HomeMy WebLinkAboutCc1123 1123 AN ORDINANCE FORBIDDING THE POSSESSION OF TOBACCO BY CHILDREN. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA DOES ORDAIN: 1123.01 Definitions. For the purpose of this Section, the following terms shall have the meanings respectively ascribed to them in this Section: A. "Tobacco" means cigarettes; cigars; cheroots; stogies; perique; granulated, plug, cut, crimp cut, ready rubbed, and other smoking tobacco; snuff, snuff flower; cavendish; plug and twist tobacco; fine cut and other chewing tobaccos; shorts; refuse scraps, clippings, cuttings and sweepings of tobacco; and other kinds and forms of tobacco, prepared in such a manner as to be suitable for chewing or smoking in a pipe or other tobacco related devices. B. "Tobacco Related Devices" means cigarette papers or pipes for smoking. 1123.02 Offense. Whoever possesses tobacco or tobacco related devices and is under the age of eighteen (18) years is guilty of a juvenile petty offense. 1123.03 Adontion by Reference. The provisions of Minnesota Statutes 609.685 are herewith adopted by reference. The prohibitions of this Ordinance shall be in addition to the regulations contained within Minnesota Statutes 609.685 regarding the sale of tobacco to children.
