REGULATION OF THE USE OF MOTORCYCLES AND MOTOR BICYCLES
AN ORDINANCE RELATING TO MOTORCYCLES AND MOTOR BICYCLES, REGULATING
THE USE AND OPERATION THEREOF AND PROVIDING PENALTIES FOR THE
VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA, DOES ORDAIN:
1104.01 Definitions.
A. "Motorcycle" is every self - propelled motor vehicle having a saddle for use of
the rider and designed to travel on not more than three (3) wheels in contact
with the ground.
B. "Highways" include any street, avenue, alley, or public way used for public
travel within the City.
1104.02 Muffler Reauired.
Every motorcycle shall, at all times, be equipped with a muffler in good working
order which blends the exhaust noise into the overall vehicle noise and is in constant
operation to prevent excessive or unusual noise. No person shall use a muffler
cutout, bypass, or similar device upon a motorcycle on a street, highway, or public
way. The exhaust system shall not emit or produce a sharp popping or cracking
sound.
1104.03 Rules and Reiulations.
A. It is unlawful to operate a motorcycle between lanes of moving or
stationary vehicles headed in the same direction, or drive a motorcycle
abreast of or overtake or pass another vehicle within the same traffic lane,
except that motorcycles may, with the consent of both drivers, be operated
not more than two abreast in a single traffic lane.
B. No motorcycle shall be operated or parked upon any public sidewalk within
the City.
C. Motorcycles shall be subject to the same traffic laws and regulations of the
City and State of Minnesota, as are other motor vehicles except where
motorcycles are expressly exempted therefrom.
D. No stunts, drills, acrobatic, racing, or games of any sort on motorcycles are
permitted on any City highway, street, alley, or public way, within the City,
without the prior approval of the City Chief of Police.
E. Motorcycles shall be operated in such manner as to minimize any
disturbances to the public and shall not unreasonably annoy or disturb the
comfort or repose of any considerable number of members of the public by
engine noise, horn, noisy acceleration and any other audible disturbance
resulting from such motorcycle operation.
F. No motorcycle shall be driven across or upon any private property without
the written permission of the owner thereof, express or implied.
1104.04 Penaltv.
Any person who violates any provision of this Ordinance, upon conviction thereof,
shall be punished by a fine not exceeding Seven Hundred Dollars ($700.00) or by
imprisonment for a period not exceeding ninety (90) days, or both.
