HomeMy WebLinkAbout1974-05-13 Council Minutes Excerpt CITY OF OAK PARK HEIGHTS MINUTES OF MEETING HELD MAY 13, 1974 Meeting called to order by Mayor Johnson. Present: Torgerson, Sommerfeldt, Mondor, Groth, Johnson, Heuer and Eckberg. Minutes of the April 8th and April 30th meetings were read. Torgerson requested the Mr. Glaser testimony in the minutes of April 30th be corrected to indicate that there are 3 lots between his home and lot 30 and not next door as stated. Sommerfeldt moved to approve corrected minutes. Seconded by Torgerson. Carried. Mr. Gifford of Lawrence Sign presented sign proposal for Goodyear Tire and Appliance Store. He will obtain additional information for the June 3rd meeting. Mr. R. Lawson, representing Oliver Oddan, advised the Council of his interpretation of the Cities Zoning Ordinance and questioned their authority to deny Mr. Oddan's request to move a house on to lots 30 and 31, Block 8, McKenty's Addition. Mayor advised that the Council reached its decision at the April 30th meeting after hearing all testimony and any further decisions required would have to be made by courts. L.Hauge presented the final plot plans for his proposed 36,000 sq. ft. office building, motel and restaurant and requested on On-Sale Liggor License. He submitted an application for Rezoning and Special Use Permit for Block 6, Cooley's Addition. Public Hearing was set for June 3rd, 8:00 P.M. at the Municipal Building. P. Geiger advised the Council that St. Croix Bowl, Inc. was considering a 16 - 24 lane bowling alley to be located directly south of the new V.F.W. club. J. Lentz presented an application, #28-74, for a fence variance. Torgerson moved to grant t. Seconded by Sommerfeldt. Carried. Aga,AS R. Polzin request #29-74 for a set back variance was reviewed. O'Neal related her concern and opinions regarding a garage proposed by her neighbor. Sommerfeldt made a motion to amend the minutes of January 14, 1974 as follows, "In exchange for the 50 ft. dedicated street lying in R.L.S. 19 and R.L.S 76, the City Attorney will prepare an agreement with Swager Bros. to require them to provide a similar size parcel for a street in this area if and when the City deems it necessary." Seconded by Groth. Carried. Dave Krech reviewed the zoning of the house located at 15330 58th St. N. He was advised that he could operate a pottery gallery on the site in conjunction with his residence. Mr. Wallace of N.S.P. advised that the Allen S. King Plant has been directed to convert to a low sulphur fuel which will require additional equipment to control the resulting increase quantity of fly ash. Mr. Wallace indicated that they would be requesting a permit to construct a silo to contain said fly ash. The City Attorney was directed to prepare an ardinance and revise the rules and regulations relating to slag and fly ash. The following items will be added to the present controls. 1) Will not allow stock piling of slag or fly ash at plant. 2) Fly ash must be completely covered by slag at end of each days operation at disposal site. 3) Fly ash must be transported in a semi liquid condition in a closed tank type container. 4) Add a penalty clause to City of Oak Park Heights Minutes of meeting held May 13, 1974 Page 2 - continued prosecute violators. Mondor moved to authorize construction of silo upon issuance of build- ing permit. Seconded by Torgerson. Carried.
