A copy of Resolution 24-08-27 is enclosed. As the City has not yet received any requests for permit or other activity since the approval or your CUP, I am writing to remind you that Conditional Use Permit approvals lapse and become null and void 12 months after the date of their approval, unless the property owner has substantially started the construction of any building, structure, addition or alteration, or use requested as part of the conditional use. (Ord. 401.03.C.4) Your CUP approval will lapse on August 27, 2025 if substantial construction on the project is not underway. An extension of the conditional use permit may be requested and shall be provided in writing to the Zoning Administrator not less than 30 days before the expiration of said approval. Written requests for extension shall state the facts of the request, showing a good faith attempt to utilize the permit, and shall state the additional time being requested to begin the construction. Extension requests shall be heard and decided by the City Council prior to the lapse of approval of the original request.
