AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF OAK PARK
HEIGHTS TO INCLUDE A SECTION 1121 RELATING TO THE PLACEMENT OF REFUSE
DUMPSTERS UPON THE PUBLIC STREETS OF THE CITY OF OAK PARK HEIGHTS,
MINNESOTA
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA, DOES ORDAIN:
1121.01 Definitions:
"Refuse Dumpster" is any portable container used or designed for collection of,
transportation, or disposal of refuse, waste, demolition materials, or the like which
has exterior dimensions in excess of six and one -half (6 -1/2) feet in width or twelve
(12) feet in length or five and one -half (5 -1/2) feet in height. Refuse Dumpster shall
include, but is not limited to, "roll off' boxes, and portable storage containers.
1121.02 Rules
A. No person shall place a Refuse Dumpster upon any street within the City.
B. Any such Refuse Dumpster in violation of this Ordinance may be summarily
removed without notice to the owner or operator by officers of the police
department of the City of Oak Park Heights, or persons employed or
designated by them, and stored in any appropriate place.
C. All necessary costs and expenses of towing, removing, and storing of such
Refuse Dumpsters shall be first paid to the person or persons designated, by
the person claiming the Refuse Dumpster before release of the same.
D. The City of Oak Park Heights shall not be responsible for any damages to
such Refuse Dumpsters removed in accordance with the provisions of this
Ordinance.
1121.03 Hardship.
A. The City Building Inspector may, upon written application by property owner
or an agent of the property owner, allow the placement of a dumpster upon a
City street if the particular physical surroundings, shape, or topographical
conditions unique to the property does not reasonably allow for placement of
a dumpster upon private property, creating a hardship to the property owner.
B. The City Building Inspector may, after written application for relief,
physically inspect the property to verity the existing hardship.

C. Upon finding of hardship by the City Building Inspector, the City Building
Inspector may issue a written permit specifying the location of the placement
of the dumpster upon a city street and the length of time the dumpster may
remain in that location upon the city street.
