Call To Order Chair Vogt called the meeting to order at 7:02 p.m. Present:
Commissioners Dwyer, Powell, and Runk; Community Development Director
Danielson, City Planner Richards, and Council Liaison McComber. Absent:
Commissioner Liljegren.
Approval of Agenda In light of its significance to Public Hearings on the Agenda,
Chair Vogt suggested that Item 2 of New Business be discussed following
Visitors /Public Comment and prior to Public Hearings. Commissioner Dwyer,
seconded by Commissioner Runk, moved to approve the Agenda with Item 2 of New
Business placed for discussion following Visitors /Public Comment. Carried 4 -0.
Approve Planning Commission Minutes•
Commissioner Runk, seconded by Commissioner Vogt, moved to approve the minutes
of April 11, 2002 as presented. Carried 4 -0.
Department /Commission Liaison 12eports
1. Hwy. 36 Partnership Stud Mary McComber reported that the partnership
committee met on May 8th and received traffic analysis data for the three
alternatives being reviewed. McComber reported that the next meeting of the Hwy.
36 Partnership Study is scheduled for 6:30 p.m., May 29th at the Washington
County Government Center. She further reported that a meeting of the aesthetic
design committee will be held at 8:00 a.m., May 22nd at the Oak Park Heights City
Hall and that an Open House is scheduled from 4:30 to 7:30 p.m., May 22nd at
Stillwater Area High School. McComber noted that a great deal of information is to
be available, including an artistic rendition of the parkway concept and the three
design- styles.

New Business (As moved per motion and second on Agenda approval)
2. Consideration of Scheduling Special May 23 Meeting
Chair Vogt noted that the special meeting scheduled for May 6th for discussion of the
McKean Square West, Oakgreen Village Townhomes, Oakgreen Village Villas and
Oakgreen Village Apartments public hearing applications was cancelled at the request
of the applicants and that they had requested a continuation and extension of 120 day
timeline. Chair Vogt asked for and received an update from Community Development
Director Danielson and City Planner Richards as to the proposed projects status and
extension request.

Discussion ensued as to the need for a special meeting, legal aspects involved with the
extension request, timeliness and general options for proceeding. Commissioner
Dwyer expressed his desire to see material, prior to next meeting, if significant changes
to the site plan were made.
Chair Vogt moved that a May 23rd special meeting not be scheduled and to recommend
that the City Council approve request for 31 -day extension.
Discussion continued as to when information from the applicant would be available to
staff for review.
Ken Hooge of Sr. Housing Partners addressed the Commission and advised them that
they were trying to move the project ahead as rapidly as possible. He noted that
changes to the site plan are not drastically different but noticeably better in meeting
the goals and guidelines as established by the City of Oak Park Heights. He added that
a concentrated effort has been made to improve the town -home area, with
modifications to building design and configuration.
Chair Vogt elected to withdraw his earlier motion as a result of discussion following the
same.
Brief discussion ensued as to the timing for coordination of meetings, materials
submission deadlines, staff review and availability for commission distribution.
Commissioner Vogt, seconded by Commissioner Dwyer, moved to recommend that the
City Council grant request for 31 -day extension to applicants for Mckean Square West,
Oakgreen Village Townhomes, Oakgreen Village Villas and Oakgreen Village
Apartments applications. Carried 4 -0.
Commissioner Runk, seconded by Commissioner Dwyer, moved to recommend the
scheduling of an additional Planning Commission for 7:00 p.m., June 3, 2002 at the
Oak Park Heights City Council Chamber for continued discussion of the Mckean
Square West, Oakgreen Village Townhomes, Oakgreen Village Villas and Oakgreen
Village Apartments applications. Carried 4 -0.
Public gleanings
A. Applebee's To consider requests for sign variance and site plan review for
vestibule addition at 13625 60th St. N.
City Planner Richards provided an overview of the applicant's requests and a summary
of his report regarding the same.
Chair Vogt opened the hearing for public comment at 7:35 p.m.
Jay Noseworthy - Applebee's Manager stated that it was the desire to be more
convenient that prompted their request. He added that they have no problem with
meeting the criteria established by Arborist Widin.

Commissioner Runk, seconded by Commissioner Dwyer, moved to close the public
hearing at 7:41 p.m. Carried 4 -0.
Commissioner Runk, seconded by Chair Vogt, moved to recommend that the City
Council approve the applicant's request for sign variance and site plan review, subject
to the conditions within the April 25, 2002 City Planner's report, as follows:
One additional wall mounted sign not to exceed 10 square feet and to be allowed
on the east elevation of the Applebee's Restaurant.
2. The sign shall be illuminated during regular business hours and must be turned
off after 1:00 a.m.
3. The neon sign shall not flash or rotate in any manner.
4. Landscaping and screening shall be subject to the review and approval of the
City Arborist.
5. Any other conditions of the Planning Commission, City Council, and City staff.
Carried 4 -0.
B. 401 Ordinance Amendment To consider amendment to City of Oak Park Heights
Ordinance 401 as it pertains to signage.
Chair Vogt summarized the history of the issues. City Planner Richards asked the
Commission for direction on how they would like to proceed with public hearing and
ordinance draft.
Chair Vogt opened the public hearing for comment at 7:42 p.m. There being no visitors
for public comment, Commissioner Runk, seconded by Commissioner Powell, moved to
continue the public hearing to the next meeting of the Planning Commission. Carried
4 -0.
City Planner Richards referenced the City of Burnsville sign ordinance, noting that the
structure of the ordinance itself was very good, as was many of the ordinance
provisions.
Chair Vogt asked for comment on the ordinance structure and procedure for moving
forward to address the issue of possible amendment. Commission discussion ensued
as to proposed changes, desire to see a draft of Oak Park Heights ordinance to review,
and format style of draft for review.
Commissioner Runk, seconded by Commissioner Dwyer, moved to request that a draft
proposal be prepared for the Commissions review prior to their meeting of June 13,
2002. Carried 4 -0.

C. Continued - McKean Square vilest: To consider a request for a planned unit
development: concept plan for Phase II, Boutwell's Landing, located south of
Norwich Pkwy. and Nolan Ave. N.
Chair Vogt initiated a brief discussion regarding conduct for this public hearing, along
with the continued hearings for Oakgreen Village Townhomes, Oakgreen Village Villas
and Oakgreen Village Apartments, in light of the earlier made motions to schedule a
June 3 2002 special meeting and recommending that the City Council approve the
request for 31 -day extension.
City Planner Richards indicated that each hearing should be opened for public
comment, if any, and then moved for continuance. Chair Vogt opened the hearing for
public comment.
There being no public comment, Commissioner Runk, seconded by Commissioner
Dwyer, moved to continue the public hearing to the next meeting of the Planning
Commission. Carried 4 -0.
D. Continued - Oakgreen Village ° Townhomes To consider requests for a
planned unit development: concept plan, conditional use permit and zoning
amendment from O, open space to R -3, multiple family residential for the
construction of a multi- family housing development, located north and south of
58th St. N. and west of Oakgreen Ave. N.
Chair Vogt opened the hearing for public comment.
There being no public comment, Commissioner Dwyer, seconded by Chair Vogt, moved
to continue the public hearing to the next meeting of the Planning Commission.
Carried 4 -0.
E. Continued - Oakgreen Village Villas To consider requests for a planned unit
development: concept plan and conditional use permit for the construction of a
multi- family housing development, located north of 58th St. N. and west of
Oakgreen Ave. N.
Chair Vogt opened the hearing for public comment.
There being no public comment, Commissioner Runk, seconded by Commissioner
Dwyer, moved to continue the public hearing to the next meeting of the Planning
Commission. Carried 4 -0.
F. Continued Oakgreen Village Apartments To consider requests for a
planned unit development: concept plan and conditional use permit for the
construction of a multi- family housing development, located north of 58th St. N.
and west of Oakgreen Ave. N.

There being no public comment, Commissioner Powell, seconded by Commissioner
Runk, moved to continue the public hearing to the next meeting of the Planning

1. Planning Commissioner Terms
Chair Vogt announced that Commissioner Dwyer's term expired May 31, 2002.
Chair Vogt, seconded by Commissioner Runk, moved to recommend that the City Council
reappoint Commissioner Dwyer to a new term, effectively immediately. Carried 4 -0.
