A review of the conditional use permit for the Metropolitan Waste
Control Commission (MWCC) sewer treatment plant and the letter
from Alan Dye from the MWCC indicate that all conditions of the
permit have been satisfied and a building permit can be issued.
I am enclosing copies of the correspondence related to the
landscaping plan between Mr. Dye and Carol Sustak of the
Sunnyside Condominium Association for your files .
In addition, Molly Shodeen of the Department of Natural Resources
(DNR) has indicated that the matter related to zoning for the
sewer treatment plant in the Lower St. Croix National Scenic
Riverway has been resolved and the DNR agrees with the
interpretation of the Ordinance as per my memo dated 24 January
1991 . A copy of that memo is attached.

Dear Allen,
First off, I would like to thank you and your team for your patience with us during our time of
decision making on this matter. Your meeting with Mr. Ben Kelly from our association and the
offering of the plans was very helpful in clearing up some details.
As the plan stands today, we are in acceptance with it except for two remaining areas. Those two
areas are 1) directly east of the Sunnyside parking lot at the S.E. corner between the two Amur
Maples (see area circled) and 2) directly north skirting fence line and running east past the newly
identified utlraviolet building (see circled area). We would request that additional trees be
placed within these areas to assist in blocking the view from residents. If these two areas could
be filled in, the landscaping plans, as shown on the drawings and discussed between Mr. Kelly
and you, stand as acceptable.
In addition, we had discussed the MWCC providing a survey of the property line connecting
Sunnyside and the wastewater treatment plant on the north end of the Sunnyside development.
We would request that these plans he presented to Sunnyside so we may proceed with any land
development plans we may have in the future.
Allen, if you should have any further questions or requests from us, please don't hesitate to con-

Landscaping Plan
Dear Ms. Sustak:
Thank you for your approval of the landscaping plan for the
referenced project. Additional trees will be added to the plan as
follows: 3 additional Amur Maple trees will be planted just south
of the two Amur Maples that are south of the treatment plant
parking lot and 4 additional Colorado Spruce will be placed along
the north edge of the U.V. disinfection building. This building
will also continue to be screened by the existing trees located
north of the building.
The north property line of the treatment plant was surveyed last
October. I do not know if the wooden stakes are still in place, but
there is a steel monument at the northwest corner of the property.
The property line that is shown on the landscaping plan is
correct. If you would like to have the entire property line staked,
it could be done this spring when the ground thaws. Thank you for

As per your request, I have researched the issue related to an
expansion of the Metro Waste Control Commission Sewer Treatment
Plant located in the City of Oak Park Heights . The sewer
treatment plant is located adjacent to the St . Croix River at
Upper 61st Street and St . Croix North. The site on which the
plant is located is an 0, Open Space Conservation District in
which governmental and public regulated utility buildings are a
conditional use . Government or public regulated utility
buildings are not defined in the Oak Park Heights Zoning
Ordinance .
The sewer treatment facility is located in the Lower St. . Croix
National Scenic Riverway and is regulated under NR2200 General
Provisions . The provisions do not allow sewage treatment
facilities as a permitted use and conditional uses are allowed as
follows :
"In Urban Districts ; uses permitted without a rezoning in
specific zoning districts by existing local ordinances in
effect on May 1 , 1974 may be allowed as conditional uses by
the local authority. "
The Oak Park Heights Zoning Ordinance in effect in May of. 1974
was Ordinance No . 60, approved February 14 , 1972 which adopted
and amended portions of the Model Zoning Regulation Code For.
Communities in Washington County adopted May 23 , 1967 . Ordinance
No . 60 is silent on sewage treatment plants in all of the zoning
districts . The general area containing the sewage treatment
plant was zoned Limited Industrial at that time. In Section 4

the Ordinance does allow those sections of the previous zoning
regulations including Ordinance No. 20 to be valid if not
inconsistent with Ordinance No . 60 . Ordinance No. 20, adopted
November 9 , 1964 , allows public utility and public service uses
which would include sewage treatment as a permitted use. That
-- section is found not to be inconsistent with Ordinance No. 60 in
that other public utility and utility substation uses are listed
permitted uses . See attached Ordinance No. 20 and applicable
sections of Ordinance No. 60 .
CONCLUSION
From the review of ordinances , it would appear that the sewer
treatment plant was a permitted use under the Oak Park Heights
Zoning Ordinance on May 1 , 1974 . Under current regulations
expansion of the sewer treatment plant will require a conditional
use permit to be issued by the City. If you have any questions
or would like copies of the aforementioned ordinances , please
advise .

SECTION 4. REPEAL OF CONFLICTING ORDINANCES, VALIDITY AND
INSEPARABILITY.
Ordinances No. 20, 26, 46 and all other Ordinances or parts of Ordinances
of the Village of Oak Park Heights inconsistent with the provisions of this
Ordinance are hereby repealed.
• If any section, subsection, sentence, clause or phrase of this Ordinance is
for any reason held to be invalid, such decision shall not affect the validity
of the remaining portions of this Ordinance.

SECTION 5 . EFFECTIVE DATE.
This Ordinance shall be and is hereby declared to be in full force and effect
from and after its passage and publication according to law.
Passed by the Village Council of the Village of Oak Park Heights, Washington
L County, Minnesota, this 14th day of February, 1972.

Conditional Use Permit Application
Dear Mr. Richards:
Enclosed please find the documentation requested by the City of Oak
Park Heights to complete the Commissions application for a variance
of the Conditional Use Permit. The following is a brief list of
the items in question:
1. The sludge storage and gravity thickeners will encroach upon
the setback as stated in the NAC letter of March 7 , 1990 . Also
the new Ultraviolet Disinfection building will encroach upon
the north setback approximately 5 feet. The entire site has
been limited even further by revising the grading plan for the
south east corner to minimize disruption of the wetlands on
the site. A copy of the revised plan is enclosed.
2 . Parking for the treatment plant is currently nine stalls. The
expansion of the plant will not require additional operating
or maintenance personnel, which are the people using the
parking stalls. Since no additional personnel will be needed
at the plant and there have been no off street parking
problems in the past, the nine parking stalls will be
sufficient.
3 . A very good landscaping plan has been designed by our
Consultant, Donohue and Associates. Two copies of the
landscaping plan and a copy of a letter from Sunnyside
Condominiums approving the landscaping plan are enclosed for
your review.
4 . The grading plan is included in the plans and is located on
sheets 30 - 33 . I have also included a revision that was made
to the grading of the south east corner of the site to
minimize damage to the wetlands in this area.
5. The plans show clearly that there are no structures that will
be greater than 30 feet in height, which is well below the 35
feet requirement.

6. All the structures for this project will be built with an
exterior of brick and mortar. The trim of the structures will
be painted with earth tones.

Landscaping Plan
Dear Ms. Sustak:
Thank you for your approval of the landscaping plan for the
referenced project. Additional trees will be added to the plan as
follows: 3 additional Amur Maple trees will be planted just south
of the two Amur Maples that are south of the treatment plant
parking lot and 4 additional Colorado Spruce will be placed along
the north edge of the U.V. disinfection building. This building
will also continue to be screened by the existing trees located
north of the building.
The north property line of the treatment plant was surveyed last
October. I do not know if the wooden stakes are still in place, but
there is a steel monument at the northwest corner of the property.
The property line that is shown on the landscaping plan is
correct. If you would like to have the entire property line staked,
it could be done this spring when the ground thaws. Thank you for

Dear Allen,
First off, I would like to thank you and your team for your patience with us during our time of
decision making on this matter. Your meeting with Mr. Ben Kelly from our association and the
offering of the plans was very helpful in clearing up some details.
As the plan stands today, we are in acceptance with it except for two remaining areas. Those two
areas are 1) directly east of the Sunnyside parking lot at the S.E. corner between the two Amur
Maples (see area circled) and 2) directly north skirting fence line and running east past the newly
identified utlraviolet building (see circled area). We would request that additional trees be
placed within these areas to assist in blocking the view from residents. If these two areas could
be filled in, the landscaping plans, as shown on the drawings and discussed between Mr. Kelly
and you, stand as acceptable.
In addition, we had discussed the MWCC providing a survey of the property line connecting
Sunnyside and the wastewater treatment plant on the north end of the Sunnyside development.
We would request that these plans he presented to Sunnyside se we may proceed with any land
development plans we may have in the future.
