I have seen the concept plans presented . b AI G at the Plannin Commission hearin on November 14th, and the overall development should be a si contribution to the Cit of Oak Park Hei even thou it is inconsistent with the desi g uidelines adopted b the Cit after several y ears of stud I Nevertheless it is important that I inform the Cit of m concern about the mana of the storm water runoff that the Kohl's site will g enerate when full developed. As y ou know, tht Cit rules for submission of a stormwater mana plan have not been followed in this case. I I cannot determine, therefore, whether stormwater from the site, when full developed, will impact the stormwater mana plan that I must submit when I seek development approval for the land that I own that adjoins the Menard's store. Please consider this letter as notice to the Cit that I will vi contest an stormwater plan that AIG proposes that sends its stormwater runoff to m land, if that plan then results in a future re that I provide additional land for stormwater runoff when I develop m land. I am sendin this notice at this time because the site plan approval process is desi to allow these kinds of conflicts to be addressed prior to development, when the are most easil resolved. Mr. Dennis Postler November 19, 2002 Page two In resolving this storrnwater conflict (if any exists), the City should take into account AIG's statement that while their site could accommodate a pond for their stormwater, it would be more financially lucrative for them if the water could be sent off site, thereby increasing the amount of commercially useable land. However, that solution is unacceptable if I am then forced to decrease the useable land I own to provide ponding for AIG's water. Clearly, the City should not resolve a stormwater conflict on the basis of financial benefit for one landowner if that results in the financial detriment of another. Further, I spent several hundred thousand dollars in 1996 to construct a six -acre stormwater pond (in a 60 -acre parcel) that was sized to accommodate all the stormwater that my land would generate when fully developed. Of course, I will be pleased if the AIG plan does not send any stormwater to my land. If their plan does propose to do so, however, I insist upon advance notice of any public meeting or hearing held by the City that will consider such a plan. Moreover, I request that any stormwater plan, when filed by AIG be sent to me, and any written response by any city official to that plan be sent to me also. I hope you understand that this letter is neccessary because of the unorthodox approach that the City has taken with the AIG proposal, and my concern that my rights as a landowner may be affected as a consequence.
