AN ORDINANCE ADOPTING THE MINNESOTA STATE PLUMBERS CODE: REQUIRING
ISSUANCE OF PLUMBING PERMITS AND PAYMENT OF FEES ESTABLISHING THE
OFFICE OF PLUMBING INSPECTOR AND PROVIDING PENALTIES FOR VIOLATIONS.
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA, DOES ORDAIN:
304.01 State Plumbing Code Adonted.
The City Council of the City of Oak Park Heights, for the purpose of prescribing
regulations governing the installation, maintenance, and repair of plumbing systems
in the City of Oak Park Heights, hereby adopts that certain code known as the
Minnesota State Plumbing Code, as amended and filed with the Secretary of State,
Department of Administration of the State of Minnesota. Said code is hereby
adopted and incorporated as fully as if set out at length herein, and shall be in force
and effect in the City of Oak Park Heights insofar as applicable to plumbing and
building construction therein. All work done hereafter in the City of Oak Park
Heights shall be done in accordance with the provisions thereof.
304.02 Conies of Code to be Filed.
A copy of the above code, as aforesaid, shall be available at the City of Oak Park
Heights offices for inspection and use of the public. This Ordinance shall become
effective upon such filing and upon the publication hereof as required by law.
304.03 Permits Required.
Before proceeding with any plumbing construction, enlargement, alteration, or
repair, the owner of the property where such plumbing is proposed, or his agent, shall
first obtain a permit for such purpose from the City Building Department.
Application for such permit shall show the owner of the property, the legal
description of the property where the work is proposed, the nature of the proposed
work, and the identity of the contractor who is to perform the work.
304.04 Permit Fees.
The City Council shall determine fees for the issuance of plumbing permits and
reinspection of work found defective and in need of correction and reinspection
by resolution, from time to time.

304.05 Plumbing Inspector.
The City Council shall employ a Plumbing Inspector, who shall serve at the pleasure
of the Council, and determine his compensation from time to time. The Plumbing
Inspector shall enforce the code hereby adopted. Wherever the designation
"Administrative Authority" is used in said code, it shall be held to mean the City
Council of the City of Oak Park Heights and its agents and employees, including but
not limited to the Plumbing Inspector of said City.
304.06 Anneals.
Whenever the Plumbing Inspector of the City of Oak Park Heights shall disapprove
an application or refuse to grant a permit applied for, or when it is claimed that the
provisions in this Ordinance do not apply or that the true intent and meaning of the
Ordinance has been misconstrued or wrongfully interpreted, the applicant may
appeal from the decision of the City Plumbing Inspector to the City Council of the
City of Oak Park Heights, within thirty (30) days from the date of the decision of
appeal.
304.07 Plumber's License Reauired.
No person shall engage in or work at a business of a Master Plumber in the City of
Oak Park Heights unless licensed to do so, by holding a State of Minnesota Master
Plumber's license and providing a coy of the same for City record keeping.
304.08 Enforcement.
It shall be the duty of the Plumbing Inspector designated by the City Council to
enforce the provisions of this Ordinance. All plumbing work hereafter constructed
shall be inspected and if found not to be in accordance with the said code, shall be
corrected. If after written notice to the person installing work requiring correction
thereof, such person neglects or refuses to conform to such order, the City or any
duly appointed inspector may remove such work and charge the cost thereof to the
person installing the same. At least two (2) inspections shall be required, one when
the rough work is completed and one upon completion of the work. The provisions
of this section are in addition to and not in lieu of the State Plumbing Code.
304.09 Penaltv.
Any person violating any provision of this Ordinance shall, upon conviction thereof,
be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by
imprisonment for not exceeding ninety (90) days, or both.
