As an incentive to recycle and to increase fire prevention awareness, the City rewards two residents each month with their choice of an award of a fire extinguisher and/or smoke detector. Your residence was checked on Tuesday, June 3, to determine if you had your recycling bin out with your regular garbage. Your recycling was out and ready for collection; therefore, you are one of this month's winners. Jennifer Pinski Assistant City Administrator TREE CITY U.S.A. 0 CITY OF OAK PARK HEIGHTS CITY COUNCIL WORKSESSION NOTES TUESDAY, May 27, 2025 Present: Deputy Mayor Dougherty, Councilmembers Johnson, Liljegren and Runk; City Administrator Rife, Assistant City Administrator Pinski, Police Chief Hansen, Public Works Director Kegley, and City Attorney Sandstrom (arrived at 5:50 p.m.). Absent: None. 1. Call to Order: Deputy Mayor Dougherty called the meeting to order at 5:30 p.m. 2. Stillwater High School Ballfield Fence: City Administrator Rife provided background on the request by Mike Polehna to waive the fence permit fees. The City Council discussed that the permit holder was the school district and that the fee should not be waived. No action was taken. 3. 58" Street Arborvitae Trees: City Administrator Rife reported that some trees were damaged by exhaust during the trail resurfacing project. He said it was believed the trees would not die and would return to health. He said staff would meet with the resident affected. No action was taken. 4. Cryptocurrency Kiosks: The City Council would like to further discuss the registration fee. They requested the item be pulled from the Agenda and brought back at a future meeting. No action was taken. 5. Automated License Plate Readers: Police Chief Hansen provided a background on the use and cost of license plate reader cameras. City Attorney Sandstrom said data practices policies would be required if they were installed in the City. Councilmember Johnson was concerned about privacy issues. The City Council would need more information. No action was taken. 6. Adjournment: Councilmember Johnson suggested the City Council consider scheduling a meeting for June 10 to discuss the vacant mayor seat. Staff present: City Administrator Rife, Police Chief Hansen, Assistant City Administrator/City Clerk Pinski, Public Works Director Kegley, City Engineer Mann, City Planner Richards, and City Attorney Sandstrom. Absent: None. Deputy Mayor Dougherty reported Mayor Mary McComber passed away on May 26, 2025. He provided a statement on behalf of the City Council expressing condolences and gratitude for her advocacy and dedication to the City of Oak Park Heights. He announced Mayor Mary McComber's visitation was set for Thursday, June 5 from 4:00 to 8:00 p.m. at Bradshaw in Stillwater and the funeral was set for Friday, June 6 at 10:00 a.m. at Bradshaw. Consent Agenda Item G was removed from the Agenda and Consent Agenda H was added: "Schedule June 10, 2025 Worksession at 5:00 p.m. and a Council Meeting if Necessary." Councilmember Johnson, seconded by Councilmember Liljegren, moved to approve the Agenda as amended. Carried 4-0. II. Council/Staff Reports: A. Councilmember Dou _gheM: He reported he attended the Parks and Trails Commission meeting on May 19. B. Councilmember Johnson: Nothing to report. C. Councilmember Liljegren: He reported that the next Fire Department Advisory meeting had not been scheduled yet but it was being discussed. D. Councilmember Runk: Nothing to report. E. Staff: City Administrator Rife reported that staff would be beginning the budget process. Police Chief Hansen reported that grant -funded increased traffic enforcement would be commencing. He also reported that the totaled police vehicle was sold at auction, and the last day of school would be June 3. Assistant City Administrator Pinski reported that Daniel and Sara Lantz of 13767 55th Street North were chosen as the recycling award winners. She also reported that Clean-up Day was held May 17, and Party in the Park was set for June 5 from 4:30 pm to 6:30 pm. City Council Meeting Minutes May 27, 2025 Page 2 of 3 III. Councilmember Runk, seconded by Councilmember Johnson, moved to approve the Resolution. Carried 4-0. B. Conditional Use Permit for Construction of a Garaize in the Front Yard and for Setback at 15117 651h Street North: City Planner Richards reviewed his report. He said he provided two Resolutions to discuss and consider. The first was a Resolution reflecting the Planning Commission's recommendation, and the second was to approve as requested by the applicant. Councilmember Liljegren, seconded by Councilmember Johnson, moved to approve the Resolution granting the applicant's request. Carried 4-0. C. Approve and Agreement with Stantec Consulting Services, Inc. for PFAS Design Work: Councilmember Johnson, seconded by Councilmember Liljegren, moved to approve the Agreement. Carried 4-0. VIII. The City would like the City Council to accept the donations and direct they be used for Party in the Park to offset costs or to be raffled off to event attendees. If the City chooses to waive the tort limits to the extent of the insurance coverage purchased, the limits would then become $2,000,000 per individual and $2,000,000 per occurrence/aggregate. In effect, the City would be purchasing increased insurance coverage. The City has typically made the choice of not waiving the limits. Staff recommends not waiving the limits. FINANCIAL IMPACT: • DOES ACTION REQUIRE EXPENDITURE OF FUNDS? No ACTION REQUESTED: Non Waiver of Statutory Tort Limits for City Liability Insurance for 2025-2026 ATTACHMENTS: Liability Coverage Waiver Form 0 LMCMEINNESOTA CITIES LIABILITY COVERAGE WAIVER FORM Members who obtain liability coverage through the League of Minnesota Cities Insurance Trust (LMCIT) must complete and return this form to LMCIT before their effective date of coverage. Email completed form to your city's underwriter, to pstech(amc.org, or fax to 651.281.1298. The decision to waive or not waive the statutory tort limits must be made annually by the member's governing body, in consultation with its attorney if necessary. Members who obtain liability coverage from LMCIT must decide whether to waive the statutory tort liability limits to the extent of the coverage purchased. The decision has the following effects: • If the member does not waive the statutory tort limits, an individual claimant could recover no more than $500,000 on any claim to which the statutory tort limits apply. The total all claimants could recover for a single occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits would apply regardless of whether the member purchases the optional LMCIT excess liability coverage. If the member waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could recover up to $2,000,000 for a single occurrence (under the waive option, the tort cap liability limits are only waived to the extent of the member's liability coverage limits, and the LMCIT per occurrence limit is $2,000,000). The total all claimants could recover for a single occurrence to which the statutory tort limits apply would also be limited to $2,000,000, regardless of the number of claimants. • If the member waives the statutory tort limits and purchases excess liability coverage, a single claimant could potentially recover an amount up to the limit of the coverage purchased. The total all claimants could recover for a single occurrence to which the statutory tort limits apply would also be limited to the amount of coverage purchased, regardless of the number of claimants. Claims to which the statutory municipal tort limits do not apply are not affected by this decision.
