Dear Mr. and Mrs. Ross:
The City is in receipt of your application materials submitted on September 8, 2025, for
a Conditional Use Permit to allow a setback less than is required, and for construction in
a side yard for an accessory building at 5420 O'Brien Avenue North. With this letter we
are notifying you that the application is not complete. The City will deem it complete with
receipt of the following item by September 24, 2025:
1. A project narrative that explains why the shed should be placed in the side yard
versus the rear yard. Are there topographic, tree or other site issues that prevent
this structure from being placed in the rear yard?
2. A site plan showing the property lines, location of the house, and the proposed
location of the accessory building with dimensions of the structure and of the
setbacks to property lines.
3. Pictures of the proposed location of the accessory building and pictures in the
rear yard to support your reasoning why it should not be placed in the rear yard.
If all of the materials are provided, the Planning Commission would consider the
application at a meeting scheduled for October 9, 2025, at 6:00 P.M. in the City Hall
Council chambers. If recommended by the Planning Commission that evening, the City
Council will review the application at their meeting scheduled for October 28, 2025.
Pursuant to Minnesota Statutes 15.99, Sub. 3(f), the City of Oak Park Heights is
herewith extending the period of time for agency/city review of the application for an
additional 60 day period (for a total of 120 days from the date of a complete application)
inasmuch as the City has determined that additional research and study by the City staff
relative to the complexity of the project as proposed will be required.
