PUBLIC MORALS AND WELFARE CODE
AN ORDINANCE DEFINING CERTAIN OFFENSES INVOLVING PUBLIC MORALS AND
WELFARE AND PRESCRIBING PENALTIES AND VIOLATIONS THEREOF.
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA, DOES ORDAIN:
1105.01 Definitions.
A. "Person" includes any person, firm, or corporation and the singular shall
include the plural.
B. "Public Place" includes streets, alleys, and sidewalks, dedicated for public
use and shall also include such parts of buildings and other premises, whether
publicly or privately owned, which are used by the general public, or to
which the general public is invited commercially for a fee, or otherwise, or
on which the general public is permitted without specific invitation.
1105.02 Bei2�i6ni2�.
No person, in any public place or private place, shall beg from strangers for money
or other property other than solicitation for recognized charities.
1105.03 Lurking.
No person, in any public or private place, shall lurk, lie in wait, or conceal with
intent to do any mischief or to commit any crime or unlawful act.
1105.04 Breach of Peace.
No person, in any public or private place, shall engage in, prepare, attempt, offer, or
threaten to engage in, or assist or conspire with another to engage in, or congregate
because of, any riot, fight, brawl, tumultuous conduct, act of violence, or any other
conduct which disturbs the peace and quiet of another, save for participating in a
recognized athletic contest.
1105.05 Peeping.
No person, in any public or private place, shall enter a toilet designated for the use of
the opposite sex or look into any window or opening for an indecent, immoral or
unlawful purpose.
1105.06 Noise in Residential Areas.
A. No person shall, between the hours of 10:00 p.m. and 7:00 a.m., congregate
because of or participate in any party or gathering of people, or any place of
business located near any residential area, from which noise emanates of a
sufficient volume as to disturb the peace, quiet, or repose of persons residing
in any residential area.
B. No business shall operate on Sunday that emanates noise of a sufficient
volume that will disturb the peace, quiet, or repose of persons residing in any
residential area.
C. No person shall visit or remain within any residential dwelling unit wherein
such party or gathering is taking place except persons who have gone there
for the sole purpose of abating the disturbance.
1105.07 Profanitv and Obscenitv in Public Places.
No person shall, in any public place, use any profane or obscene language or gestures
to, or in the presence of, another or to the annoyance of other persons in public
places.
1105.08 Indecent Conduct.
No person, in any public place or private place, shall engage in, or offer to engage in,
or congregate because of:
A. Lewd, lascivious, or immoral conduct,
B. The use of slanderous, foul, obscene, or indecent language,
C. The indecent or lascivious exposure or use of the human body, or any
part thereof, or
D. Behavior, whether by words or acts, of a nature to corrupt the public
morals or to outrage the sense of public decency.
1105.09 Exhibiting Obscene Matter.
No person, in any public or private place, shall prepare, exhibit, or transfer in any
manner to another, or offer to do so, or prepare, exhibit, or transfer to another,
whether or not for consideration, any obscene or indecent writing, picture,
photograph, drawing, design, model, or object, or have any thereof in possession
with intent to transfer or exhibit.
1105.10 False Motel Reiistration.
No person shall register or knowingly permit himself to be registered, in any motel or
similar establishment under other than his true name, or as the spouse of any person
not his spouse.
1105.11 Pandering.
No person, in any public or private place, shall secure, or offer to secure, or entice or
attempt to entice, another to engage in unlawful sexual intercourse, prostitution, or
any lewd, lascivious, or indecent act; nor shall any person accept knowingly any part
of the earnings of a female from prostitution.
1105.12 Participating in a Disorderly House.
No person shall own, lease, operate, maintain, reside in, visit, or entice or attempt to
entice another to reside in or visit any building or place with knowledge that
unlawful sexual intercourse, prostitution, lewd, lascivious, or indecent acts, gambling
or the unlawful sale of intoxicating liquor or non - intoxicating malt liquor occurs
within. Evidence of the general reputation of such building or place, as one where
any of the foregoing occurs, shall be prima facie evidence of such knowledge.
1105.13 Penaltv.
Any person, firm, partnership, or corporation who shall violate any portion of this
Ordinance shall be guilty of a misdemeanor and, upon conviction thereof, be fined a
sum not to exceed Seven Hundred Dollars ($700.00) or imprisonment for a period
not to exceed ninety (90) days, or both.
