(Applicant) on behalf of Hall Properties, LLC, the owner, has submitted an application for an Amended Conditional Use PermlUPlanned Unit Development and Design Guideline/Site Plan Review for 13341 60th Street North. The Applicant has requested a fourth wall sign and the construction of a tire storage building. The Conditional Use Permit (CUP) was approved for Discount Tire in May of 2004. The new tire storage building is a 28 square foot x 28 square foot building to be constructed to the east of the Discount Storage building in the parking lot. Ten parking stalls will be removed as part of the construction. The building is to be constructed with CMU and EFS trim to match the primary structure. The building will have a metal roof. The signs on the building are being changed out and one added with the new corporate logo. E*-II*V-111T1> Comprehensive Pian. The property is designated as Commercial on the Proposed Land Use Map. The continued use of the site for retail and service commercial use is consistent with the Comprehensive Plan. Zoning. The property is zoned B-2 General Business District. The Shoppes of Oak Park Heights development, which includes the Discount Tire, was approved as a PUD in 2004 to allow multiple commercial buildings within the development with shared access and parking. The PUD is an overlay of the B-2 District. The approval of Discount Tire in 2004 allowed for three wall signs. At the time, only two were allowed per freestanding business. A CUP/PUD is required for the addition of the tire storage building. An amended CUP is required to allow the fourth wall sign. Signage. The four wall signs proposed are all 60 square feet for a total of 240 square feet. The ordinance allows for a total of 200 square feet of wall signage. The request for the fourth sign will also include the allowance for the additional 40 square feet of signage. The signs are to be back lit. Setbacks. The tire storage building meets all accessory building setback requirements. Traffic Circulation. Traffic circulation within the site will not be impacted by this site change and the addition of the building. Parking. Ten parking stalls are being removed that makes the site more in conformance with the new parking standards. Lighting. The pians do not show any additional lighting being added as part of the tire storage building. If fixtures are added, lighting shall be full cut off and shall be consistent with Section 401.15.13.7 of the Zoning Ordinance as it relates to lighting requirements. 0 Trees/Landscaping. The City Arborist has provided a report addressing the tree removal and replacement. The final landscape plan is subject to the review and approval of the City Arborist. Grading, Drainage, Erosion Control and Utilities. No grading, drainage and utility plans were required for this project. Design Guidelines. The proposed structure and site changes are consistent with the Design Guidelines. The accessory building will match the existing Discount Tire building in materials and colors. Building Height. The building height maximum for accessory buildings is 20 feet. The proposed building is 11 feet. Section 401.03.A.7 City Council and Planning Commission Considerations. The Planning Commission and City Council should also consider the conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, as follows: 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. . The conformity with present and future land uses in the area. . The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. S. The demonstrated need for such use. 7. Trac generation by the use in relation to capabilities of streets serving the property. 8. The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. 9. The proposed use's conformity with all performance standards contained herein (i.e... parking, loading, noise, etc.). Comment: The Planning Commission and City Council should review the above criteria regarding the request for the Conditional Use Permit. The storage building and sign changes will not have an adverse impact on the surrounding area or neighbors. The City Arborist has provided a review of the tree replacement to improve the appearance of the site. City Staff has no issues with the request as proposed and would recommend with conditions. CONCLUSION I RECOMMENDATION Subject to the preceding review, City staff recommends approval of the Amended Conditional Use Permit/Planned Unit Development and Design Guideline/Site Plan Review for 13341 60th Street North for the following and subject to the conditions that follow: 3 Amended Conditional Use PermittPlanned Unit Development for the tire storage building. The following includes my comments and/or recommendations: Preliminary Site Plant (Sheet Number 5100) The overall landscaping plan items submitted with this plan set was very minor. Additional plan information must be submitted as noted in each section below. The plan includes removal of (g) two large existing spruce trees and planting of (2) two Velvet Pillar Crabapple trees. Landscape Details (Sheet 1-4.0) P i ►1 The landscape notes and planting detail was not submitted. Please include the following items on the final plans: 1. All trees must be landscape grade trees of good form and structure not Park Grade trees. Trees with poor form Will be more prone to storm damage and failure in the future. Pleas: include this In the planting notes. 2. The trees included in the plan are hardy under local growing conditions, tolerant and/or fairly resistant to major insect and disease problems and fairly low maintenance. All plant sizes, root and container classes included in the plan roust conform to the City of Bak Park Heights zoning ordinance requirements. 3. i would recommend substituting the Velvet Pillar Crabapple trees with a variety that has an excellent resistance to apple scab. Some suggested varieties include Royal Raindrops or Prairifire Crabapple. Please see Photo #3 of the existing site conditions for the island where these trees are proposed to be planted. 4. Burlap, wire and all rope must be removed from the top 12'of the root ball on all trees. S. All trees must be straight and not heed staking after planting. Contractor shall stake trees only if the tree(s) begin to lean within the guarantee period, please include this in the final planting notes. 6. The landscape contractor is requi:ped to plant trees and shrubs according to the approved planting detail diagrams and landscape noes submitied with the final apprtwed landscaps plan. This will be checked after planting and any deviations from the plans must be corrected before the landscaping will be approved by the City., this needs to be noted in the final plans. 7. Planting detail diagrams and notes must be included on the plan sheet(s) for: -Deciduous Trees -Evergreen Trees -Shrubs -Perennials -Maintenance Strip (Sod edge, seeding, landscape edging, mulch) 6. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Worker's License for 2023 from the City of Oak Park Heights Building Department. All required documents must be submitted with the application. 9. The City Arborist will conduct an Initial Landscape Inspection after all plantsitrees, mulch, ect. have been installed. 10. The City Arborist will conduct a Final Landscape Inspection typically (1) year after installation, at the end of the plant guarantee period. For Final Acceptance of the landscaping portion of the project the specified planting procedures must have been followed and all plants must be alive and in good condition at the end of the plant guarantee period. Tree Protection and Removal Pian (Sheet L1.0) A Tree Protection and Removal Plan was not submitted. Please include the following items on the final plans: 1. A tree inventory of all the significant trees currently located on the site must be submitted. 2. Please see the attached photo (Photo #2) of the (2) two large spruce trees that are planned to be removed. . 1 recommend also removing the spruce tree in poor condition. Please see Photo 01. 4. Contractors doing any type of tree work must secure a City of Oak Park Heights Tree Worker's License for 2023 from the City of Oak Park Heights Building Department.
