Washington County Road Turnbacks
. • Enclosure A MEMO Date : September 13 , 1996 To: Mayor & Council From: Mike Robertson, City Administrator Re: Meeting with Washington County Public Works On Monday, September 9 I met with Don Theissen and Chris Thornton, of Washington County Public Works Department, Ken Hartung of Bayport, and Jeff Davis and Sue Mason of SEH Engineering. We discussed the following topics . Osgood Avenue - The County intends to do the Osgood Avenue improvement in 1999 at roughly the same time MNDOT finishes rebuilding the Osgood/Highway 36 intersection. Their reason for this timing is that MNDOT will use Osgood as a haul road for moving material to and from the reconstruct area. The County will receive some funds from MNDOT for this which they will use to defray the costs of the Osgood improvements . The County will be installing a sidewalk as part of the improvements . 56th Street Improvement (County Road 21) - This road (in front of the old prison) will be improved by the County. This improvement is intended to tie into MNDOT' s rebuilding of Highway 95 and to provide an upgraded route for truck traffic from the new Andersen Windows site. SEH was assisting with the engineering design of this project . As part of this improvement the County will be improving Stagecoach Trail just north of where it enters 56th Street to match it into 56th Street . This section of Stagecoach will be 32 feet wide with curb & gutter. There will be a stop sign at this intersection that will stop southbound traffic on Stagecoach. I told them I wanted a right turn lane installed at this intersection for southbound Stagecoach traffic . They agreed to this . 56th Street will be 44 feet wide with curb & gutter. There will be a bike/pedestrian trail on the north side which will tie into the trail that was built as part of NSP' s excavation of the old Junker site . 56th Street will have a different alignment after it is improved. Since it is currently the boundary between Oak Park Heights and Bayport, it will be necessary to agree on a new boundary. The County has agreed to plat the new 56th Street . As part of that platting process we will establish the new boundary on the centerline of the street . The County intends to hold a public forum for the neighborhood to explain the improvement and receive comments . 411 • County Road Turnbacks - As part of the improvement of 56th Street, the County would be willing to do an overlay of that part of Stagecoach Trail that they do not rebuild as an incentive for us to agree to take ownership of the road. I told Don Theissen that I would talk to the City Engineer to see whether an overlay would be acceptable or whether he would recommend that the road be rebuilt . I also told him that the City would want to sign an overall agreement governing all road turnbacks between the County and City rather than negotiate each one individually. Perro Pond North Outlet Improvement - We discussed the possibility that the Middle St . Croix Water Management Organization might want to install an outlet pipe for Perro Pond along 56th Street . We agreed that if this work was done in 1999 that it would be beneficial to work together. 411 Page 4 - City Council Minutes 08/27/96 New Business: Appointment of Election Judges - Councilmember Schaaf, seconded by Kern, moved to approve the list of election judges presented by Administrator Robertson. Carried 5-0 . Proposed Community Water Supply Plan - Councilmember Schaaf, seconded by Swenson, moved to table this item until the September 11, 1996 Council meeting. Carried 5-0 . Approval of Water Tower Washing Bid - Councilmember Swenson, seconded by Robert, moved to approve the low bid of $3 , 200 by Kangas Tank & Maintenance for washing the water tower. Carried 5-0 . Utilities Department Proposed 1997 Budget - Utilities Superintendent Benson was present to discuss the proposed 1997 budget . Council discussed with Benson his proposed replacement of City vehicles . Council was in consensus to replace the 1987 truck but to keep the auxiliary equipment for the new truck. Councilmember Schaaf, seconded by Swenson, moved to sell the existing loader and trailer and to not purchase replacements. Council discussed additional items in the proposed Utilities Department budget . Council tabled further action until a future meeting. Resolution 96-08-23 - A Resolution Granting MNDOT a Temporary Permit to Construct on City Property - Councilmember Kern, seconded by Swenson, moved to approve Resolution 96-08-23 . Carried 5-0 . Resolution 96-08-24 - A Resolution Concurring with the aesignation of Oagood Avenue as a County State Aid Highway - Councilmember Schaaf, seconded by Kern, moved to approve Resolution 96-08-24 . Carried 5-0 . Utility Easement from Sunnyside - Councilmember Schaaf described a recent meeting with the Sunnyside Board of Directors that he attended with City Engineer Anderlik to discuss a proposed utility easement . Schaaf said that the utility pipe could be jacked underneath an embankment and a parking lot so as to minimize the disruption for the residents . Councilmember Schaaf, seconded by Swenson, moved to direct staff to prepare an agreement with Sunnyside on this issue. Carried 5- 0 . Councilmember Kern Announcement - Councilmember Kern announced that he would not run for reelection when his term was up at the end of the year. 411 • Page 3 - Minutes 02/26/96 Unfinished Business: Park Survey Report - City Planner Richards reported on the Park and Trail Survey for local businesses . Richards noted that the 17% response was very good considering 10% is an average response . Richards stated that results of the survey helps the City justify its park dedication fee charged for new commercial activity. Richards noted the survey results do not help establish the appropriate ratio of cash to acreage formula for an Ordinance revision. Staff will continue to study this issue and provide a recommendation to the Council . Valley Branch Watershed - Proposed Rules and Regulations - City Attorney Vierling indicated that he has reviewed the proposal and has no problems with it . Vierling noted the City already has adopted a plan for the small portion of Oak Park Heights affected by the proposed rules and regulations . He said that the plan already adopted will meet the guidelines in the proposal . Design Review Committee - Councilmember Robert reported that the Design Review Committee had held its last meeting and that MNDOT has issued its design guide for the bridge and Highway 36 reconstruction. Mayor O'Neal praised Councilmember Robert for all of her hard work with the committee . New Business: City Attorney Memo - County Road Turn back Process - City Attorney Vierling stated that at the request of the City Council his office reviewed the applicable rules and statutes of the State of Minnesota regarding the turnback of roads between government units . Vierling stated that the City does not have to take any road that it does not want . Review of Recording Secretary - Robertson noted that the performance of Recording Secretary Eloise Nettleton had been excellent and recommended an increase in compensation to $11 . 00 per hour. Councilmember Swenson, seconded by Kern, moved to increase the compensation of Eloise Nettleton for the duties of Recording Secretary to a rate of $11 . 00 per hour. Carried 5-0 . City Administrator 1996 Contract - Mayor O'Neal reported that the Council has finished its review of City Administrator Robertson, that he has met or exceeded the Council ' s expectations in all areas, and that Council was very satisfied with his performance . Councilmember Kern, seconded by Schaaf, moved to approve the City Administrator' s 1996 contract . Carried 5-0 . In that process, we have also shared with the division of State Aid at the Minnesota Department of Transportation a copy of the diagram prepared by the County as it affects the turnback process . The actual turnback process is outlined in Minn. Stat . §162 . 02 Subd. 10 and Minn. Stat . §162 . 09 Subd. 9, copies of which I have attached. Given the foregoing, it is our impression, based upon the statute and the applicable rules of the Department of Transportation that there is no independent authority for the County to be forcibly turning back county roads to the cities without city consent . Vierling MJV/smp Enclosure • • Enclosure A MEMO Date : January 4 , 1996 To: Mayor & Council From: Mike Robertson, City Administrator Re : Meeting with Washington County Public Works Councilmember Janet Robert and I met with Washington County Public Works officials Don Theissen and Sandy Cullen. We discussed the County' s turn back proposals . We also discussed the City' s requests for Oakgreen and Osgood Avenues . Don reaffirmed the County' s position stated in their 2015 Comprehensive Plan, that the County expects to take over Greeley/Oakgreen/Northbrook and make it a County Road from County Road 12 (Myrtle Street) in Stillwater to County Road 14 in Baytown. Don said that the County would like to negotiate an agreement with us on the County Road turn back issue . He said that agreement would include pledges from Washington County for future improvements to City roads, including the County' s takeover of Oakgreen Avenue . We updated Don on approved and proposed development in the corridor between Highway 36 and 58th Street, and told him that because of the development potential we wanted the County' s takeover of Oakgreen to be on their next 5 year Capital Improvements Plan. Don said that all of these items were negotiable as part of an overall agreement which would include County Road turn backs . I told him that the Council would discuss this issue and then I would contact him. Councilmember Schaaf, seconded by Swenson, moved to table the public hearing on the request for variance for Robert and Lydia Wood until January 22, 1996 . Carried 4-0 . Request for Variance - James Bonse - 14775 Upper 55th Street North - Mayor O'Neal opened public hearing at 7 :42 p.m. James Bonse was present and requested a variance to construct a garage 208 square feet larger than allowed by City ordinance . Bonse said that the larger garage would allow him to park his trucks in his garage, therefore removing them from his driveway or the street . Hearing no further comments, Councilmember Swenson, seconded by Schaaf, moved to close the public hearing at 7 :46 p.m. Carried 4-0 . Councilmember Swenson, seconded by Schaaf, moved to approve the variance to construct a larger than allowed garage to James Bonse of 14775 Upper 55th Street for reasons of neighborhood improvement by removal of the metal pole building and the addition of a wood garage . Carried 4-0 . New Business: Stillwater Ford - Request for Rezoning and Conditional Use Permit - Establish a Public Hearing - Tom Palme, George McGuire, and Dick Kadrie from Stillwater Ford were present to request a public hearing date be set to approve a Conditional Use Permit and a Rezoning. City staff said that the information provided was sufficient that staff reports could be ready within two weeks . Councilmember Schaaf, seconded by Robert, to set a public hearing date for December 11, 1995 . Carried 4-0 . Proposed County Road Turnbacks - Robertson said that he had received official notice from Washington County Public Works that the County wished to turn back roads to the City. Robertson and Councilmember Robert noted that they were opposed to Washington County' s proposal because they thought it had little benefit for the City. Council directed Robertson to schedule a meeting to discuss this issue with Washington County. r I Alk Ask Enclosure 9 MEMO Date : November 21, 1995 To: Mayor & Council From: Mike Robertson, City Administrator Re : Proposed County Road Turnbacks I have enclosed a copy of the road turnbacks Washington County is proposing. A turnback is when a road is given from one jurisdiction to another. It is generally a custom that when turning back a road the jurisdiction turning it back will undertake repairs or reconstruction such that the road is in good condition. For Oak Park Heights, the County would like to remove the State Aid designation for Beach Road, turnback Beach Road to the City, and place the State Aid designation on Osgood Avenue. This would allow them to use the State Highway Aid money they receive from the State for future maintenance of this road. Both Councilmember Janet Robert and I expressed disagreement with Washington County over this proposal . We think the City would benefit from having the State Aid designation placed on Oakgreen Avenue. The City gains little benefit from Osgood Avenue becoming a State Aid road, since it is already a County Road. The County has stated in their Comprehensive Plan that they envision Oakgreen becoming a County road within the next 25 years . The new interchange of T.H. 36 with T.H. 95 severs/removes the existing Beach Road - CSAH 21 route over T.H. 36. This will require Washington County to revise the route of CSAH 21 in order to preserve the continuity of the CSAH system as required by the State Aid rules. This action by Mn/DOT was the only practical build alternative in this interchange area and was undertaken without concurrence by Washington County. Therefore, any changes required to preserve the continuity of the CSAH routes in this area can be made without payback penalty for revoked segments. I encourage you to begin the revocation/designation process at your earliest convenience. I also encourage you to coordinate the CSA system revisions with the city, for consideration of revisions to the MSA system. If you have questions about this, please contact Mr. Larry Erb (582-1384).
