TUESDAY, JANUARY 12, 2010 CITY COUNCIL! MEETING MINUTES I. Call to Order /Pledge of Allegiance /Approval of Agenda: The meeting was called to order at 7:00 p.m. by Mayor I3eaudet. Present: Councilmembers Abrahamson, MCComber, Runk. and Swenson. Staff present: Administrator Johnson, Police Chief DeRosier, City Attorney Vierling, City Engineer Long, and City Planner Richards. Absent: None. Councilmember MCCOmber, seconded by Councilmember Swenson moved to approve the Agenda. Carried 5 -0. II. Department /Council Liaison Reports: A. Plannin), Commission: City Planner Richards reported that the next meeting of the Planning Commission was scheduled for January 14. He stated that the commission would be continuing discussion on design guidelines. B. Parks Commission: Councilmember McComber• reported that the next Parks Commission meeting was set for January 25 at 6:30 p.m. at City Hall, C. Cable Commission: Councilmember Swenson reported that the commission discussed the digital /analog conversion that Comcast would be doing over the next year. Ile reported that Coincast was conducting a webinar in the near future on how to do the digital conversion. D. Water Management Organizations /Middle St. Croix: Mayor I3eaudet reported that the next meeting of the Middle St. Croix Water Management Organization was set for January 14 at 7:00 p.m. at the Washington Conservation District Office. E. Other Liaison /Staff Reports: Councilmember McComber reported that there was a National League of Cities meeting that week regarding economic development and information on how City officials can deal with vacant business lots. Mayor I3eaudet reported that the Washington County League of Local Governments dinner was scheduled for January 28. III. Visitors /Public Comment: Administrative Secretary Pinski reported that Jennifer and Jed Cass of 14439 Upper 56 =) ' Street North were chosen as the recycling award winners. Citv Hall Facilitv Update: City Administrator Johnson reported that the brick on the rotunda would be installed in the near future. He stated lie spoke with the cleaning service contractor for City Hall, and the) agreed to carry over service to the new building for at least one month. Johnson staffed the contract would likely be re -bid at that time. Johnson also reported that he and Public Works Director Kegley met with Xcel l nerg;y regarding the generator switch. B. Design Guidelines Update — Set Joint Worksession with Planning Commission: Mayor Beaudet, seconded by Counci I in ember MCCon7ber, moved to schedule a joint worksession with the Planning Commission prior to the February 11 Planning; Commission meeting. Approve ADDointnients for 2010: Mayor Beaudet provided the council with his appointments for the year 2010. Mayor Beaudet, seconded by Councilmember Abrahamson, moved to approve the Resolution of appointments for 2010. Roll call vote taken. Carried 5 -0. 13. Authorization to Offer 24 -week Local Government Internshio .-Tern Position: Mayor Beaudet, seconded by Councilmember Swenson, moved to approve the intern position. Carried 5 -0. C. Summer Park Proarammin)_ - 2010: Councilmember McComber, seconded by Councilmember Swenson, moved to approve the park programming for 2010. Carried 5 -0. D. FEMA -- Floodolain Map Updates --- NFIP Participation: City Administrator Johnson reported that the City does not participate in the National blood Insurance Program because the City elevation is well above the flood plain. I-Ie reported that FEMA has been working on a map update. IIe noted from conversations with the DNR that there could be flooding from other issues such as a backup or a water main break. tie stated the council could discuss whether they wished to participate in the National Flood Insurance Program. Mayor Beaudet stated that there would be vary little cost to participate in the program. Johnson reported that FD MA was requesting that the City adopt a Floodplain Management Ordinance, and a Public Hearing would be needed. Councilmember Swenson, seconded by Councilmember McComber, moved to set a Public Hearing on the issue for January 26 and allow staff to do all necessary things to move forward. Carried 5 -0. T. Alcohol Con Failure - Grand Grille & Pizzeria: Police Chief DeRosier reported that Grand Grill & Pizzeria failed a routine alcohol compliance check on December 21, 2009, by serving alcoholic beverages to persons under the age of 21. DeRosier recommended the council impose a $500 sanction to be paid within 60 days and set a Hearing to Show Cause on January 26 in the event Grand Grille & Pizzeria wished to contest the $500 sanction. Tobacco Compliance Violation . -- Wak),reens: Police Chief DeRosier reported that Walgreens failed a routine tobacco compliance check on December 30, 2009, by selling a pack of cigarettes to a person under the age of 18. DeRosier recommended the council impose a $1,000 sanction to be paid within 60 days, impose a five -day suspension of its tobacco license from February I to February 5, and set a Hearing to Show Cause on January 26 in the event Walgreens wished to contest the $1,000 sanction and license suspension. Councilmember McComber, seconded by Counciln ember Run](, moved to set the Public I- Tearing for .January 26. Carried 5 -0. G. Consider Grant Avolication — EECBG — MN Dent. of E'nert?v Security: ------ - - - - -- - - -- - - - - - City Administrator Johnson reported that the City may apply to the State for up to $100,000 in grant fiends. Sonic suggestions for use of Iunds would be for a survey of City operations on greenhouse gas and what the City could do to become more efficient, set up a revolving loan program or grant program to subsidize or invite commercial operations in the City or homeowners to make switches ]'or energy efficiency, or look at a the City's development ordinances for energy efficiency. Johnson stated the City should provide some level of grant match to improve chances of obtaining the grant. I-le suggested a grant match from the City's Municipal Building Fund. Councilmember Swenson, seconded by Councilmember McComber, moved to approve with no objection to submitting a grant match. Carried 5 -0. VIII. The City did award Section *1 (the relocation) last fall to Linner Electric in the amount of $21,300.00. This work is to take place in spring. At that time the City did not issue an award on Section #2, the installation of the three new poles as it is awaiting a Price Request response from Jorgenson Construction. Jorgenson has responded and has supplied an arnount of $29,406.00. January 7, 2010 MEMO TO City Council Members / FR Eric John City Adm1 istr r:: �`F RE: Floodplain Ordinances EMA, ap Updates As Council Members are aware, the City of Oak Dark Heights does NOT participate in the National Flood Insurance Program. This decision not to participate has been in place for numerous years and, I presume, stems largely from the tact that little to no residential properties are anticipated to be impacted by a 100 -year flood due to their elevations or other flood protection measures taken at the time of the development - such as at Sunnyside. Recently however, FEMA has been working on updating the Base Floodplain Maps (also known as the Flood Insurance Bate Maps - "FIRM "S) for the State of Minnesota. The City has provided information and commentary on this mapping update and effort. The proposed FINAL floodplain map update is slated to become effective on Feb 3 2010. There appears to be no material deviations in the City of Oak Park heights compared to the former map established in the early 1980's. Related to this update, the City did submit information to FEMA regarding the bridge in lower Valley View Park - crossing Perro Pond, which could be flooded. Additionally, the City sent correspondence to Sunnyside Marina, Xcel Energy and the MET Council's Wastewater treatment plant advising them to monitor and comment on these map updates. To the best of my knowledge, these groups likely agreed with the proposed FIRMS as the City received no response from these entities, nor did they submit further information. (I have attached copies of such correspondence here to as EXHIBIT A). Largely because of this update, the question has again arisen as to the City joining the National Flood Insurance Program. Page 32 of 142 FEMA generally cites seven (7) "EFFECTS of NON- Parficipation" see EXHIBIT B. However many of the items noted in this document would practically not affect any homeowner in the City, as there are not homes in Oak Park Heights that are in the floodplain as the City has regulated these issues to date via the City's Riverway District -- Ordinance 401.34, (Attached as Exhibit C). Carefully note the City's current ordinance does by reference adopt the State standards for Development in the floodplain area, generally lying east of STH 95 and the railroad righf -of -way. In examining the new floodplain maps, if would appear that a flood of significant proportions, well beyond the scope of any flood witnessed to date would be required to impact lands west of STH 95. While, there is some possibility of flooding in the Perro Creek area, this would be a very unique and highly unlikely situation considering the topography. Another aspect to consider is how the NFIP processes floods in situations where flooding is not due to a typical flooding event caused in /by the St. Croix River levels; rather how does the NFIP impact home or communities if for example, a water main break floods an area or a localized storm sewer becomes plugged. Certainly, there may be coverage from the City L.M.C.I.T., it the City is found abjectly negligent; however membership in the NFIP may be a required antecedent for private home flood insurance to be either available or in- effect. Lastly, it is possible that in the future joining the NFIP may be mandatory it ANY Federal Aid any disaster aid is to be provided to a city. Current documents appear to only withhold aid to non -NFIP cities for helping in specific areas that are in the floodplain. It joining the NFIP is desired, the City musts 1 o Set and hold a Public Hearing on the proposed new Floodplain Management Ordinance (Attached here as Exhibit D) - Proposed Date Jan 26th, 2010. 2. SECTION 7.0 SUBDIVISIONS `Note: This Section is not intended as a substitute for a comprehensive city or county subdivision ordinance. It eau, however, be used as an interim control until the cortrl)r•eliensive subdivision ordinance can be amended to include necessary flood plain management provisions. 7.1 Review Criteria: No lands, , mider this Chapter -shall be subdivided which is unsuitable for the reason of flooding, inadcquatc drainage, water supply or sewage treatment facilities. All lots within the flood plain districts sllal l be able to contain a building; site outside of the Floodway District at or above the regulatory flood protection elevation. All subdivisions shall have water and sewage treatment facilities that comply with the provisions of this Ordinance and have Toad Access both to the subdivision and to the individual building sites no lower than two feet below the regulatory flood protection elevation. Railroad tracks, roads, and bridges to be located within the flood plain shall comply with Sections 4.0 and 5.0 of this Ordinance. Any sewage treatment system designed in accordance with the State's current statewide standards for on -site sewage treatment systems shall be determined to be in compliance with this Section. Therefore, we conclude from our review of the permit file application materials submitted for this project, that there will be a minimum encroachment, change, or damage to the environment, particularly the ecology of the waterway (section 103G.245, subd. 7), The final plan for material handling and disposal will be at the contractor's discretion once the bid has been let, however, such plans roust be submitted to this office for DNR approval in accordance with Condition 916 of the permit. We would also like to see a copy of the erosion control, sediment control and water quality management plan so that we can assure compliance with condition #12 of the permit. The apparent problem is an elevation difference between the storm sewer inlet to a drainage pond and a culvert exiting the pond is not significant. The storm sewer line holds water which erodes the grout and in winter freezes and thaws, potentially breaking or separating the pipe, Further investigation is needed to expose the exact failure location(s); however the effects of a failure are apparent at eroding catch basins on the east and west side of O'Brien Ave N as well as undermining of 53' Street N. Repairing/ replacing the storm sewer and catch basins will prevent the street from undermining. Project Overview Simply replacing the storm sewer and catch basins may alleviate erosion and undermining for a short period; however a solution to prevent water storage in the storm sewer line should be the ultimate goal. If preventing water storage in the storm sewer line is not feasible the pipe and catch basins should be lined with a water tight substance to, at a minimum help prevent erosion of grout and subsequently erosion around catch basins and undermining of the street. The estimated construction cost of this project is based on replacing the existing roughly 50' of 15" pipe, 40' of 30" pipe, and 90' of 36" pipe as well as two catch basins. The swale directs area storm water flow from 62 " Street N to an existing culvert/catch basin just west of Lookout Trail. The concrete swale is broken in several sections and undermining of the rock base is evident. An existing 30" storm sewer line exists near the termination of the existing swale, Proiect Overview This project would install two catch basins and roughly 200' of underground storm sewer to replace the above ground concrete swale. The new storm sewer would tie into the existing 30" line which terminates in a wooded area between Peabody Ave and Hwy 36. The impact to the general public would be minimal as most work would occur on an easement between private properties.
