
Determine ifnon public BWC data is shared with other law enforcement agencies, government
entities, or federal agencies.
The Oak Park Heights Police Department's BWC policy allows for the sharing of BWC data with
other law enforcement agencies for legitimate law enforcement purposes only and for the sharing
BWC data with prosecutors, courts, and other criminal justices entities as provided by law.
The Oak Park Heights Police Department requires written requests from law enforcement seeking
access to BWC data. Sharing of data is documented in an Excel spreadsheet and copies of requests are
maintained in a request folder.
No discrepancies noted.
Audit Requirement: Biennial Audit
Determine if the agency maintains records showing the date and time the portable recording system
data were collected, the applicable classification of the data, how the data are used, and whether data
are destroyed as required.
The WatchGuard Evidence Library and the server Active and Purged Event Reports document the date
and time portable recording system data was collected and deleted. Both public and private or
nonpublic BWC data were collected during the audit period. The WatchGuard audit trail and an Excel
spreadsheet document how the data are used and shared.

Oak Park Heights Police Department's BWC data is stored on a local file server. The server is located
in a secure area with limited access. The server is password protected. Access to the server is managed
by the Chief of Police.

Audit Requirement: Public Comment
Determine if the law enforcement agency provided an opportunity for public comment before it
purchased or implemented a portable recording system and if the governing body with jurisdiction
over the budget of the law enforcement agency provided an opportunity for public comment at a
regularly scheduled meeting.
The Oak Park Heights City Council approved the purchase of body -worn cameras their September 22,
2015, council meeting. The BWC system was purchased and implemented prior to the requirement of
Minn. Statute § 626.8473, Subd. 2.
No discrepancies noted.
Audit Requirement: Body -worn Camera Policy
Determine if a written policy governing the use of portable recording systems has been established and
is enforced.
The Oak Park Heights Police Department's BWC policy is posted on the agency's website. The policy
was compared to the requirements of Minn. Stat. § 626.8473, Subd. 3 (b) and included all of the
minimum requirements of Minn. Stat. § 626.8473, Subd. 3 (b) (8) that were in effect prior to August 1,
2023. The policy was updated on January 1, 2024, to include the additional minimum requirements.

BACKGROUND:
In September 2023, the Finance Director Search Committee was formed which consisted of Mayor
McComber, Councilmember Runk and certain City staff members. The committee was charged
with finding a replacement for the now retired Finance Director Betty Caruso. In September, the
City issued a job ad to solicit candidates to apply for the Finance Director position. After
advertising for the position, the City received very few applications. The City reposted the position
and directly encouraged interested individuals to apply. Ultimately, the City interviewed three
candidates for the position.
After completing interviews, the Finance Director Search Committee recommends hiring Alison
Egger to serve as the City's Finance Director. Ms. Egger currently serves as the Finance Director
for the City of Hudson, WI. Ms. Egger previously served as Stillwater's Assistant Finance Director
and obtained her Bachelor's degree in Accounting from the University of Minnesota — Twin Cities.
Ms. Egger's salary will be $125,063 which is within the wage schedule for the MNPEA union
contract. Upon approval by the City Council, we will coordinate with Ms. Egger on a start date.

BACKGROUND:
As the Council is aware, the City is preparing to drill on new well (Well #3) along with constructing
an associated pump facility. Well #3 will allow the City to achieve firm capacity and ensure we
continue to meet the water demands of our community. City Staff have been working in the
background to meet the requirements of the Economic Development Administration (EDA) as this
project was awarded an approximately $1.5M grant from the EDA.
In working with the EDA, the City has finalized the Well #3 plans and we are prepared to submit
the plans to the EDA for review. Upon the EDA's approval of the plans, the City will seek bids for
the project. Once bids are received, a recommendation will be made to the City Council. Based on
feedback from well drilling contractors, we expect this project will start in 2025.

The television screens in the Council Chambers and conference rooms at City Hall are
approximately fourteen years old and are not adequately sized to allow for the Council members,
staff and the audience to easily see content being displayed. After receiving direction from the City
Council at their March 12, 2024 Worksession, staff obtained multiple quotes from audio/video firms
for upgrades. Staff reviewed the proposals and is recommending the City move forward with
Provision. The proposal includes display screens at each of the dais seats as well as three large
screen TVs to replace the current TVs in the Council Chambers, a TV with wireless capabilities in
the adjacent conference room, and a TV with videoconferencing capabilities in the rear conference
room. The proposal also includes all cabling, design, installation and system testing.
