HomeMy WebLinkAboutCc302 302 AN ORDINANCE PROVIDING FOR THE ISSUANCE OF CONTRACTORS' LICENSES OF INDIVIDUALS, FIRMS, CORPORATIONS, CONTRACTORS, AND SUB- CONTRACTORS DOING OR PERFORMING WORK WITHIN THE CITY OF OAK PARK HEIGHTS AND PROVIDING PENALTIES FOR VIOLATIONS. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, DOES ORDAIN; 302.01 Purpose. That it is deemed in the interest of the public and the residents of the City of Oak Park Heights that the work involved in building, alteration, repair, and construction of buildings, the installation of various appliances and service facilities in and for said buildings, including all carpentry work, landscaping, and snow removal, be done only by individuals, firms, and corporations that have demonstrated or submitted evidence of their competency to perform such work in accordance with the applicable codes and ordinances of the City of Oak Park Heights regulating the same. 302.02 Permits. The permits which are issued under Ordinances 301, 304 and 305 and ordinances amendatory thereto of the City of Oak Park Heights, shall be issued only to individuals, firms, or corporations holding a contractor's license, except hereinafter noted. 302.03 Application and Approval. Application for contractor's license shall be made to and approved by the Building Department for the City of Oak Park Heights upon proof of the applicant's qualifications therefor and therein that it is conditioned upon the ordinances of the City. No individual, partnership, corporation, or other business association holding license from the State of Minnesota and bonded to said state, shall be required to pay a license or registration fee, or to file a bond with the City of Oak Park Heights provided that a copy of the license or such other evidence of license or bond with the State of Minnesota is provided to the City's Building Department. Application for said contractor's license above described shall be further conditioned upon the filing of certificates evidencing the holding of public liability insurance in the limits of $100,000.00 per person and $250,000.00 per accident for bodily injury and $100,000.00 for property damage and certificates of workman's compensation insurance as required by law." 1 302.04 Fees The annual fee for each such contractor's license shall be established by City Council resolution, from time to time. Said contractor's license shall expire December 31 of the year issues, irregardless of issue date and said fee shall not be prorated. 302.05 Contractor's Licenses. A Contractor's license shall be obtained by every business or individual engaging in the following businesses or work in accordance with the applicable ordinances of the City of Oak Park Heights. Businesses or individuals engaging in the following businesses that are required by the State of Minnesota to have a Minnesota State Licensed for their trade shall be required to provide documentation verifying a valid license: A. Building, altering, repairing and constructing buildings or structures, installing major appliances and service facilities. B. General contractors in the business of building construction, including carpentry work. C. Masonry and brick work. D. Plumbing, including the installation of cesspool, septic tank, drain fields, connections to Municipal system, and inside plumbing. E. Roofing and insulation. F. Plastering, stucco work, sheet rock taping. G. Heating, ventilation, and refrigeration. H. Gas piping, gas services, gas equipment installation. I. Oil heating and piping work. J. Water supply system installation construction, and connection. K. Sanitary sewer system installation, construction, and connection. L. Excavations, including excavation for footings, basements, sewer and water line installation. M. Moving and wrecking of buildings. 2 N. Sign erection, construction and repair, including billboards and electrical signs. O. Street work, driveway construction and repair, sidewalk construction, and repair and basement construction. P. Landscaping /Irrigation (Sprinkler) Systems. Q. Snow removal. R. Fire Protection Systems. Nothing herein shall be construed as preventing any such qualified permittee from performing the work by an employee under his supervision and control. 302.06 Exemptions. A. Public Service corporations shall not be required to obtain contractor's permits for work upon or in connection with their own property except as may be provided by other ordinances. B. Manufacturers shall not be required to obtain contractor's permits for work incorporated within equipment as a part of manufacturing, except as may be provided by other ordinances. C. Individual homeowners shall not be required to obtain contractor's permits for work done by themselves upon or in connection with their own property, except as may be provided by other ordinances. 302.07 Penaltv. A person, firm, or corporation who shall violate any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not more than One Thousand Dollars ($1,000.00) for each offense, or by imprisonment for not more than ninety (90) days, or any combination thereof. 302.08 Liabilitv. This Ordinance shall not be construed to affect the responsibility or liability for any party owning, operating, or installing the above described work for damages to persons or property caused by any defect therein, or shall the City of Oak Park Heights be held as assuming any such liability by reason of the licensing of persons, firms, corporations engaged in such work. 3 302.09 Constitutionalitv. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Oak Park Heights hereby declares that it would have passed this Ordinance, any section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. 4
