The increased housing development as well as its proximity to the St. Croix Mall has produced an increase in pedestrian traffic at this location. With these issues in mind, the City is requesting that Washington County install a pedestrian crosswalk at this location. If you have any questions, please feel free to contact me. Paris Avenue is a low speed (30 mph), low volume (2600 vehicles per day) road, which allows adequate gaps in traffic for children to cross safely. The Oak Park Heights Police have requested that school children cross at Upper 63rd Street and our recent observations confirm that the few students who do cross Paris Avenue are crossing at Upper 63rd Street. We agree that this is the best location to cross Paris Avenue because there is not a problem with sight distance for pedestrians or vehicles. We also noticed that the students had no problems crossing Paris Avenue safely. A pedestrian crossing at 63rd Street or 62nd Street is not recommended because of poor sight lines created by the curve in the road. As we stated in a previous letter to the city, since the excessive usage of signs and pavement markings can substantially reduce the effectiveness of the devices, installation should be limited to locations where significant numbers of pedestrians cross the street. Thus we will not be installing signs or markings on Paris Avenue at this time. We have discussed this issue with John Johnson, Principal of Oak Park Elementary School and will continue to work with him on school crossings that cross our county roads near Oak Park Elementary. We will monitor this area for any significant change in pedestrian traffic or vehicle traffic patterns. Please call me at 430-4330 if you have any additional questions or concerns. Oak Park School had agreed to provide a crossing guard. Councilmember Robert passed their request on to Washington County Public Works . The attached letter rejected this request . I will need quantities regarding centerline and edge striping paint. Please provide a map with your requests. If your community would like roads striped in 1998, please provide us with a written response no later than January 9, 1998. A written response is also needed if you have no striping needs. Also, we cannot guarantee striping of roads requested after January 9, 1998. Please keep in mind that some roads that have been striped begin to fade within one year, depending on the traffic flow. The CITY OF OAK PARK HEIGHTS and its employees, consultants, or agents may combine the Digital Parcel Maps Data Base with different data to create new and original electronic or hardcopy products which the CITY OF OAK PARK HEIGHTS can use. However, the CITY OF OAK PARK HEIGHTS and its employees, consultants, or agents shall not reproduce or duplicate the Digital Parcel Maps Data Base in electronic form for sale, licensing or distribution in any manner; except it may create one electronic backup copy for its own internal use. 3. The County is furnishing the Digital Parcel Maps Data Base on an "AS IS" basis, without any support whatsoever, and without representation or warranty, including but not in any manner limited to fitness, merchantability and completeness of the Digital Parcel Maps Data Base. 4. The CITY OF OAK PARK HEIGHTS agrees to hold the County and all its agents and employees harmless from and indemnify the County, its agents and employees against any and all liability, claims, damage, loss and expense arising from the utilization of this Digital Parcel Maps Data Base. 5. The Digital Parcel Maps Data Base is neither a legally recorded map or a survey and is not intended to be used as one. The Digital Parcel Maps Data Base is a compilation of records, information and data from various city, county and state offices and other sources and should be used for reference only. No representation is made that the features presented, accurately reflect true location. Washington County or any other entity from whom data was obtained assume no liability for any errors or omissions herein. She recommended not signing the resolution until that language was taken out . City Attorney Vierling said that this is not an unusual arrangement and that the City currently does this in other situations . Vierling recommended that the City approve the agreement as presented. Councilmember Turnquist, seconded by Swenson, moved to approve the resolution as presented. Carried 5-0 . Review of Letter from Washington County - Pedestrian Crosswalks on County Roads - Councilmember Robert said that she had received a request from residents about putting in a crosswalk on Paris Avenue by 62nd Street . She contacted Washington County and they subsequently decided that there was not a need for a crosswalk at that location. Police Chief Swanson said he agreed with Councilmember Robert that the area in question could use a sign because there is a curve in the street that could make it dangerous for children crossing. Council directed staff to send a letter to the Washington County Board of Commissioners and request that a sign be put on Paris Avenue near 62nd Street . Review of Larry Simonson' s Variance Request Bill - Councilmember Turnquist objected to the amount Larry Simonson was charged for a variance request which was denied. Besides the application fee, Simonson was billed almost an additional $500 from the City Planner. While Simonson claimed he was not informed that he would be billed for any work done by the City Planner, Administrator Robertson stated that he did inform Mr. Simonson that there may be additional charges for his request . City Planner Richards said that he cannot write a recommendation until he is able to look at the property and that the average variance costs between $500-$700 . He then said in Wayzata, he charges a flat rate of $300 for single family variances and that he would be willing to do this in Oak Park Heights . Councilmember Turnquist said that he would like to set up a workshop to discuss the details of this proposal . Councilmember Beaudet then asked Richards if he would be willing to accept $300 for this variance; Richards said no, but that he would talk to his boss about what might be acceptable. There was discussion about how the City should handle this and how clear the policy currently is to residents . There was also concern that this would be setting a precedent for refunds on previous variance bills . Councilmember Turnquist, seconded by Swenson, moved for the City to pay this bill with the understanding that this is not setting a precedent for future refunds . Councilmember Beaudet moved to amend the motion to have Mr. Simonson pay $300 and the City pay the rest . Without a second, the amendment died. Original motion carried 4-1, Councilmember Beaudet opposing. 1110 Page 7 - City Coun, Minutes 09/23/97 Request for Refund of Liquor Licenses - Club Tara - City Attorney Vierling indicated that the City had received a request from Club Tara for a pro-rated refund of their liquor license fee . He stated that the City has never had a liquor license revoked and that there is no policy regarding whether refunds are permitted. Vierling requested that the City develop a policy for guiding this in the future . There was discussion by the Council about differentiating between loss of license due to revocation compared to bankruptcy. There was also discussion about the costs to the City. Councilmember Robert, seconded by Beaudet, moved to not allow for a refund when a liquor license is revoked due to the costs incurred by the City in investigation fees . Carried 5-0 . Washington County' s Five Year Capital Improvement Plan (CIP) - Councilmember Robert said that after reviewing the County' s proposed CIP, she noticed that there is no mention of the Oakgreen Avenue project . She recommended that the City Engineer send a letter to Washington County making an argument why this project is important . Council was in consensus to direct City Engineer Anderlik to contact the County on this issue. Council was in consensus to appoint Councilmembers Swenson and Robert as a committee to negotiate with the County if necessary. Resignation of City Administrator Robertson - Councilmember Turnquist read a letter from Mike Robertson announcing his resignation as City Administrator effective December 23 , 1997 . Councilmember Turnquist, seconded by Swenson, moved to accept the resignation and authorize Mayor Schaaf to sign the necessary amendment to Robertson' s contract . Carried 5-0 . Councilmember Turnquist thanked Robertson for the good job he has done, acknowledging that being the first City Administrator in a city is a tough job. He also said that Robertson has handled the position with professionalism, patience, understanding, and a sense of humor. The Council wished Robertson good luck in the future . Correspondence: Letter from Menards About Garbage Prices - There was discussion about the validity of the other price proposals that Menards presented. Councilmember Swenson, as the garbage liason, agreed to find out what other Menards stores in the area pay for garbage service and report his findings back to the Council . Box 2007 Oak Park Ileights, MN 55082 2007 Re: Washington County Capitol Improvement Program Our File No. 55 Dear Mike: We have reviewed the five year Capitol Improvement Program (CIP) for Highway Projects as prepared by Washington County with the intent to possibly identify projects which may have a lower priority than providing an additional north-south corridor at Oakgreen/Greeley Avenue. It is fairly well known that Osgood Avenue or County State Aid Highway (CSAH) 24 and County Road 5 are at or near their maximum capacity. To alleviate this congestion problem,it would appear appropriate to upgrade Oakgreen Avenue in conjunction with the Highway 36 improvements which appears throughout the.C.T.P. This route has not been included for any capitol improvement because. it is not on the County system at this time. In the process of identifying various turnback roads, the County should also be encouraged to add routes which arc required to meet overall County wide traffic needs. The need for the County to assume control over and provide improvements to Oakgreen Avenue should be promoted because of roadway capacity needs in the area with funds always available through shifting of priorities. The prioritizing of projects and/or the reallocation of funding in a five year C.T.P. is difficult because the whole process is subjective. However, the following is some of our comments for review and discussion. a. There is 9.4 million dollars allocated for pavement preservation and rehabilitation over the five year period. While it can probably he debated that this amount is too little or too much, some reallocation is always possible. b. Project No. 2237 provides for the improvement of CR-61 almost solely because of pavement condition. This roadway serves very little except for the County Maintenance facility with no capacity problems and little or no safety problems. This interchange generally provides access from central Woodbury to and from 1-494 with very limited traffic using CSAH 25 and Century Avenue. One primary concern presented by the city council was the desire to add provisions for bicycle and pedestrian traffic into the County's CSAH 24 pavement preservation project. Proposed Project: The 1997 pavement preservation project will mill, cold inplace recycle and overlay the bituminous surface of CSAH 24. The existing concrete curb & gutter and raised median will not be affected by this project. This project will extend from the junction of CSAH 14 to the north mall entrance (350 feet south of the TH 36 frontage road). From CSAH 14 to Upper 56th Street, the existing ten-foot paved shoulder will be overlaid in each direction. From Upper 56th Street to TH 36, the roadway-width and striping will be replaced in kind. The northernmost portion of this section is planned for reconstruction by Mn/DOT as part of the TH 36 improvement project. • • • Deficiencies: • Currently, there are no signed nor striped bicycle facilities alongthis section of CSAH 24. Between CSAH 14 and Upper 56th Street, a wide paved shoulder exists. North of Upper 56th Street, bicyclists share the outside lanes of traffic with motorized vehicles. Between Upper 56th Street and TH 36 there are frontage roads, mall entrance roads, several driveways, and right and left-turn lanes. The roadway in this area is delineated by concrete curb and an 18-inch concrete gutter along the outside of the roadway and along the raised medians. The outside lanes in each direction are striped at a width of 14 feet from the white skip stripe to the curb face. CSAH 24 has a high accident rate when compared to other similar roads within the area. This can be partially contributed to the high traffic volumes and the large number of turning vehicles in the area. A traffic signal at TH 36 also results in queuing of vehicles and congestion within the corridor. This is a commercial area with heavy emphasis on motorized vehicles, though neighboring residential areas on both sides of TH 36 have the potential of generating bicycle and pedestrian traffic of varying degrees of experience. The conditions discussed above make it uncomfortable for both non-motorized and motorized traffic. Therefore, only experienced bicyclists tend to take this route and motorized traffic is forced to maneuver around the bicyclist. Pedestrians tend to walk outside of the curb where • no facilities exist. The existing roadway geometrics for the section north of Upper 56th Street limit the improvements that can be done within scope of the current pavement preservation project. To provide an on-road bicycle facility that would meet the needs of all levels of biking experience would require widening the roadway. This option still would not address the needs of pedestrians. Base on the "Mn/DOT State Aid Operations Rules", April 1996, Section 8820.9935. • • • As indicated above, the existing roadway is about 12 feet narrower than the desirable width, 110 and two feet narrower than the absolute minimum width. To obtain even the minimum requirements for having an on-road bike lane, would require widening the roadway. The process of widening the roadway would include the removal and replacement of concrete curb & gutter, storm sewers, and driveways. Changes to the raised median would also require changes in curb & gutter and storm sewers. As mentioned earlier, the addition of an on-road bike lane would not adequately address pedestrian traffic. Using the minimum design criteria also does not provide for snow storage or the damage done to the concrete gutter by the increased number of vehicles that would actually be driving on it. Widening the roadway would substantially increase the cost of this project and includes work outside of the normal scope of a pavement preservation project. Funds are not available for this work. The limiting factor is the face-of-curb to face-of-curb roadway width. This limitation does not permit any changes in striping that would provide an acceptable bike lane as well as acceptable lane widths. Narrowing the lane widths to less than 11 feet or providing a bike lane of less than four feet would give bicyclists a false sense of safety and would adversely affect the motorized traffic in an already high accident rate area. Restriping the roadway would also do nothing to address the large number of conflicts between bicycles and vehicles due to the turning movements. These issues should be resolved in the future project which is planned to specifically address such issues. The consideration of additional bicycle and pedestrian facilities is programmed for 1999 in the • current Washington County Capital Improvement Program (CIP). The current scope includes project construction of an off-road trail. The 1999 project will require additional right-of-way and City financial participation. STAT. § 162.02 subd. 10 to abandon, change, or revoke jurisdiction over the delineated portions of CSAH 21 and CSAH 23. a) If the commissioner does not approve the County's request for abandonment of CSAH 21 or CSAH 23 or if the County does not adopt a resolution requesting abandonment, change or revocation of all the Roads, this Agreement shall become null and void. 2. In lieu of any statutory or rule requirement of the County to maintain abandoned or revoked roads, including but not limited to MINN. STAT. § 163.11 subd. 5.b. the County shall complete S.A.P. 82-621-23 and S.A.P. 82-623-04. 3. The County will fund 100% of the costs for S.A.P. 82-621-23 and S.A.P. 82-623-04. 4. At no further consideration to the City, the County shall transfer to the City all public road rights of way and road easements it currently holds or may acquire in the future. 5. After jurisdictional transfer is accomplished, the City shall continue to own and be solely responsible for the maintenance of all utilities and facilities located within the public Roads right of way and Roads easements, including, but not limited to, sanitary sewer, water main, and appurtenances and sidewalks. 6. After jurisdictional transfer is accomplished, the City shall own and be solely responsible for the maintenance of all storm water systems and culverts located within or adjacent to the Roads right of way. 2 • • 7. The County shall transfer to the City all construction and maintenance records of the Roads within 180 calendar days after jurisdictional transfer has been completed. 8. Pursuant to MINN. STAT. § 162.02 subd. 10 and Minn. Rules promulgated thereto, the City agrees to provide by resolution the approval requisite for County State Aid Highway designation removal from Stagecoach Trail, 59th Street North, Beach Road, and 65th Street North within the City's boundaries. 9. The County shall use its best efforts to effectuate jurisdiction over the Road by 12:01 a.m., January 1st in the year following completion of work in condition 2. 10. The County agrees to provide maintenance on the Roads until 12:01 a.m. on May 1st in the year following completion of the work in condition 2. 11. The parties agree that paragraph 1, 2, and 8 of this Agreement are conditions precedent to the formation of the contract and failure of any of these conditions shall render the whole Agreement null and void. The parties further agree that all other provisions of the Agreement are conditions subsequent and the failure of one party to fulfill its obligations under any of these provisions shall entitle the other party to maintain any action in law or equity to enforce those provisions of the Agreement. 3 • S This Agreement sets forth the entire agreement between the parties hereto with respect to the subject matter hereof and fully supersedes any and all prior agreements or understandings between the parties and no change in, modification of, or addition, amendment or supplement to this Agreement shall be valid unless set forth in writing and signed and dated by each party hereto. When will Osgood Ave. be repaved in 1997? The Washington County 1997 Pavement Preservation program includes approximately 13 miles of roadway in various communities. We are planning to select a contractor in late March of this year. The County will work with the contractor to coordinate when the work will be performed on each roadway. We are anticipating that the work on Osgood Avenue will be done between May 15th and July 1st. 2. How long (days/hours) will that take? The plans include cold-inplace recycling of the existing pavement and a bituminous overlay on Osgood Avenue from 59th St./Mall Entrance south to 47th St. (CSAH 14). The work will take approximately one month to complete, but during that time there will not be any construction activity for about two weeks. The cold-inplace recycling procedure involves using a special milling machine that will grind off the top 2 inches of the existing road. The machine then pulverizes all of the remaining pavement, adds oil, and then places the mixture back down. The surface can be driven on immediately. This will take 3 to 5 days. The material must cure for approximately two weeks, during which time there will be no construction activity. Placing the new asphalt surface on the cured material will take another 2 to 3 days. After all of the paving in done, joints are sawed into the new pavement and filled with joint sealing material to control thermal cracking, which takes an additional 2 to 3 days. 3. Will you do the corner at the RR Tracks? Several projects are planned for this year, in addition to the Osgood Ave. project. Last year an overlay was done on 40th St. (CSAH 14) between Manning Ave. and Omaha Ave. in Baytown Township. This year a safety improvement project is planned for the curve between Omaha Avenue and 47th St., and an overlay planned for 47th St. The work will be done between April 15th and July 1st. (See the attached Project Location Map and Project Descriptions.) The County is working with the Union Pacific Railroad Company to replace the crossings on Osgood Ave., 40th St., Manning Ave. and Lake Elmo Ave. This work will be done by the railroad, and the schedule is not yet known. The County is working with Mn/DOT on a design for the intersection of 47th St. and Osgood Avenue for an all way stop, which may be constructed concurrently with the curve project. (See the attached layout.) • • 4. When was Osgood Ave. last paved? Osgood Avenue was reconstructed between 47th St. and 56th St. in 1980, and from 56th St. to TH 36 in 1972. No major work has been done since that time. 5. Can you put a 3' stripe bike lane down each side? The Mn/DOT Bikeways Manual recommends for a 4-lane urban section (35 mph/ 10,000 ADT) a bike lane 5 to 6 feet in width, not including the gutter. The recommended rural section (45 mph/ +5000 ADT) is an 8 foot wide shoulder. (See the attached information from the Mn/DOT Bikeways Manual.) In the segment between 47th St. and Upper 56th St. the road varies between a rural and an urban section. There is a 10' shoulder in the rural and urban sections. The edge stripe serves as a divider between the vehicle traffic and bikes/pedestrians/others. From just north of Upper 56th St. to TH 36, there are four traffic lanes. The outside lanes are 14 feet wide to the face of curb, which does provide room for striping a separate bike lane in accordance with the Mn/DOT 6. Describe future reconstruction plans. There are no reconstruction projects identified for this section of CSAH 24 in the current Capital Improvement Program. Construction of a pedestrian trail is included as a 1999 project and will be coordinated with the City. Pavement rehabilitation is planned for 1999 on the section of Osgood Avenue north of TH 36. This project will be coordinated with any TH 36 improvements. ADDITIONAL QUESTIONS Will Osgood Ave. be closed at any time? Osgood Avenue between TH 36 and 47th St. will not be closed to through traffic, but traffic delays are likely. One lane may be closed with flaggers directing traffic during the time the milling, paving, and joint sawing/sealing is done. Other County projects will have detours, which will be signed. (See the Project Location Map and Project Descriptions). What is the status of the Osgood Avenue speed study? Mn/DOT performs speed studies in the order in which they are requested, and the earliest that the study on Osgood Avenue would be done is May-June. The group held another two meetings during the months that followed. Meeting participants included public works personnel and City Administrators representing ten communities. One of the discussion items that surfaced repeatedly during these meetings was the need to know what type of equipment is owned by and would be available for use from other communities. While many communities currently participate in equipment sharing with neighboring communities, few do so with non-adjoining cities or townships. This despite the fact that many of the equipment needs identified by public works departments are currently available from communities within Washington County. As a result of these discussions,this Public Works Equipment Directory was compiled using information submitted by cities,townships and the County. The Directory is intended to be a resource for public works departments to meet both emergency and scheduled equipment needs. This Directory is not intended to supersede or replace any formal or informal sharing arrangements currently in place. Rather it is hoped that use of this document will increase the opportunities for all communities to access needed equipment and personnel. This document was created as part of the Equipment Sharing Study and funded by Washington County and the cities of Bayport, Cottage Grove,Forest Lake, Hugo, Lake Elmo,Mahtomedi, Newport, Oak Park Heights, St. Paul Park, Stillwater and Woodbury. Information included in the Directory Communities included in the Public Works Equipment Directory completed an inventory form indicating the following for each piece of equipment: (1)number owned; (2)whether the equipment will be available for use by other communities; (3)whether the equipment will be 1 available for use in emergency situations, for scheduled tasks or both; (4)whether an operator will be required to accompany and operate the equipment; (5)the percentage of time the equipment is likely to be available(refer to column headings to determine whether these percentages reflect annual or seasonal availability); (6)other specific information regarding the equipment; and(7) other requirements that must be met in order to use the equipment. In addition,respondents were asked to indicate whether they would be willing to make their vehicle maintenance facilities and equipment available in emergency situations. Only the equipment which communities are willing to share has been included. Contact people are listed for each community, including day and evening phone numbers in most cases. Listed behind each type of equipment are the communities willing to share that item. For more information about use of the equipment-- such as contact person, whether an operator is required,etc. --refer to the community's listing in Section One of the Directory. Arrangements for use of equipment or personnel(deliveryand use of equipment, compensation, liability,etc.) should be made between the communities involved. Updates and revisions The information in the Public Works Equipment Directory should be updated annually. This will allow communities to keep current on equipment available through other Washington County cities and townships. In addition,this will allow communities to reassess and update their equipment holdings and their willingness to share-- adding or deleting equipment from their availability list. Annual updates will also provide the opportunity for reassessment of the Directory and allow for changes in content or format to be made. One of the discussion items that surfaced repeatedly during these meetings was the need to know what type of equipment is owned by and would be available for use from other communities. While many communities currently participate in equipment sharing with neighboring communities, few do so with non-adjoining cities or townships. This despite the fact that many of the equipment needs identified by public works departments are currently available from communities within Washington County. As a result of these discussions, this Public Works Equipment Directory was compiled using information submitted by cities, townships and the County. The Directory is intended to be a resource for public works departments to meet both emergency and scheduled equipment needs. This Directory is not intended to supersede or replace any formal or informal sharing arrangements currently in place. Rather it is hoped that use of this document will increase the opportunities for all communities to access needed equipment and personnel. Information included in the Directory Communities included in the Public Works Equipment Directory were asked to complete an inventory form and indicate the following for each piece of equipment: (1)number owned; (2) whether the equipment will be available for use by other communities; (3)whether the equipment will be available for use in emergency situations, for scheduled tasks or both; (4) whether an operator will be required to accompany and operate the equipment; (5) the percentage of time the equipment is likely to be available (refer to column headings to determine whether these percentages reflect availability annually or seasonally); (6)other specific information regarding the equipment; and (7) other requirements that must be met in order to use the equipment. In addition,respondents were asked to indicate whether they would be willing to make their vehicle maintenance facilities and equipment available to other communities in emergency situations. How to use this Directory The information noted above is included in Section One of the Directory in an easy-to-read table format. Only the equipment which communities are willing to share has been included. Contact 1 � r people are listed for each community, including day and evening phone numbers in most cases. Fax numbers or e-mail addresses are also included for many communities. A quick reference guide is included in Section Two of this document--arranged according to equipment type. Listed behind each type of equipment are each of the communities willing to share that item. For more information about use of the equipment--including contact person, whether an operator is required,etc. --refer to the community's listing in Section One of the Directory. Arrangements for use of equipment or personnel (delivery and use of equipment,compensation, liability,etc.) should be made between the communities involved. Updates and revisions The information in the Public Works Equipment Directory should be updated annually. This will allow communities to keep current on equipment available through other Washington County cities and townships. In addition,this will allow communities to reassess and update their equipment holdings and their willingness to share--adding or deleting equipment from their availability list. Annual updates will also provide the opportunity for reassessment of the Directory and allow for changes in content or format to be made.
