Conditional Use Permit-Power Plant Cannabis Shop, LLC

I will not be present at this meeting. The following reflects my comments and position for
the Vice Chair to reference and enter into the record as appropriate.
Overall,this application is consistent with the Comprehensive Plan and the B-4 Limited
Business District. City staff's analysis is thorough, and the proposed use is one that is
allowed with a Conditional Use Permit, subject to the stated conditions.
My primary concern is traffic and access.
No additional traffic associated with this use customers, employees, or deliverie can be
allowed to use the private drive serving the adjacent property at(Stillwater Dentistry).
That drive is private and was never intended to support additional commercial traffic and is
already supporting traffic from Panera and Popeyes that it was never intended for after the
City closed 60th Street to build the roundabout, there has been limited to no solutions
provided for traffic even with concerns original proposed and I believe we added them to
both Popeyes and Paneras conditional use permits when approved but we need to confirm
this with Mr Richards.
For that reason, the condition requiring construction of a dedicated ingress and egress
connection from 59th Street to the east driveway is critical. That access must
be approved by the City Engineer and fully constructed prior to issuance of a
certificate of occupancy. This is not a minor condition, it is essential to preventing
spillover impacts on the neighboring property which us as a city have already failed to do
with the other construction to the east.
If traffic issues develop after opening and are tied to this use, I support the City requiring
additional corrective measures without delay.
With that access issue properly addressed and enforced, the remainder of the proposal
appears reasonable and consistent with City code, including the conditions related to
hours of operation, odor, noise, lighting, security, and indoor-only operations.
Please make sure the access and traffic issue, specifically preventing use of the Stillwater
Dentistry private drive, is clearly reflected in the Commission's discussion and any
recommendation or decision.

Thank you for the quick response,
I reviewed the documents and appreciated the mandate for additional access from 59th Street.
The road through my property remains an issue and depreciates my property value, as does the loss of
parking spots in an already tight area.
Two questions:
1. It is listed as the 5th dispensary in Oak Park Heights, but only 4 are permitted.
2. I do not know how the existing 11 parking spaces will accommodate 20-50 employees in
addition to customers.
3. I have had issues in the past with people parking in my north lot and walking over to the old
furniture store.This area has become much, much more congested since that time.
Additional parking would be necessary, and fence or landscape barriers may be required.
Ultimately, a dispensary is not a neighbor that I want next to a Family practice and a professional medical
building. Although they do not provide inpatient treatment.The second level is Mn Mental Health.
The city ordinance lists this as a barrier to a dispensary.
I plan to be at the hearing. Please accept this as written testimony requesting additional parking and a
barrier between the properties.
