Dave's Hot Chicken—Planned Unit Development/CUP Amendment

I will not be present at this meeting.The following reflects my comments and perspective
for the Vice Chair to reference during discussion.
This application is limited in scope.The underlying land use, drive-through restaurant
approval, site layout, parking, and access were all approved as part of the Planned Unit
Development in 2003 and remain in effect. No changes are proposed to access,
circulation, parking, or building footprint.
The issues before the Planning Commission are signage and Design Guidelines
compliance, specifically:
1. Wall signage quantity, and
2. Building color and exterior mural graphics as a variance from the Design Guidelines.
Signage
I agree with staff's recommendation that wall signage should be limited to one sign per
facade, for a total of four wall signs, consistent with past precedent for similar drive-
through restaurants. Given the site's visibility from Stillwater Boulevard/County Road 15,
additional wall signs are not necessary.
Square footage limits and lighting standards should be enforced at the time of sign
permitting to ensure compliance with ordinance requirements.
Design Guidelines/ Building Color and Murals
The proposed white building base with bright mural graphics is a clear departure from the
City's Design Guidelines.The Commission's role is to determine whether this deviation is
acceptable for this site and use.
If the Commission finds the murals and color scheme acceptable as part of a franchise
design, that determination should be clearly stated and supported as a variance specific to
this proposal. If not,the applicant should be directed to revise the exterior treatment to
better align with the Design Guidelines.
Closing
This request does not reopen or modify prior approvals related to traffic, access, parking,
or drive-through operations.The focus should remain on signage limits and whether the
proposed exterior colors and mural graphics are appropriate for this location under the
Design Guidelines.
Please ensure the Commission's discussion and recommendation clearly reflect those
two decision points.
