HomeMy WebLinkAbout09-10-40 RESOLUTION 0 9 -10 - 4 0 A RESOLUTION BY THE OAK PARK HEIGHTS CITY COUNCIL DIRECTING THE PUCHASE OF APPROXIMATELY 2.1 ACRES FROM RADUENZ DEALERSHIP PROPERTIES, LLC Whereas, the City Engineer in Technical Memorandum dated June 15` 2009 identified that the in the future the City's water systems will require additional capacity to provide for daily firm flow, and Whereas, the City does have practical limitations on well and tower location, the same being restricted by adequate flow of the aquifer and possible contamination to the south of the City limits, and; Whereas, the Property to be purchased, (approximately 2.1 Acres located at the northeastern terminus of Memorial Ave. in the City), is available from Raduenz Dealership Properties, LLC and at a price of $8.00 per foot, pending final appraisal, and; Whereas, the placement of a municipal well and water tower in this location is not in conflict with the City's Comprehensive plan as determined by the City Planning Commission. NOW, THEREFORE, BE IT RESOLVED that the City Council for the City of Oak Park Heights does direct that the City purchase the Property for an approximate price of $8.00 per square foot and that the necessary funds, including acquisition costs, shall be drawn equally from the City's Capital Revolving Fund and Water Connection Charge fund. BE IT FURTHER RESOLVED that the City Administrator and City Attorney shall complete all required due - diligence paperwork to effectuate the transaction, including but not limited to possible the securing of a satisfactory Phase I Environmental Report, completion of a minor subdivision, finalizing of land appraisal reports or any other items deemed necessary by the City Attorney.
