Irving, Texas 75063 RE: Oak Park Heights — Conditional Use Permit and Design Guidelines/Site Plan Review for a Dave's Hot Chicken — 5910 Neal Avenue North TPC FILE: 236.02 — 25.09 Dear Mr. Padilla: The City received your application materials submitted on November 20, 2025, for a Conditional Use Permit for signage and Design Guidelines review for a Dave's Hot -- -- Chicken at 5910 Neal Avenue North. With this letter we are notifying you that the application is not.complete. The City may deem the application complete with receipt of the following clarification by December 17, 2025: 1. The request for the Conditional Use Permit and Design Guidelines review requires fees of$800.00 and escrow of$1,000.00. To date, only $200.00 has been received. - 2. Please clarify the relationship of you, the applicant, with the owner of the property, Alex Humphries. 3. In the submitted materials, what does Sheet 10 represent? _ 4. Provide more detail on the size of the two sign faces of the pylon sign. 5. Are there any building materials alterations, additions, changes to windows or doors, or changes to exterior mechanical equipment proposed to the building? City Staff have reviewed your application and would like to invite you to a meeting to discuss your request at 10:30 AM, December 17, 2025, at the Oak Park Heights City Hall. Please coordinate with Jacob Rife, City Administrator if you would like to meet If the materials are submitted as requested, the Planning Commission would consider the application at a meeting scheduled for January 8, 2025, at 6:00 P.M. in the City Hall Council chambers. If recommended by the Planning Commission that evening, the City Council will review the application at their meeting scheduled for January 27, 2025. Pursuant to Minnesota Statutes 15.99, Sub. 3(f), the City of Oak Park Heights is herewith extending the period of time for agency/city review of the application for an additional 60 day period (for a total of 120 days from the date of a complete application) Polo Padilla December 10, 2025 inasmuch as the City has determined that additional research and study by the City staff relative to the complexity of the project as proposed will be required.
