Dear Ms. Weiss:
The City received your application materials submitted on November 21, 2025, for a
Conditional Use Permit to allow a cannabis retail dispensary under the name of Power
Point Cannabis Shop II, LLC at 13435 60th Street North. The application also includes a
Conditional Use Permit for parking and Design Standards/Site Plan review. With this
letter we are notifying you that the application is not complete. The City may deem it
complete with receipt of the following clarification by December 10, 2025:
1. The "Lease" as provided in your application materials continues to identify
"Omar Salah, on behalf of an entity to be formed" as the Tenant in the
opening paragraph on the first page and with additional blanks for tenant
identification in Section 1.8. These must be updated to identify Power Plant
Cannabis Shop II, LLC as the intended Tenant with entitlement to possession
and control of the premises.
If the lease is updated as requested, the Planning Commission would consider the
application at a meeting scheduled for January 8, 2025, at 6:00 P.M. in the City Hall
Council chambers. If recommended by the Planning Commission that evening, the City
Council will review the application at their meeting scheduled for January 27, 2025.
In emails to City Staff, Omar Salah has indicated that there are two active applications,
one from OS Management MN, and the other from Power Point Cannabis Shop II, LLC
for a cannabis retail dispensary at this address. Note that on November 19, 2025, I sent
Mr. Salah a letter rejecting the OS Management MN application. The application fees
and supporting documentation were returned to Mr. Salah. Assistant City Attorney
Christina Benson has recently sent further correspondence to OS Management's legal
counsel regarding that prior application by OS Management. The City will not consider
the OS Management application.

There are two other cannabis retail applications that have been approved by the City
and two that are under consideration, one that needs further review by the City Council
and another that is being considered by the Planning Commission at a public hearing on
December 11, 2025. The Power Point Cannabis Shop II, LLC application is the fifth
application in the queue. As you are aware, the City's Code only allows for registrations
for up to four licensed cannabis operations in the City.
Pursuant to Minnesota Statutes 15.99, Sub. 3(f), the City of Oak Park Heights is
herewith extending the period of time for agency/city review of the application for an
additional 60 day period (for a total of 120 days from the date of a complete application)
inasmuch as the City has determined that additional research and study by the City staff
relative to the complexity of the project as proposed will be required.
