DRIVERS' LICENSES AND DRIVER TRAINING SCHOOLS
AN ORDINANCE REGULATING DRIVERS' LICENSES AND DRIVER TRAINING SCHOOLS,
AND THE OPERATION OF MOTOR VEHICLES IN ACCORDANCE WITH THOSE
REGULATIONS UPON THE STREETS AND HIGHWAYS OF THE CITY OF OAK PARK
HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AND PROVIDING FOR PENALTIES
FOR VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA, DOES ORDAIN:
1114.01 Drivers' License and Driver Training Schools.
Except for Sections 171.05, 171.06, 171.07, 171.12, 171.13, 171.14, 171.15, 171.16,
171.17, 171.18, 171.19, 171.21, 171.26, 171.28, 171.29, 171.31, 171.32, 171.36,
171.38 and 171.41, Minnesota Statutes 1969, Chapter 171, as amended by the laws
of 1976, known as the Drivers License and Driver Training Schools Act is hereby
adopted as the Drivers License and Driver Training Schools Ordinance of the City of
Oak Park Heights, Washington County, Minnesota. Every provision contained in
said statute is hereby adopted and made part of this Ordinance by reference as if fully
set forth herein.
1114.02 License Reauired.
A. No person shall drive a motor vehicle as a chauffeur on any public street or
highway in this City unless licensed as such by the State of Minnesota,
except that a non - resident chauffeur, licensed under the provisions of the law
of the country, state, territory, province or district of his residence, operating
such motor vehicle temporarily within this state not more than sixty (60) days
in any one year, and while having in his immediate possession the license
assigned him as such chauffeur in the country, state, territory, province, or
district of his residence shall be exempt from such license requirements.
B. The term "Chauffeur" includes:
1. Every person, including the owner, who operates a motor vehicle
while it is in use as a carrier of persons or property for hire;
2. Every person who is employed for the principal purpose of operating
a passenger vehicle;
3. Every employee who, in the course of his employment, operates upon
the streets or highways a truck, tractor or truck- tractor belonging to
another and;
4. Every person who drives a school bus transporting school children;
but does not include employees who, in the course of their
employment, operate upon the streets and highways light trucks
classified as pickups, panels and sedan deliveries which are used only
to carry tools, repairs, light materials, and equipment used by the
driver in the furtherance of some other and principal occupation,
crawler tractors, farm and industrial wheel type tractor, self - loading
motor scrapers, front end loaders, motor graders, crawler mounted
construction equipment and farm trucks operated by the owner or an
immediate member of his family, or an employee not primarily
employed for the purpose of operating the farm truck.
1114.03 School Bus Drivers License Reauired.
No person shall drive a school bus unless he holds a valid school bus driver's license
from the State of Minnesota.
1114.04 Owner Allowing Non - Licensed Person to Drive.
No person having possession or control of a motor vehicle shall knowingly authorize
or allow the same to be driven or operated by any person prohibited from driving or
operating such vehicle.
1114.05 Penaltv.
Any person convicted of violating any of the provisions of this Ordinance shall be
guilty of a misdemeanor and shall be punished by a fine of not to exceed Seven
Hundred Dollars ($700.00) or by imprisonment for a period not to exceed ninety (90)
days, or both; but if a minimum fine or imprisonment is prescribed by the State
Highway Traffic Act for an offense, such penalty shall apply to a person convicted of
the same offense under this Ordinance.
