Dear Mr. Triemert:
Enclosed herewith please find a copy of the recorded Conditional Use Permit issued to Lodge
Properties LLC for auto repair use at 1462160 St. N. This is being provided to you as contains specific
restrictions and provisions pertaining to the automotive use at this multi- tenant development and its
operation practices as part of the conditional use permit approval.
Please note that one of these provisions is that "all automobile repair activities shall be limited to
within the principal structure and the doors to the service bays shall be kept closed except when
vehicles are being moved in or out of the service areas."
If you are not currently adhering to the provision of keeping the service bay doors closed at all times,
other than when a vehicle is being move inside or out o the service area, you are requested to
immediately commence such adherence This provision is part of the terms of the conditional use
permit issued for the automotive business operations. Failure to adhere to the provisions of the
conditional use permit may result in revocation of the conditional use permit and /or misdemeanor
citation for violation of Oak Park Heights City Ordinances related to the conditional use permit.
It is imperative that you ensure that all staff is aware of the provisions contained within the
conditional use permit that affect daily operation activities, including but not limited to the provision
that the service bay doors remain closed at all times, other than when a vehicle is being moved in or
out of the bay service bay. No additional warning will be provided regarding the conditional use
permit provisions.
I appreciate your assistance in communicating the appropriate provisions to your staff and immediate
compliance with the closure of service bay doors. Please contact me anytime.

I. CONDITIONAL USE PERMIT FOR:
Date Issued: April 23, 2002
All uses shall be subject to the following conditions and /or restrictions imposed by the City Council of the
City of Oak Park Heights.
General Description:
1. That the Applicant shall be allowed to develop an outdoor used auto sales under the business name of
Motorsport Automotive, Ltd. operations shall include small engine service, brake repairs water pumps,
exhaust, engine replacement, rebuilding of transmissions and tune -ups. No auto bodywork shall be done
on site. The City hereby grants the Conditional Use Permit providing that the following conditions are
met:
1. The outdoor sales area shall be limited to not more than three parking stalls.
2. All automobile repair activities shall be conducted within the principal structure and the doors to the
service bays kept closed except when vehicles are being moved in or out of the service bays.
3. The landscape plan and existing plant materials are subject to review and approval of the City Arborist.
4, The bituminous parking surface and concrete curb are subject to Zoning Ordinance requirements and the
review and approval of the City Engineer.
5. The exterior lighting to include wall mounted and freestanding light fixtures shall be retrofitted to
confornl to Section 401.15.B,7 of the Zoning Ordinance.
6. There shall be no exterior storage of oil and flammable materials, automobile parts, parts cars, or related
items on the site. All storage shall be internal to the building. Any cars to be stored outside of the
building shall be in full working order.
7. All noise created from operations on the site shall be in conformance with Section 401.15.B.11 of the
Zoning Ordinance.
8. The automotive repair and any food operations shall be totally separated including all ventilation
systems and storage of materials in conformance with the requirements of the Washington County
Department of Health, Environment and Land Management, and the Building Official.
9. The applicant shall receive and retain a Hazardous Waste Generators License from Washington County,
if required.
10. The applicant shall receive and retain an air discharge permit from the Minnesota Pollution Control
Agency, if required.
11. All signage shall be subject to Section 401.15.G.9 of the Zoning Ordinance.
12. The applicant shall provide building plans and elevations for the improvements subject to review and
approval of the Building Official.
II. ADDITIONAL RESTRICTIONS AND PROVISIONS.
The following additional restrictions and provisions being pant of the Conditional Use Permit to be issued
herein affecting the following matters shall be:
